Legal Bases
 Presidential Decree No. 705, as amended, otherwise known as the
Revised Forestry Code of the Philippines

• Section 20. License Agreement, License, Lease or Permit.


“No person may utilize, exploit or occupy, posses or conduct any
activity within any forest land (FL), unless authorized to do under a
license agreement, lease or permit.”

• Section 57. Other Special Uses of Forest Lands. “Forest lands, may be
leased for a period not exceeding twenty-five years, renewable upon the
expiration thereof for a similar period or held under permit for the
establishment of sawmills, lumber yards, timber depots or other
beneficial purposes which do not in any way impair the forest resources
therein”.

Presidential Decree No. 705, as amended, otherwise known as the
Revised Forestry Code of the Philippines

Section 78. Unlawful Occupation or Destruction of Forest Lands and


Grazing Lands

Any person who enters and occupies or possess, or makes kaingin or for his
own private use or for others, any FL or grazing land without authority
under license agreement, lease, license or permit, or in a any manner
destroys such FL or part thereof, pursuant to the provisions of Section 53
hereof shall, upon conviction, be fined, and imprisoned, and be liable to the
payment to ten (10) times the rental fees and other charges…

(CBFM)
The strategy to improve the well-being of forest-
dependent communities while ensuring sustainable
management, rehabilitation, and protection of
forestlands and the resources therein, through the
active participation of stakeholders

DAO No. 2021-02: Amending Certain Provisions of DAO No.
2004-28 and DAO No. 2004-59

The government share or user’s fee for SLUP, FLAg, and


FLAgT shall be paid within 30 days upon issuance of
SLUP, FLAg, and FLAgT and annually thereafter on or
before March 31 of the succeeding years. Failure to
pay within the prescribed period shall be subject to 8%
surcharges monthly for late payment of 100% for one
year.
