CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease is entered into by and between:

That we, SPS. RONNIE O. ALDAVE & DEVELYN B. ALDAVE of legal age,
Filipino Citizen, resident of Blk. 17 Lot 30 Annex 35 Brgy. Don Bosco, Parañaque City,
hereinafter referred to as the LESSOR;

-and-

LAURO T. CRUZ of legal age, Filipino Citizen, married resident of Lot 20 Blk 18
Barnabas St., annex 35 Better Living Subd., Parañaque City, hereinafter called the
LESSEE.

WITNESSETH:

That the LESSOR hereby leases unto the LESSEE and the latter hereby accepts in lease
fromt he owner of residential space, located at Lot 20 Blk 18 Barnabas St., annex 35 Better
Living Subd., Parañaque City.

The terms and condition of this lease are as follows:

1. PURPOSE: The leased property shall be used only and exclusively by the LESSEE
for residential purposes and shall not be diverted to any other uses. It is hereby
expressly agreed that if at any time the leased property is used for other purposes the
LESSOR shall have the right to immediate rescind this contract without judicial
intervention.
2. TERM: The term of lease is for THREE (3) YEARS commencing on
SEPTEMBER 8, 2020 . Within one (1) month immediately before it expires, this
lease may be renewed under such term and conditions as may be mutually agreed
upon both parties.
3. MONTHLY RENTAL: The monthly rental for the leased property shall be
FIFTEEN THOUSAND PESOS (P15,000.000) Philippine Currency. All payments
shall be in form of CASH.
4. SECURITY DEPOSIT/ADVANCE RENTAL: The LESSEE shall pay the
LESSOR __________ months security deposit in the amount of
________________________________________________and _________________
____________________ upon signing of this contract and prior to moving in the
leased property. The ______________________ security deposit shall answer for the
unpaid bills for water, electric, internet, telephone, for damages caused to the leased
property, and to guarantee as well the faithful performance by the LESSEE of her
obligations under this contract. In no case shall the security deposit be used to answer
for any unpaid rent.
5. PUBLIC UTILITIES: The LESSEE shall pay for telephone, electric, water, internet,
and other public services and utilities during the duration of the lease.
6. REFUND OF SECURITY DEPOSIT, Refund of the security deposit shall be made
within fifteen (15) days from the expiry date of this contract and only if the LESSEE
completed/stayed in the leased property for _____________________________
7. ear as agreed upon and provided further that there are no unpaid utility bills and
damages caused to the leased property by the LESSEE. The LESSEE agrees to pay
one hundred (Php 100.00) PESOS as penalty for every day of delay in the payment of
rental.
8. PRE TERMINATION OF CONTRACT/ABANDONMENT OF THE LEASED
PROPERTY. In case of pre termination of this contract or abandonment of the
leased property by the LESSEE for whatever reasons, the LESSOR has the right to
forfeit it all the security deposit and advance rental already given to the LESSEE as
penalty and compensation for liquidated damages, without prejudice to further right
of the LESSOR to file a claim for sum of money for back rentals and unpaid utility
bills, and for damages caused to the leased property against the LESSEE.
9. ILLEGAL AND PROHIBITED DRUGS. The LESSEE is prohibited from
keeping/storing in the leased property illegal and prohibited drugs.
10. PETS AND ANIMALS: The LESSEE is prohibited from takin in and keeping any
kind of pet animal inside the leased property without the written consent of the
LESSOR.
11. PROHIBITION OF SUB-LEASE: The LESSEE is strictly from sub leasing the
leased property or any part/portion thereof to any third party/person
12. MINOR REPAIR/MAINTENANCE: The LESSEE shall responsible for the minor
maintenance and repair of the leased property such as plumbing, electrical and the
like, during the existence of this lease contract. No permanent improvement or
structure of strong material should be erected by the Lessee on the premises or
property. Any building structure of improvements constructed on, shall restore to its
original design upon termination of this Contract.
13. The LESSOR is free from any civil or criminal liability for crimes or offenses
committed by the LESSEE, her households, relatives, and guest, inside the leased
property and while this leased property is in effect.
14. This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.
