At the end of the Module 1, the student will:
 explain the concept of the Criminal Justice System;
 appreciate the functions of the five pillars; and
 understand the various terminologies used in studying this course.

Question: Who are the parties in Criminal Case?
Answer: Accused, Victim/Complainant and People of the Philippines

Content Focus: (Content)

The Essence of Justice

Criminal Justice System – The machinery of the state or government, which enforces the rules of conduct
necessary to protect life and property and maintain peace and order.

CJS is a Social Institutions and a System:


Social Institution – The system attempts to meet society’s needs for law and order.
System – Criminal Justice System depends on due process involving the five pillars.

Characteristics of the Philippine Criminal Justice System


1. Spanish- and Anglo-American Law
2. Common Law
3. Criminal Law
4. Litigation is adversarial in nature

Goals of CJS

Primary goals of CJS:


1. Protection of the Members of the Society
2. Maintenance of Peace and Order

Secondary Goals of the CJS:


1. Prevention of crime.
2. Suppression of criminality.
3. Review the legality of existing rules and regulations.
4. Judicial determination of guilt or innocence of those arrested and/or under trial

Criminal Law – is the branch of public law, which defines crime, treats of their nature and provides for
their punishment.

The Basic Principles of Criminal Law


1. The Presumption of Innocence – It means that those who are accused of crimes are considered
innocent until proven guilty.

2. The Burden of Proof – it means that the government must prove beyond reasonable doubt that the
suspect committed the crime.
“beyond reasonable doubt “ -excluding all the possibility of error and produces absolute
certainty.

People involved in the system (Parties to the criminal case)


1. Accused = The most pampered party in a criminal case.
2. Victim/complainant = The forgotten party in a criminal case.
3. People of the Philippines = The actual offended party.
