(2) Notwithstanding anything contained in any law, contract or agreement, after the sanctioned plans, layout plans and ‘specifications and the nature of the fixtures, fittings, amenities and common areas, of the apartment, plot or building, as the case may be, as approved by the competent authority, are disclosed or furnished to the person who agree to take one or more of the said apartment, plot or building, as the case may be, the promoter shail not make— (i any additions and alterations in the sanctioned plans, layout plans and specifications and the nature of fixtures, fittings and amenities described therein in respect of the apartment, plot or building, as the case may be, which are agreed to be taken, without the previous consent of that person: Provided that the promoter may make such minor additions or alterations as may be required by the allottee, or such minor changes or alterations as may be necessary due to architectural and structural reasons duly recommended and verified by an authorised Architect or Engineer after proper declaration and intimation to the allottee. Explanation — For the purpose of this clause, "minor additions or alterations" excludes structural change including an addition to the area or change in height, or the removal of part of a building, or any change to the structure, such as the construction or removal or cutting into of any wall or a part of @ wall, partition, column, beam, joist, floor including a mezzanine floor or other support, or a change to or closing of any required ‘means of access ingress or egress or a change to the fixtures or equipment, etc. (i) any other alterations or additions in the sanctioned plans, layout plans and specifications of the buildings or the Page 6 of 16 ‘common areas within the project without the previous written consent of at least two-thirds of the allottees, other than the promoter, who have agreed to take apartments in ‘such building. Explanation — For the purpose of this clause, the allottees, imespective of the number of apartments or plots, as the case may be, booked by him or booked in the name of his family, or in the case of other persons such as companies or firms or any association of individuals, etc, by whatever name called, booked in its name or booked in the name of its associated entities or related enterprises, shall be considered as one allottee only. (6) Every allottee, who has entered into an agreement for sale to take an apartment, plot or building as the case may be, under section 13, shall be responsible to make necessary payments Page 7 of 16 in the manner and within the time as specified in the said agreement for sale and shall pay at the proper time and place, the share of the registration charges, municipal taxes, water and electricity charges, maintenance charges, ground rent, and other charges, if any. (10) Every allottee shall take physical possession of the apartment, plot or building as the case may be, within a period of two months of the occupancy certificate issued for the said apartment, plot or building, as the case may be. Provided that if the Chief Executive Officer fails to issue the ‘occupaney certificate or send any intimation showing his inability to issue such Page 8 of 16 certificate within 60 days of the date of receipt of application for occupancy certificate an intimation to this effect shall have fo be sent to the Authority by the ‘owner for occupying the building and if no communication is sont to the applicant for a further period of 30 days, the allottee may occupy the building after expiry of 30 days from the date of intimation received in the Authority. In case objections are intimated by the Chief Executive Officer or by an authorized officer showing inability to issue occupancy certificate the owner shall take necessary action {0 remove the objections. If the objections remain un-removed for a period of 6 months, the application for issue of occupancy certificate shall stand automatically rejected. Thereafter the Chief Executive Officer shall take suitable action for removal of unauthorised construction with fee. Thereafter, the applicant has to apply afresh with fee for occupancy certificate, Greater Noida Industrial Development Area Building Regulations, 1992 In exercise of the powers under Section 19 of the Uttar Pradesh Industrial Area Development Act, 1976 (U.P. Act 6 of 1976), the Greater Noida Industrial Development Authority, with the previous approval of the State Government, hereby makes the following regulations for the purpose of proper Planning and Development of the Greater NOIDA Industrial Development Area, Regulation 22: Notice of completion — Every owner shall have to submit a notice of completion of the building to the Authority regarding completion of work described in the building permit in the proforma given in Appendix 5 accompanied by three copies of the completion plan Regulation 23: occupancy certificate necessary for occupation — No building erected, re-erected or altered, shall be occupied in whole or part until the issue of occupancy certificates by the Chief Executive Officer in the form given in Appendix 6, Provided that if the Chief Executive Officer fails (0 issue the ‘occupancy certificate or send any intimation showing his inability to issue such certificate within 30 days of the date of receipt of completion certificate, the building may be occupied without waiting for such certificate. intimation to this effect shall have fo be sent to the Authority by the owner before occupying the same. The Promoter agrees and undertakes to indemnify the Allottee in case of failure of fulfilment of any of the provisions, formalities, documentation on part of the Promoter. The Allottee, after taking possession, agrees to pay the maintenance charges as determined by the Promoter/association of Allottees, as the case may be after the issuance of the completion certificate/occupancy certificate (as applicable) for the Project. The Promoter shall hand over the completion certificate/occupancy certificate (as applicable) of the apartment/plot, as the case may be, to the Allottee at the time of conveyance of the same. Failure of Allottee to take Possession of [Apartment/Plot] - Upon receiving a written intimation from the Promoter as per Para 7.2, the Allottee shall take possession of the [Apartment/Plot] from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the (Apartment/Plot] to the Allottee.
