1.1. Background of the study

In most countries around the world, there exists an established electoral system. In Nepal, the
election system predominantly operates under a mixed-member proportional representation
framework, wherein certain representatives are chosen via a first-past-the-post system, while
others are selected through proportional representation methods. According to the Election
Commission Act of 2073, it explicitly defines "Election" as encompassing the process of
selecting the President, Vice President, Members of the Federal Parliament, Members of the
Provincial Assembly, and Members of Local Levels, in accordance with the provisions outlined
in the Constitution and Federal Laws. Furthermore, this definition extends to include the conduct
of by-elections.

In Nepal, the governance system is structured as a federal state, necessitating the division of
power into three distinct levels: local, state, and federal. Consequently, elections are conducted
twice to elect representatives for each tier of government. One election occurs at the local level,
while the other encompasses the state and federal governments. This dual election process
ensures representation and accountability across all levels of governance, fostering democratic
participation and effective administration.

1.2. Statement of problem

In Nepal, the direct election system at the local level ensures representation from various groups,
including marginalized communities. However, a significant problem arises when it comes to
higher posts such as mayor and deputy mayor in local-level elections. These positions are not
allocated or selected by marginalized groups, but rather by individuals who are affluent in
society and have provided funding to political parties. Consequently, candidacy for these higher
posts is often determined by financial influence rather than genuine representation or merit. This
situation underscores a critical problem within the local-level election process, where the ability
to provide financial support to political parties can outweigh considerations of equitable
representation and community needs.
1.3. Research Question

 What are the reasons marginalized communities are not given tickets for higher positions
in local-level bodies' elections and are not selected for roles such as mayor, deputy
mayor, or chairperson in local-level elections?
 What are the essential criteria necessary to successfully conclude a local level election?

1.4. Research Objective

 To identify and analyze the essential criteria required for the successful completion of a
local-level election.

 To investigate the factors contributing to the lack of representation of marginalized


communities in local-level elections, particularly in receiving candidacy for higher
positions such as mayor, deputy mayor, or chairperson, and to understand the reasons
behind their exclusion from these roles.

1.5. Literature Review

 The article or journal by Joan Wintr, Marekantos, and Jan Kysela discusses the direction
of the president and its constitutional and political consequences. The objective of this
article is to introduce direct presidential elections in the Czech Republic and respond to
the long-standing public demand for popular vote elections. In my research paper, it fills
the gap between the direct election systems of Nepal in local-level bodies. In my study, I
discuss the election system criteria of local bodies.

 The article or journal by Prem Darshan Sapkota and Srishi Adhikari discusses elections
and democracy in Nepal. The study delves into the historical election system of Nepal,
the introduction of democracy in the country, the granting of voting rights to the Nepalese
people, and the political history of Nepal. In my research, I aim to bridge the gap in the
study of local-level bodies by investigating why marginalized communities are not
provided with tickets in local-level elections.

1.6. Methodology

While preparing ths paper, I have done as the primary, secondary source and employs mixed
methods to obtain valid useful data.

1.7. Limitation

This research paper examines only the direct election system in local-level bodies in Nepal. It
does not address other election systems in Nepal. The paper focuses solely on the local-level
election laws of Nepal and does not include international laws.
