Anuradha v. State of Maharashtra

Anuradha, originally from rural Punjab, married Shyam in 2010. They reside in
Mumbai with their seven-year-old daughter, Anamika. Initially, their marriage
was happy, but Shyam developed an alcohol addiction over time, leading to
frequent beatings and abuse towards Anuradha. Despite enduring the abuse,
Anuradha chose to remain in the marriage for the sake of their daughter.

One night, following an argument about dinner and her inability to financially
support him, Shyam severely abused Anuradha, resulting in significant
injuries. He took her to a hospital where doctors suspected domestic violence.
They presented a false accident story to the hospital staff, concealing the
domestic violence. Frustrated by the situation, Anuradha decided to confront
Shyam.

While cooking in the kitchen on February 10, 2020, Anuradha caught Shyam
drunkenly mishandling Anamika. When she intervened, Shyam threatened to
kill both her and their daughter if she didn't procure 20,000 rupees the next
day. After a heated exchange, Shyam retired to bed. Feeling threatened,
Anuradha grabbed a kitchen knife and stabbed Shyam in the stomach.

Initially, she claimed she was not fully conscious of her actions and didn't
know what she was doing. She also stated that she had lost her mental
stability and slipped into depression because of the emotional and physical
abuse she had endured at the hands of Shyam. However, Shyam later informed
the police, when they recorded his statement, that Anuradha's actions were
deliberate.

The trial court sentenced Anuradha to 7 years imprisonment for intentionally


causing grievous hurt.

Anuradha accepted the decision but the story caught the attention of a
women's NGO called “Naari”. The volunteers convinced Anuradha to appeal.
She and the NGO are now approaching the Honourable Sessions Court of
Greater Bombay against the sentence.
