ABOUT PGCL
SVKM’s Pravin Gandhi College of Law (PGCL) is situated in Vile Parle,
Mumbai. PGCL works under the auspices of Mumbai University
providing B.L.S LL.B Course (5 Years),L.L.M. and PG Diploma
courses. The institution recognises the fact that there
lodges within the heart of every student a spark of creativity, which is the
essence of singularity in every individual.
ABOUT CCA
The Centre for Consumer Advocacy was set up in the year 2016 in the
month of September, with an aim to research, collaborate and create
awareness about consumer rights, consumer grievances, and solutions.
In line with this, the CCA has carried out research assignments on
various consumer issues, in association with the Mumbai Grahak
Panchayat, Consumer Association of India, Consumer Guidance Society
of India, etc.
revealing that the air bags had failed to deploy correctly owing to a
manufacturing defect, and that the accident was not the result of breaking any
traffic rules or negligence by Mr. Shukla, who was driving the car, or any other
vehicle’s negligence. However, Apna Car Pvt. Ltd. refused to provide any refund
or compensation to Mr. Shukla, stating that the accident had occurred due to a
liable.

PROBLEM
Mr. Shah and Mr. Shukla are now desirous of filing a complaint before the
District Consumer Disputes Redressal Commission. They have approached you
for a legal opinion in this regard, as they are unsure of (i) whether the complaint
ought to be filed before the North Goa District Consumer Disputes Redressal
Commission or the Mumbai Suburban District Consumer Disputes Redressal
Commission, (ii) whether the complaint should be filed against Apna Car Pvt.
Ltd., or Mynah Cars Inda Ltd., or Woodpecker Cars, (iii) whether Mr. Shah, not
being a party to the contract with Apna Car Pvt. Ltd., can file a complaint, and
(iv) whether Mr. Shah and Mr. Shukla can file a joint complaint. Address all four
issues in your opinion, relying on relevant statutory provisions and case law.

TEAM COMPOSITION:
The team may comprise of a maximum number of 2 members. A
maximum of 3 entries are permitted from each institution.

The last date to register for the competition is 10th March, 2024. All

FORMAT OF THE SUBMISSION:
The language for the competition will be strictly English.
The font used must be Times New Roman, size 12, line spacing 1.5,
with one inch margin on each side.
The font of footnotes must be Times New Roman, size 10, single
line spacing.
Page numbers must be given at the bottom of the page.
The length of the opinion should not exceed 2500 words.
The cover page of the submission should include the name of the
Authors, with the Authors’ designation (i.e., year of study) and the
name of the Institution.

JUDGING CRITERIA:
Each Opinion shall be evaluated out of 100 points by an
evaluator. The criteria for evaluation are as follows:
Knowledge of Law and Facts- 25 Points
Proper and Articulate Analysis- 25 Points
Extent and Use of Research- 20 Points
Clarity and Organization- 20 Points
Grammar and Style- 10 Points
PRIZES:
The Best Team - Cash Prize of Rs. 2,000/- and a Certificate of
Merit.
The Runner Up Team - Cash Prize of Rs. 1500/- and a Certificate of
Merit.
The Second Runner Up Team - Cash Prize of Rs. 1000/- and a
Certificate of Merit.
