COMMANDANT, CISF UNIT NALCO DAMANJODI FOR GRANT OF RISK & HARDSHIP ALLOWANCES Under the authority of GOI, MHA vide U.O No. {-27012/147/2019-PF-1(CF No.3477246 dated 22.11.2019 has conveyed that the proposal of CISF fo implement the judgement order dated 01.02.2019 of the Hon’ble High Court of Delhi in WP (C) No.8497/2016 filed by Shri Satyendra Kumar Jha, Dy. Comdt., CISF Unit NALCO Damanjodi for grant of Risk & Hardship Allowances to the petitioner as well as all those who are similarly placed as the petitioner has been considered in the Ministry in consultation with Integrated Finance Division (IFD/MHA) and the same is agreed to. In this regard, Ministry's U.O No.27012/40 2017-PF.1 (Part): (CF No. 3416609) dated 21.08.2019 may also be referred to (Copies enclosed for ready reference). 02. In pursuance of the above order, sanction for grant of Risk & Hardship Allowance is hereby conveyed strictly to the Units mentioned as Hard Area in CISF Circular No. 53/2011 issued under letter No.(2752) dated 20.12.2011 and Circular No.14/2015 issued under letter No,.(1022) dated 27.07.2015 and subsequent changes in above orders. 03. Grant of Risk & Hardship Allowance for the period from 01.03.2009 to 30.06.2017 is required to be taken into account in terms of MHA’s O.M. No.II-27012/56/2008/PF.| dated 16.04.2009. Increase of all applicable allowances in these areas to be increased by 25% when DA rates goes up 50%. Other terms and conditions mentioned in MHA's O.M dated 16.04.2009 will continue. 04. Further, grant of Risk & Hardship Allowance for the period from 01.07.2017 to 21.02.2019, is required to be taken into account in terms of GOIVMHA OM No.II.27012/40/CF-3396706/2017.PF-I dated 31.07.2017 and subsequently on the basis of MHA O.M No.lI-27012/ 40/2017-PF.1 (Pt.ll) (CF No.3451885) dated 22.02.2019 as and where applicable only. While sanctioning Risk & Hardship Allowance, sanctioning Authority will certify and re-check that the Unit/Location falls within the classified areas mentioned in Annexure-1 to 11 of MHA O.M dated 22.02.2019. The complete postal address of the Unit/Office including Block, Sub-Division, Tehsil and District shall be mentioned in the sanction Order. Other terms and conditions mentioned in MHA's O.M dated 31 07.2017 and O.M dated 22.02.2019 will continue. However, Ministry's U.O No.27012/40 /2017-PF.I (Part) (CF No. 3416609) dated 21.08.2019 and Ministry's U.O No.27012/30 /2017-PF.I(CF No. 3395693) dated 23.08.2019 may also be referred to (Copies enclosed for ready reference) € @ 5 Inview of the above, with regard to - a) LWE based Units rates of Cl(Ops) in Modified Field Area is required to be taken into account as per O.M dated 16.04.2009 w.e.f 01.03.2009 and Special Compensatory (Tribal) Area allowance/Tough Location Allowance or any other special compensatory allowance already drawn is required to be adjusted, b) J&K based Units Risk-Hardship allowance already drawn up to 30.04.2014 as per the location co-located with Army/CAPFs may not be claimed again and thereafter, Special Compensatory (Remote Locality) Area allowance/Tough Location Allowance or any other special compensatory allowance drawn is required to be adjusted. ©) NER based Units, Risk & Hardship Allowance already drawn by CISF Units up to 30.04.2014 as per the location co-located with Army/CAPFs may not be claimed again. Rest of the units on the basis of certificate of co-location with army/CAPFs under NER are required to take into account i.e Cl (Ops) in Field/Modified/Peace Areas or Highly Active Field Area/Field Area/Modified Field Area.
