up and court and counsel wear robes if possible. The audience may consist nf
non-lawyers. Since the trial is unrehearsed, it requires a high standard of
forensic ability on the part of the student "counsel". The actual trial is a
valuable experience for budding advocates. The legal participants should have
attended real trials to know how the trials are conducted in court. There
should not be more than 5 or 6 witnesses. There are 3 games in mock trial
namely Alibi, False Evidence and Third Degree. For the game of Alibi, the
gathering divides into groups of four with two prosecuting counsel and two
defendants. The defendants commit a crime at a time and place and set up an
alibi. They are cross-examined by the prosecuting counsel, whose aim is to
break down the alibi by questioning and setting contradictory answers.
In False Evidence, a defendant has assumed a false name and occupation
and all defendants submit a summary of their life. The jury has to cross examine
defendants and witnesses to find out who has given false evidence and gives
the verdict.
In Third Degree, there are only two players. The defendant has to fill in
details under questioning and based on that is cross examined to bring out the
weak points in defence. In mock trials, the counsel should make themselves
acquainted with the procedure and also the rules of evidence, so as to ask

leading question.
Questions:
(a) How do mock trials differ from moots?
(b) Who should be part of trials? How should counsel equip themselves?
(c) Explain the game of Alibi.

(d) Explain False Evidence game.

(e) How is Third Degree game conducted?
