4. PRE-FACE : Whereas following persons engaged in a social, communion
association to achieve objectives in respect of section 20 of Society Registration
Act and the association will work following social works in respect to comply all
Central, State government rules, regulation, general resolution, order passed by
them respectively. All objective of the association shall fully engage in social work
for communities and there will no any personal or individual privileges taken
through the association; it will be fully aimed organization for social work only.

5. OBJECTIVES :
1] Educational / Social :
1. To facilitate & provide gradual, traditional, modern, technical, lingual
educational activities. In this regard, to form School, Boarding, English
Medium nursery, Anganwadi, Primary, Pre-Primary, Nursery, School, High
school, College, Convents (Ashram School), Tribal school, English "Bal-
Sanskar(child Ritual centers)" etc. And schools for other mediums/lingals,
Marathi school with allied services and co-activities thereof; D.Ed., B.Ed.,
colleges, Nursing, I.T.I, Technical, Sewing, Naturopathy, Meditation/Yoga,
Fashion Designing by establishing school, high school & college buildings
with all allied & relevant facilities. To propagate education across to deprived
from study and avail facilities thereof.
2. To award scholarships, To honour scholars, To avail opportunities to grow
their skill and health development, To provide Library facility.
3. To avail and provide Handicraft skills, hatcheries, village industry with its
training to women & young male/female for the purpose of their
employments.
4. Fashion Designing Industry, Commercial, Computer education, guidance
thereof. Study room fallibility, help and assist to rural tribes students, to
distribute books.
5. To help socially weak masses by providing charitable activities, to help them
for education.
6. To guide rural student for competitive exams & career by founding training
center along with scholarship and educational material.

2] For Women
1. To provide charity work to common women & below poverty line, Provide
them training and study classes, train their knowledge and sciences with its
importance.

2. To develop women capabilities by encouraging their self-confidence and


arrange such inspirational program, talk show, lectures and other training
& educational facilities.
3. Charitable work activities for rural women, arrange programs thereof,
workshop, lecture, talk-show, seminar, training camps etc.
4. To make women/girls competent in educational field with supportive
necessary activities.
5. To organize constructive program, experiments, workshops, lecture series
for development of women’s abilities as well as increase their self-
confidence. To facilitate education and training for women. To help, guide
and support disabled destitute women, widows, abandoned women.
6. To facilitate aadharashram, orphanage, hostel and for disabled students and
youth as well as old age home for senior citizens.

3] MEDICAL
1. Provide medical help to poor - i.e. Check-up, diagnosis, surgery camps,
arrange hospitals, ambulance, public health awareness for critical diseases,
implement preventive scheme thereof.
2. Provide medical help to poor people in society such as Mobile dispensary,
Charitable Hospital foundation, open health counseling centers.
3. Therapeutic clinical camps, Learned Doctors' concerts, medical camp, talk-
shows, research centers & free treatment for Cancer/AIDS patients, Avail
facilities of Engineering, Teacher colleges, Medical colleges, Semi-medical
technical institutes along with necessary facilities in the manner to
propagate education to all basis.
4. Public awareness to donate eyes & other body parts.

4] ART - Sports/Cultural
1. To propagate & promote folk art in the manner to enlighten people of
society, to arrange folk art festival, avail the art platform for folk artists.
2. Provide various art training activities, to arrange art-festival, gives
opportunity to artists to promote social awakening program with
arrangement of Artist camps.
3. Implement sportsmanship in society, apply government recognized sports
training and classes, guidance thereof along with other allied activities.
4. Avail playground in area with gym, provide gym training, adopt habits to
students for health consciousness with creation of service skills &
awareness.
5. Public awareness & introduction of government recognized sports, to
arrange gym facility along with provisions of necessary sports allied
instruments and arrangement thereof.
6. To honour sporty scholars with graded awards.

CODE AND PROCEDURE OF ASSOCIATION

1. DEFINITION OF REFERENCE WORDS FROM THE CONSTITUTION OF


ASSOCIATION

1.1 Association : Association means Prakriti Foundation, Nashik

2. FIELD OF ASSOCIATION: Maharashtra State

3. FINANCIAL YEAR : Financial year of the Association will 1st April


to 31st March

4. MEMBERSHIP & REGISTRATION:

Any adult who is Indian inhabitant and completed age of 18 year &
may apply in prescribed form of application to the association and he will get
sanction on sole discretion of the board of directors of the association with duly
signature of the President. No member can grievance in case of any rejection or
otherwise whatsoever thereof. The selected member has to pay prescribed
membership subscription and after sanction, he will be recorded as member in
register of the association.

5. TYPES OF MEMBERSHIP:

1) Life Member: A person who will pay Rs. 500/- (Rupees Five
hundred only) membership subscription will be a life member.

2) Ordinary Yearly Member: A person who will pay Rs. 501/-


membership subscription will be considering ordinary yearly
member.

6. CANCELLATION OF MEMBERSHIP:

If any member is working against the interest of the Association or if a


member found misbehaviors acts against the association, or resigned, died or
settled abroad; will be considered his/her membership is cancelled by major poll in
respective resolution of General meeting.

7] GENERAL BODY MEETING & ITS RIGHTS:

The Annual General Meeting will be presumed that, it will be the sovereign and last
decision given meeting, he said meeting will be assumed that, it is the supreme
and final decision Meeting. The said meeting will be called once in a year. All types
of members will be participated. In the said Meeting. The functions of the meeting
will be control over works of the association, to issue order thereof, Sanction yearly
accounts, budget, amend rules, codes & procedure as necessity, discuss prompt
issued as the case may be.

8] NOTICE & QUORUM FOR GENERAL MEETING: -

It will be essential to give Notice of General Meeting prior to 15 days before


the date, Quorum to all the Association member. In the said Notice, the date, time
and place and subject of the meeting should be mentioned in the Agenda. The
Notice will be sent to all members by taking signature on the Mail Book of the
association or by Mail. Out of total members, 2 / 3 members will be present and it
will be assumed that the Quorum of Meeting is complete. Due to lack of quorum

the meeting will be postpone, then the quorum will be no binding for the postponed
meeting, however it is necessary to have a Notice of the same.

9) Special General Meeting and its functions


Such meeting will be called as per the necessity. Right to execute all the
works of General meeting will be also lying with this Special General meeting.

10] Structure of Executive Committee of the Association


In the Executive Committee of the Association, there will be minimum 07 Office-
bearers and the structure of this office -bearers as follows. Chairman-1, General
Secretary-1, Treasurer -1, Members others.

11] Period of Executive Committee and Election method


The period of Executive Committee will be 5 years. The Election of Executive
Committee will be of open resolution ballot system by major polling in Annual
General Meeting. The President will have right to casting vote in case of tie-up.

12] Office - bearers of Executive Committee and its functions:


President - To accept as a chairman position of the meeting and to run the
proceedings and to take proper decision in the interest of the Association. To
implement the resolution, to prepare & protect documents of association. To caste
additional vote in case of tie-up of the election.

Vice-President - To help the president for work of association, to preside the chair
and take charge in absence of the President, prepare and protect documents
thereof, implement and enforce to passed resolutions in meeting.

Secretary: - To correspond for and on behalf of the association, prescribed


common rules, watch / monitor over employees of association, legal proceedings
work, write the minutes.

Treasurer: - Write down the account charges, get audit thereof, book keeping and
property registers etc. update thereof, payment transactions etc.

Member of Association: - Apply necessary help in association routine work, attain


the meeting, donate the vote.

13) Meeting of Executive Committee and Demand Meeting:


Their will be minimum 2 Meetings in every year of the Executive Committee.
If 2 /3 members of Executive Committee have submitted written application, and
after demand of Chairman, a meeting of Executive Committee will be called within
15 days This meeting have all right of Executive Committee.

14] Notice of Executive Committee Meeting and Quorum-


It is essential to give prior 7 days Notice of the Executive Committee
Meeting. Notice will be given by signing on the Mail book or by Mail. If 2/3 members
will be present of Executive Committee it will be assumed that the Quorum is
completed. No quorum will be bounded on adjourned meeting, but such caption
must be mention in Agenda / Notice.

15] Rules of the Election of Executive Committee: -


The Rules of Election of Executive Committee at decided by the General
meeting. Any member who have not paid any type of fee of the Association then
he cannot context the election and will not have right of Voting.

16] Regarding vacancy filling of Executive Committee: -


Due to any reason, if any post of Committee will be vacant, then the said post will
be filled from remaining members by majority of Executive Committee for the
remaining period. If within the period of 6 months the said post still remains vacant
then the Hon. Asst. Charity Commissioner have right to fill the said vacant post.

17] Functions and rights of the Executive Committee: -


The Executive Committee will comply the resolution passed by the general
meeting, to control all the routine work to prepared general rules for carrying out
the work as per the Notice, to make changes as per the necessity. to give
recognition to the Branch offices of the Association or to withdrawal the same. to
comply the legal thing of the Association, to control over the accounts, to take note
of the complaint, to fill the vacant post of till Executive Committee, to appoint the
Intimates or to remove them, to decide the resolution legally which is passed by
majority and to implement the same.

18] Funds, Assets and Utilization of the trust: -


The source of the income of the Association will be of Membership fee
Donation, Contribution and Subsidy-1 For the compliance of the objects of the
Association, the funds will be collected. The Utilization of the funds will be made
for the compliance of the objects of the Association.

19) Provision for expenses under the objects: -


a. The funds which will be collected for the objective, will be spend 100% for
the same objective.
b. The funds collected as cash, donation, fund property shall be utilized for
aimed purposed of the association for which it is collected.
c. All objective will be social purpose, no individual or personal beneficiary
will be in the entity and the association will never work for individual
person but for the society / communities.

20) Provision for Loan or deposit: -


If the Association requires Loan or Deposit, then the same will be accepted
from any person or bank as a Loan or Deposit and it is necessary to take prior
permission from the Hon'ble Joint Charity Commissioner, Nashik.

21) Provision for Sale -Purchase of immovable Property: -


The Association have right to purchase 1.1mmovable Property and selling
the same and for the same, the Association have to take consent from to Executive
Committee by majority. It is necessary that, before selling any Association property
then to take permission from Hon. Joint Charity Commissioner U/s 36.

22) Bank Account: -


The balance amount of the Association will be kept in any Nationalized bank
or Scheduled Bank or Credit Association in the name of Association and any two
person's signature out of Chairman, General Secretary and Treasure to handle the
account and transaction.

23) Method of maintaining List of Members: -


U/s. 15A of Association Registration Act 1860, a List will be prepared of the
members of the Association and as per Rule 4B of Index 1 & Rule 7 of Association
Registration Act Maharashtra Rules 1971.

about the terms and conditions of the employees, appointed in the Association will
be sent to the Hon. Asstt. Registrar Cooperative Association Office. every year.

24) Provision for change in the Rules and Regulation of organization: -


A. If there is a need to change the rules and regulations of the organization,
the rules and regulations will be changed by passing a resolution with the approval
of 3/5 majority of voting of the members of the organization in a special general
meeting. Agenda will be given to everyone ten days before the said meeting. After
that proceeding will be taken as per Section 12 of Societies Registration Act,1860.
B. The nature of the organization will remain irrevocable. That is, the said
organization cannot be mutually dissolved. The irrevocability of the institution shall
remain subject to Section 26 of Societies Registration Act,1860.

25) Provision for change in the name of the Association and objects: -
If any changes of the Association or it$ object or amalgamation of two
societies will be made then to complete the proceeding U/s. 12 & 12 A of Association
Registration Act 1860. The General meeting will be decided after major poll of the
members ratio 3/5 and then the resolution will be passed for amendment of the
code and procedure. The agenda of the meeting should be issued prior to 10 days
from the date.

26) Dissolution:
A] If the working of the Association will be closed, then the sanction of 3/5
members with majority will be taken in the General Meeting. All types of the
transaction of exchange of the Association will be completed.
B] Also the remaining property of the Association will be donated to other trust
as Donation. Under section 13 & 14 of Association Registration 1860, the working
of Association will be closed or Association will be dissolved.
