Design Service - Architects Service Agreement
This Service Agreement is made and entered into on this June 11, 2024, by and between:
WHEREAS, the Client desires to engage the Service Provider to provide design services for a Container Van
Housing; and
WHEREAS, the Service Provider agrees to provide such services under the terms and conditions set forth in this
Agreement.
1. Project Description
2. Scope of Services
The scope of service of the architect and its professional fees covers the following:
2.1 Preliminary Concept Schematics/ Conceptual Design/ Sketches and Design Solution.

2.1.1 The ARCHITECT shall consult with the CLIENT to ascertain the requirements of the
CLIENT.
2.1.2 The ARCHITECT shall prepare schematic design studies leading to a recommended
solution together with a general description of the project for approval by the CLIENT.
2.1.3 The CLIENT must sign the schematic design before the production of the Development
and Contract Document Phase.
2.1.4 The CLIENT is given ONLY one (1) major revision (free of charge) on the schematic
design. Revisions after the schematic design phase shall be charged Php 5,000 per
revision, whether major or minor.
2.2 Design Development (Architectural layout and space planning studies in scale, including perspective
and facade appreciation and material conceptual presentations).
2.2.1 The ARCHITECT shall prepare from the approved Schematic Design Studies. The Design
Development Documents consist of plans, elevations, and other drawings, and outline
specifications to fix and illustrate the size and character of the entire Project in its
essentials as to kinds of materials, type of structure, mechanical, electrical, and sanitary
systems, and such other work as may be required.

2.2.4 Printing Cost (Site Planning and Architectural)
2.2.5 The Total cost of the Architects services based on the above-tabulated scope of services
to be rendered shall be with a sum of One hundred Twenty-six thousand Two hundred
Forty Pesos only (Php 126,240.00) plus 10% architect’s office overhead cost of Twelve
thousand Six hundred Twenty-four Pesos only (Php 12,624.00).
2.2.6 The Total sum of the Architects Professional fee as enumerated above shall be Three
hundred Forty-Eight thousand Eight hundred Sixty-Four Pesos only (Php
348,864.00).
2.2.7 The CLIENT agrees that whatever is finalized in the Design Development Phase,
shall reflect on the Contract Document Phase.

3.2 Upon signing this Architects service proposal, an amount equal to five percent (5%) of the fee as set
forth in section 2.2.6 of this service proposal.
3.3 Upon completion and approval by the CLIENT of the Preliminary Site Development plan, the
Architect may request and receive a sum which, together with previous payments, shall increase
the total amount paid to him to fifteen percent (15%) of the basic fee of the Architect in section
2.2.6 of this service proposal.
3.4 Upon advice by the CLIENT to proceed with the production of the construction drawings. The
Architect may request to receive a sum together with previous payments equivalent to twenty
percent (20%) of the fee for the production of drawings as provided under section 2.2.6
3.5 Upon completion of Contract Document Services, including the preparation of all necessary
construction documents, the CLIENT is required to make a payment of fifty percent (50%) of the
total fee under section 2.2.6 of this service proposal.
3.6 The balance of the Architect’s fee upon completion of contract documents shall be payable upon
completion of the work and delivery as provided for under the service proposal, together with
previous payments equivalent to one hundred percent (100%) of the basic fee under section 2.2.6
of this proposal.
4. Separate Contracts
4.1 The Architects fee applies to work under one general contract only, which is only intended for this
project, other projects similar in nature shall be quoted separately.
4.2 Architects' supervision, whether part-time periodic visits or full-time supervision, is not yet included
in this service proposal. Should the CLIENT desire for the Architect to render full-time supervision,
that supervision fee shall be quoted separately in another service proposal before the
commencement of the execution of the project.
5.2 Reimbursable expenses such as transportation and living expenses when travel is authorized by the
CLIENT in connection with the project, long-distance calls and telegrams, postage and handling,
and fees paid for securing approval of authorities having jurisdiction over the project shall be paid
by the CLIENT separately. The Architect shall maintain an accurate cost accounting system as to
all such additional expenses and shall make it available to the CLIENT upon request.
6.2 The CLIENT, at its expense, shall furnish all such data to the Architect or, at its option, may require
the Architect to procure such information, in which event the cost incident thereto shall either be
paid directly by the CLIENT or reimbursed to the Architect, as the Architect may request. The
CLIENT likewise shall pay for all boring or test pits and any mechanical, chemical, or other tests as

well as professional verification and inspection incident to the proper appraisal of the site for the
contemplated construction provided such boring, test pits, other test and inspections are done by
individual outside of the Architects organization.
6.3 Specialized engineering services, other than the normal services as provided in Section 2, when
specifically requested by the CLIENT, will be paid for by the CLIENT.
7.2 Upon completion of the working drawings, the Architect may then submit to the CLIENT a cost
estimate of the Bills of Quantities as the base of the construction cost for their project. On the other
hand, the CLIENT may opt to hire a separate quantity surveying firm or another architect with
expertise in quantity surveying for the proper budgeting and estimating of the scope of the works for
the project without any deduction from the architect's fee.
8.2 Republic Act 9266 Section 33 stipulates that all designs, drawings, specifications, and copies
thereof, prepared by the Architect as instruments of service, are the property and documents of the
Architect whether the work for which they are made may be executed or not, and it shall be
unlawful for any person to copy, duplicate said documents for use on other works, except by written
consent of the Architect or author of said documents and the Architect properly compensated for it.
9. Assignment of Agreement
The Architect may not assign this Agreement or any sum due to the Architect under the provisions of this
Agreement without the prior written consent of the CLIENT.
12. Amendment
No amendment of this Contract shall be effective unless made in writing and signed by all the Parties hereto.
13. Notice
Any notice, claim, correspondence, or other documents relating to this Contract shall be in writing in the
English language and shall be deemed to be duly given or made when delivered by personal delivery

with written acknowledgment or receipts or by international courier, to the Party to which it is to be given
or made at the following addresses:
14. Confidentiality
The terms and conditions of the Contract are in the interest of the Parties and should be treated with strict
confidentiality. No information in this Contract shall be disclosed to third parties other than the Parties' agents or
employees, shareholders and/or directors, and legal advisers except as required by the applicable laws.
16. Durations
16.1 Full production of drawing starts upon approval of schematic design services.
16.2 Final plans, drawings, and other rendered documents shall be submitted within thirty-five
(35) calendar days of receipt of this offer. (Excluded Saturday, Sunday, and Holiday).
17. Counterparts
17. 1 This proposal is limited only to the above-mentioned project; any other projects will be quoted
separately.
17.2 We trust that the foregoing Service Proposal shall meet your favorable consideration and kind
approval.
17.3 Should this service proposal be acceptable, you may deposit a payment of 5% of the initial
architect's fee set forth under item 2.2.6 of this service proposal to the BPI account, detailed as
follows.

18. Terms of Payment
This section details the agreed-upon payment schedule for architectural services between the CLIENT and the
ARCHITECT, as outlined under Section 6, arranged as follows:
