Suit for the recovery of Rs.6,75,000/-,

[Rs. 5,50,000/- as principle and Rs.

1,25,000/- as interest @ 12% PA on the

basis of pronote and receipt dt.

13.5.08.

Respective Sir,

The plaintiff submits as under: -

1. That defendant borrowed a sum of Rs.

5,50,000/- vide pronote and receipt dated 13.5.08 from

the plaintiff and the defendant promised that he will

return the amount along-with interest @1.56% PM on the

demand of plaintiff.

2. That on 13.5.08 defendant received Rs.

5,50,000/- from the plaintiff in cash and executed a

pronote and receipt in favour of the plaintiff and put

his thumb impression on the pronote and receipt at the

time of receiving the amount of Rs.5,50,000/- in the

presence of the witnesses of the receipt.

3. That the pronote and receipt dated 13.5.08

was executed at the instance of defendant. The pronote

and receipt was read over to the executant defendant

and he after admitting the same to be correct and after


receiving the amount of Rs.5,00,000/- put his thumb

impression in the presence of witnesses on the pronote

and receipt.

4. That the defendant promised that he will

return the amount on the demand by the plaintiff

alongwith interest.

5. That the plaintiff requested the defendant

to return the pronote amount to the plaintiff along-

with interest, but the defendant till today has not

make the payment of the pronote amount and interest to

the plaintiff.

6. That a week ago the plaintiff requested

the defendant to make the payment of the amount

borrowed by him vide pronote and receipt dated 13.5.08

alongwith interest, but he flatly refused to make the

payment.

7. That the defendant with the intention to

defeat the recovery of the plaintiff has started

negotiation for selling his property. An application

U/o 39 rule 1&2 CPC for restraining the defendant not

to alienate the property owned by him is also filed

with the suit.

8. That the cause of action to file the suit

arose to the plaintiff from the bundle of facts stated

above and from the non payment of the pronote amount

and interest of Rs. 1,25,000/- to the plaintiff.

9. That the money was advanced at Sangrur,

Tehsil & Distt. Sangrur and the pronote and receipt

dated 13.5.08 was also executed at Sangrur, which is


within the jurisdiction of this Hon`ble Court and hence

the court has the jurisdiction to try and decide the

suit.

10. That the value of the suit for the purpose

of court fee and jurisdiction is Rs.6,75,000/- and a

court fee of Rs.19,538/- is fixed on the plaint.

11. That no suit between the parties regarding

the same subject matter is neither pending nor has been

decided by any competent court.

12. That the original pronote and receipt,

Talwana, vakalatnama, Duplicate copy of plaint, address

sheet is attached herewith the plaint.

It is therefore, respectfully prayed that the

suit of the plaintiff for the recovery of the amount of

Rs.6,75,000/- along-with interest till the realization

of amount may kindly be decreed with costs or any other

relief to which the plaintiff is found entitled may

also be granted.
