Your petitioner is a law abiding and bonafide citizens of | The humble petition on behalf of the Writ Petitioner above named most respectfullyand residing at the address mentioned in the cause title hereinal 2. The respondents are all the ‘State Authorities’ and/or its agencies and/or instrumentalities, coming under the scope, purview and ambit of Article 12 of the Constitution of India. The acts, actions, conducts and inactions on the part of the respondents are subject to judicial scrutiny and review. The petitioner has been affected, aggrieved by the act and/or decision of the respondent commission, its men and/or agents for tie arbitrary selection process adopted by the Respondent Authority and the relief prayed for by the petitioner against the respondents herein would affect the petitioner. The act of the Respondent Authority has resulted in an infringement of right of relief to exist in the petitioner against the respondents, its men and agents as your petitioner 1s more qualified for the primary teacher than other appointed candidates, The petitioner herein is a physically handicapped person with 100% visual impairment and appeared in the selection process held by the Respondent Authorities on 17% June, 2012 and ai appearing in the said examination the petitioner’s name appeared in the call list published by the Purba Medinipur District Primary Schoo Council on 19.10.2012 in the panel for PC_ Ear category, but one o! sudden the petitioner came to know that the name which appeared in the final cail list was a typographical error and for this he was unable to join in the said post for primary teacher. Knowing such factpetitioner filed one RTI application dated 3" January 2013 Chairman, District Primary School Council seeking informatie. regarding the score and how many candidates were being appointed in the primary teacher post as per the recruitment 2009 of District Primary School Council Purba Medinipur and after getting reply from the Respondent Authority, your petitioner came to know the petitioner came to know that he got lowest score than the lower score obtained candidate which is 21.08 and also came to know the name was appeared in the list was clerical mistake. Upon knowing the fact the petitioner informed the same fact to the Court of Chief Commissioner for Persons with Disabilities informing the same fact for non appointment of as a primary teacher as per the recruitment 2009 published by the Purba Medinipur District Primary School Council On 10 April, 2023 the petitioner filed another RTI application under Right to Information Act, 2005 for certain quarries but the Respondent Authorities unable to provide the information according to the petitioner Finding no other way the petitioner is filing this instant writ application with a hope to get a proper adjudication from this Hon'ble High Court. 4. Your petitioner states that your petitioner is a blind and physically handicapped person with 100% vision impaired and got certificate from the Government of West Bengal Contai Sub-divisionai Hospital at the time of certification of his disability Photocopy of the disability c ficate along with the medical Ycertificate for physically handicapped person are annexed anc collectively marked as Annexure-P/ 1. 5. Your petitioner states that your petitioner appeared in selection process for the post of primary teacher on 17% June, 2012 held by the Purba Medinipur District Primary School Council holding enrolment No. 600504 and qualified in the jew call amination and got an int from the said council which was hi on 8% September, 20 around 10.00 am at the Tamralipta Mahavidyalaya, Tamluk, Purba Medinipur. Copy of the application form along with admit card and the interview letter are annexed and collectively marked as Annexure-P/2. 6. Your petitioner states that one intimation he got from the set council on 19% October, 2012 on around 5.04 pm where wt has been stated that all testimonials and certificates of the petitioners should be submitted before the council within 1* November, 2012 to 17% November, 2012 on working days for further verifications and on such date the petitioner submitted all the documents as per the requirements of the council. Copy of the intimation letter is annexed herewith and marked as Annexure-P/3 7 Your petitioner states that after verification of all the testimonials and all the certificates by the Respondent Authorities.the petitioner waited till 21% December, 2012 knowing that others were getting appointment in the said post of primary teacher. The petitioner visited at the office of the District Primary School Council Purba Medinipur and got information due to some clerical mistake the petitioners did not get any call from the council. 8. The petitioner states that despite of getting any information your petitioner file one RTI application before the Chairman, Purbu Medinipur District Primary School Council seeking some information regarding the academic score, how many seats were reserved for disabled persons and the details (marks in subjective academic score, marks in OMR total in written marks in Viva-voce marks in co- curriculum activities and rank) of the appointed candidates by Purba Medinipur District Primary School Council. 9. Your petitioner states that upon receiving the said RTI letter from the petitioner the Chairman of the said Council replied that the score of the petitioner is much lower than the lowest score of the empanelled candidates as the petitioner obtained 21.08 marks where the lowest core of the panel PC-EYE category is 22.092 and the said council also disclosed, it happened due to the clerical mistake in percentage of marks without additional subject in Madhvam Pariksha of the said candidate of the petitioner was entered as 78,75 instead of 68.75. For that academic sore was recorded as © S though actually it would be 08.25 in the case of the petitioner. it has also disclosed by the said council that initially the name of the Aepetitioner has been empanelled but after verification of the academic records the mistake was noticed and corrected in due course taking academic score as 8.25 and gradually it was found by the council that the total score of the petitioner is lower than the lowest score of the panel and the name of the petitioner was excluded from the panel. Photocopy of the said letter dated 21% February, 2013 alone with the list of panel are annexed and collectively marked os Annexure-P/4. 10. Your petitioner states that after getting such information from the Chairman of the Council the petitioner went into depression and with no other option left the petitioner informed the said fact to the Court of Chief Commission for person with disabilities by disclosing the entire fact of illegalities done by the Respondent Authority on 3 February, 2013. The complaint was being forwarded to Commissiunes for Person with Disabilities from the Court of Chief Commission for the person with disabilities on 2294 August, 2013, but after that the petitioner did not pay any relief neither get any suggestion or help from the Commissioner of Person with Disabilities. Photocopy of the complaint dated 22" August, 2013 is annexed herewith and marked as Annexure-P/5. 11. Your petitioner states that without getting any fruitful resuilt. the petitioner posted his grievances in a social network and one Mr Ayan Banerjec, Advocate contacted with the petitioner and suggestedhim to file a FIR before the Egra Police Station, Purba Medinipur per the suggestion of Mr. Banerjee, Advocate your petitioner lodged a complaint on 8 May 2023 before the Egra Police Station through registered post with A/D. 12. Your petitioner states that your petitioner has informed the entire fact of such illegalities happened with the petitioner bv the Council to the High Court authority by a written letter 13. The petitioner states that the issue which was actually the basis of the instant writ application is to get relief from illegalities which has done by the respondent commission by not disclosing the actual fact of the appointment of the petitioner in the post of primary teacher rather providing a fake statement of “typographical mistake”. The etitioner has ever right to know the entire marks of the appointed candidates as the petitioner neard that some of the candidates «nu got lower marks in Madhyamik Examination, but got chance in the primary teacher selection process 2009. 14. Your petitioner states that rather getting help being a physical disable person he has a way only moving the writ petition before this Hon'ble Court where the petitioner can his agitation and a get a proper adjudication against the illegalities committed by the commissioners by not disclosing the detailed merit list in respect of marks percentage of the appointed candidates and your petitioner is in belief that he will get chance if the proper investigation conductedby the authorities, 18. Your petitioner states that your petitioner filed another RTI application under the act of 2005 on 10.04.2023 seeking information as follows: a) e) As per the Notification of primary teacher recruitment par 2009 (whose written examination was held on 17% June, 20!2 conducted by Purba Medinipur District Primary School Council} How many teachers were recruited by Purba Medinipur District Primary School Council? Mention the number of appointment of each category ---UR, SC, St, OBC PWD and others. From which month after the declaration of primary teacher recruitment panel 2009 in 2012 was the issuing of appoinunent letters started? Provide detailed information of all appointed primary teachers of physically challenged categories, who were recruited by Purba Medinipur District Primary School Council as per the recruitment panel 2009 conducted in 2012, mentioning name date of bi ‘h, enrollment number, written examination score academic score, interview mark, score of extra curricular activities, name and address of the schoo! appointed. Copy of the RTI application along with track report dated 10% April, 2023 is annexed herewith and marked as Annexure-P/6.16. Your petitioner states that your petitioner will get appoinumen if the authorities view the complaint of the petitioner and investigate the matter the petitioner will definitely get a chance tw get appointment as a primary teacher. 17. The act of the respondent council in preparing the panels bu not disclosing the detailed marks of the candidates who has heer appointed and/or non-appointed is illegal, arbitrary, mala fice, unreasonably, discriminatory and constitutes violation of guarantees enshrined in Article 14,19 (1G) and 21 of the Constitution of India. 18, Being aggrieved by and/or dissatisfied with the inaction on the part of the Respondent Authorities, your petitioner begs to move the instant writ application under Article 226 of the Constitution of India before Your Lordship on the grounds following amongst other: GROUNDS 1, FOR THAT the Respondent Authority made illegalities by not providing the information sought in the RTI application dated 10% April, 2023 to the petitioner and this is a massive illegalities done by the authorities which shows that the authorities are trying suppress the actual truth of selection process of primary teacher, 2009 to the petitioner; Ul, FOR THAT the respondent council made illegalities by not providing any opportunity to the petitioner in primary teacher,i. Nv. VI. 19. by saying a typographical mistake has happened in the preparation of list for appointment in primary teacher selection process 2009 as your petitioner came to know from the repiy 21 February, 2015 of the previous RTI application; FOR THAT the act of the respondent council is iliegal as w the respondent council provided the panel list of PC category to the petitioner in the reply of the RT application i> not disclosing the detail marks of the candidates in the merit list as your petitioner information sought in the RTI application; FOR THAT the petitioner has ever right to see and inspect his OMR sheet and the OMR sheets along with subject paper and question paper and the marks of the other appointed candidates for swiping out the illegalities and also knowing the truth as per eye of law; FOR THAT the commission cannot deny the right of the petitioner as an primary teacher by not providing a proper clarification as per the appointment proceedings by which the other appointees has been appointed in the said post. FOR THAT the petitioner has every right to know the truth per law; ‘There is no other alternative, speedy and/or efficacious remedy and the relief as sought for herein, if granted would be adequate andcomplete to your petitioner. Alternative remedy, even if any, would not be @ bar given that violation of fundamental rights are involved in the instant writ petition. 20. Unless, therefore, the orders as prayed for herein is made your petitioner would suffer irreparable loss and injury as recruitment and selection are squarely related to their livelihood 21. Your petitioner have not moved any other applications before this Hon'ble Court or before any other appropriate forum on the seif same cause of action. 22.
