The definitions below are pertaining to EO and EEO and are taken from the Department of
Defense and Federal policies as indicated in the column to the left of the definition.
DEFINITIONS.
Terms Definition
Abuse of authority An arbitrary or capricious exercise of power by a military member or a
federal official or employee that adversely affects the rights of any
person or results in personal gain or advantage to himself or herself or to
preferred other persons.

Accessibility Encompasses the design, construction, development, and maintenance
of facilities, information and communication technology, programs, and
services to enable all people, including those with disabilities, to fully
and independently use them. This includes providing accommodations,
reducing physical and attitudinal barriers, and adhering to best practices
like universal design.

Action plan A document describing actions, timelines, and responsibilities for
responding to the results of the DEOCS, DOCP and additional data
sources.

Americans with An individual with a disability is defined by the ADA as a person who

Advocacy services Services offered to domestic abuse victims and non-abusing parents

Responding to victims’ emergency and ongoing safety concerns and
needs. Providing information about programs and services available to
victims and their children in both the civilian and military communities.

Affinity groups A group of people who share interests, issues, and a common bond or
background, and offer support to each other. These groups can be
formed between friends, or people from the same community,
workplace, or organization. Affinity groups can represent a narrow or
broad dimension of diversity and are most commonly associated with
race, ethnicity, age, religion, gender, disability, sexual orientation,
gender identity, and family or veteran status. DoD-recognized affinity

groups for civilian employees are known as employee resource groups.


External affinity groups are non-federal entities.

Affirmative action A tool to achieve equal employment opportunity. A program of self-
analysis, problem identification, data collection, policy statements,
reporting systems, and elimination of discriminatory policies and
practices, past and present.

Age A prohibited basis for discrimination. For purposes of this Directive,
persons protected under age discrimination provisions are those 40 years
of age or older, except when a maximum age requirement has been
established by statute or the OPM. Aliens employed outside the limits
of the United States are not covered by this definition.

Age Forbids discrimination based on age against people who are 40 or older.

Alternative Any procedure that is used as an alternative to litigation or formal
dispute resolution administrative adjudicatory proceedings to resolve issues in controversy,
including, but not limited to, facilitation, conciliation, partnering,
mediation, fact finding, early neutral evaluation, mini-trials, arbitration,
and the use of ombuds or any combination thereof. The term does not
include unassisted negotiations.

Anonymous Information received by the commander, or other person, regardless of
complaint (MEO) means of transmission, from an unknown or unidentified source, that
includes allegations of prohibited discrimination. The individual is not
required to divulge any personally identifiable information.

Anonymous Complaint received by a commanding officer or supervisor, regardless
complaint (HP) of the means of transmission, from an unknown or unidentified source,
alleging harassment. The individual is not required to divulge any
personally identifiable information.

Armed Forces Defines the term “armed forces” to include the Army, Navy, Air Force,
Marine Corps, Space Force, and Coast Guard.

Awareness and Efforts which involve contact with leadership, Service members,
outreach families, civilians to provide them with information, awareness of
programs and services, encourage use of services, and connect them to
resources. Efforts may take place within or outside the MFR access
points and may be a part of the larger MFRS efforts.

Barrier analysis An examination of policies, procedures, practices, or conditions that
limit or tend to limit opportunities for members of certain groups.

Bullying A form of harassment that includes acts of aggression by Service
members or DoD civilian employees, with a nexus to military service,
with the intent of harming a Service member either physically or
psychologically, without a proper military or other governmental
purpose. Bullying may involve the singling out of an individual from
his or her coworkers, or unit, for ridicule because he or she is considered
different or weak. It often involves an imbalance of power between the
aggressor and the victim. Bullying can be conducted through the use of
electronic devices or communications, and by other means including
social media, as well as in person. Bullying is evaluated by a reasonable
person standard and includes, but is not limited to, the following when
performed without a proper military or other governmental purpose:
• Physically striking another person in any manner or threatening
to do the same.
• Intimidating, teasing, or taunting another person.
• Oral or written berating of another person with the purpose of
belittling or humiliating.
• Encouraging another person to engage in illegal, harmful,
demeaning or dangerous acts.
• Playing abusive or malicious tricks.
• Branding, handcuffing, duct taping, tattooing, shaving, greasing,
or painting another person.
• Subjecting another person to excessive or abusive use of water.
Forcing another person to consume food, alcohol, drugs, or any
other substance.
• Degrading or damaging another’s property or reputation.
Soliciting, coercing, or knowingly permitting another person to
solicit or coerce acts of bullying.
Bullying does not include properly directed command or organizational
activities that serve a proper military or other governmental purpose, or
the requisite training activities required to prepare for such activities
(e.g., command-authorized physical training). Service members may be
responsible for an act of bullying even if there was actual or implied
consent from the victim, and regardless of the grade or rank, status, or
Service of the victim. Bullying is prohibited in all circumstances and

environments, including off-duty or “unofficial” unit functions and


settings.

Command A systematic procedure used to gather information on an organization’s

For members of the National Guard this also includes the Adjutant
General and the Governor of the State.

Civilian EEO The right of all DoD employees to apply, work, and advance on the
Program basis of merit, ability and potential, free from unlawful discrimination
based on race, color, national origin, religion, sex (including pregnancy,

disability, age, genetic information, reprisal, or other unlawful factors.

Climate The collection of shared attitudes and perceptions of people within an
organization or unit. In the military context, it often reflects the efforts
of leaders to build cohesion or trust among their personnel.

Common military Non-occupational training that is mandated for all Service members to
training (CMT) sustain readiness, provide common knowledge, enhance awareness,
reinforce expected behavioral standards, or establish a functional
baseline that improves the effectiveness of DoD and its constituent
organizations. CMT may include initial, periodic, awareness, or
refresher training.

CMT lead The OSD or DoD Component responsible for the oversight,
proponent management, administration, and implementation of a specific CMT
core curriculum.

CMT Non-occupational directed training that sustains readiness, provides


requirements common knowledge, enhances awareness, reinforces expected
behavioral standards or obligations, and establishes a functional baseline
required for all Service members to perform military duties or activities
in accordance with DoDD 1322.18.

Cognitive A broad range of conditions that affect the functioning of memory,
impairment learning, and understanding and include such intellectual disabilities as,
autism spectrum disorders (ASD), severe, persistent mental illness, brain
injury, stroke, and Alzheimer’s disease, and other dementias.

Collaboration Working together towards a common goal or purpose. Can refer to a
wide range of practices and activities, including networking (i.e.,
exchanging information for mutual benefit), coordinating (i.e., altering
activities to achieve a common purpose), cooperation (i.e., sharing
responsibilities, resources, or expertise), and integrating activities over
time (i.e., merging prevention operations, administrative structures, and
budgets).

Color Skin tone or complexion. Even though race and color clearly overlap,
they are not synonymous. Thus, color discrimination can occur between
persons of different races or ethnicities, or between persons of the same
race or ethnicity.

Continuum of Range of inappropriate actions e.g., jokes, hazing, and cyberbullying


harm that are used before or after the sexual assault and supports an
environment which tolerates these actions.

Culture of A culture characterized by: (1) Fostering a community of practice that
prevention encourages healthy habits, empathy, communication, and help-seeking;
and cultivating the values of inclusivity, connectedness, dignity, and
respect while enhancing access, equity, rights, and engagement. (2)
Identifying populations disproportionately impacted by harmful acts and
climate issues that contribute to the problem. (3) Adapting prevention
plans, processes, and trainings as necessary to reduce or eliminate
disparities.

Ethical decision Defined as the process by which people evaluate or define whether a

Ethics Ethics refers to well-founded standards of right and wrong that prescribe
what humans ought to do, usually in terms of rights, obligations,
benefits to society, fairness, or specific virtues (Markkula Center for
Applied Ethics, 2021). Ethics involve moral principles, standards, and
judgment (Hoover & Pepper, 2014; Javalgi & Russell, 2015). Ethical
behavior is behavior that is morally acceptable to the community in
which it occurs (Jones, 1991).
Ethnicity Classifications of ethnicity include: Hispanic or Latino, defined as an
individual of Cuban, Mexican, Puerto Rican, South or Central
American, or other Spanish culture or origin, regardless of race; and not
Hispanic or Latino.

Evaluation The systematic collection and analysis of information and data
(quantitative and qualitative) to assess outcomes and impact of
prevention activities for continuous quality improvement.

Formal complaint An allegation submitted in writing to the staff designated to receive such
complaints in Military Department operating instructions and
regulations; or an informal complaint, which the commander or other
person in charge of the organization, determines warrants an
investigation.

Gender identity The individual’s internal sense of being male or female. The way an
individual expresses their gender identity is frequently called “gender
expression,” and may or may not conform to social stereotypes
associated with a particular gender.

Handicapped Any person who has a physical or mental impairment that substantially

of this Directive as it relates to employment programs of recipients, such
term does not include any individual who is an alcoholic or drug abuser
and whose current use of alcohol or drugs prevents such individual from

reason of such current alcohol or drug abuse, would constitute a direct
threat to property or to the safety of others. As used in this paragraph:
• Physical or Mental Impairment. Any physiological disorder or
condition, cosmetic disfigurement, or anatomical loss affecting
one or more of the following body systems: neurological;
musculoskeletal and special sense organs; respiratory, including
speech organs; cardiovascular; reproductive; digestive;
genitourinary; hemic and lymphatic; skin; and endocrine; or any
mental or psychological disorder, such as mental retardation,
organic brain syndrome, emotional or mental illness, and
specific learning disabilities. The term includes such diseases
and conditions as orthopedic, visual, speech, and hearing
impairments; cerebral palsy, epilepsy, and muscular dystrophy;

Sexual Unlawful discriminatory harassment that is based on conduct of a sexual

pay, or career. For example:
• Submission to or rejection of such conduct by a person is used as

Sexual Conduct that:
harassment • Involves unwelcome sexual advances, requests for sexual favors,
and deliberate or repeated offensive comments or gestures of a
sexual nature when:
• Submission to such conduct is, either explicitly or implicitly,
made a term or condition of a person’s job, pay, or career;
• Submission to or rejection of such conduct by a person is used as
a basis for career or employment decisions affecting that person;
or
• Such conduct has the purpose or effect of unreasonably
interfering with an individual’s work performance or creates an
intimidating, hostile, or offensive working environment.
• Is so severe or pervasive that a reasonable person would
perceive, and the victim does perceive, the environment as
hostile or offensive.
• Any use or condonation, by any person in a supervisory or
command position, of any form of sexual behavior to control,
influence, or affect the career, pay, or job of a member of the
Armed Forces or a civilian employee of the Department of
Defense.
• Any deliberate or repeated unwelcome verbal comments or
gesture of a sexual nature by any member of the Armed Forces
or a civilian employee of the Department of Defense.

There is no requirement for concrete psychological harm to the


complainant for behavior to constitute sexual harassment. Behavior is
sufficient to constitute sexual harassment if it is so severe or pervasive

that a reasonable person would perceive, and the complainant does


perceive, the environment as hostile or offensive.
• Sexual harassment can occur through electronic
communications, including social media, other forms of
communication, and in person.

Social media Web-based tools, websites, applications, and media that connect users
(MEO) and allows them to engage in dialogue, share information, collaborate,
and interact. This includes using social media on-duty and off-duty

Stalking (CIV) A form of harassment that includes repeated harassing, unwanted, or
threatening conduct that would cause a reasonable person to fear for his
or her safety or the safety of others. Stalking may occur through use of
technology including, but not limited to, email, telephone, voicemail,
text messaging, drones, cameras, microphones, and use of electronic
tracking and monitoring and social networking sites. Stalking conduct
may include, but it is not limited to: Following, spying on, or waiting for
an individual in places such as home, school, work, or recreational
places. Leaving unwanted items. Making direct or indirect threats to
harm an individual, an individual’s children, relatives, friends, pets, or
property. Posting information or spreading rumors about an individual

on the internet, in a public place, or by word of mouth. Obtaining or


using personal information about an individual accessed through public
records, using internet search services, hiring private investigators,
going through an individual’s garbage, following an individual, or
contacting an individual’s friends, family, work, or neighbors. In most
state and federal jurisdictions, to include that of the Military
Departments under the Uniform Code of Military Justice, stalking is a
crime.

Stalking Includes, but it is not limited to, a person: Who wrongfully engages in a
course of conduct directed at a specific person that would cause a
reasonable person to fear death or bodily harm, including sexual assault,
to himself or herself, to a member of his or her immediate family, or to
his or her intimate partner. Who has knowledge, or should have
knowledge, that the specific person will be placed in reasonable fear of
death or bodily harm, including sexual assault, to himself or herself, to a
member of his or her immediate family, or to his or her intimate partner.
When the conduct induces reasonable fear of death or bodily harm in the
specific person, including sexual assault, to himself or herself, to a
member of his or her immediate family, or to his or her intimate partner.

Unconscious bias Unconscious biases are beliefs, attitudes, and assumptions about people
and groups that individuals develop automatically based on
interpretation of cues (perceived social norms) and past individual
experiences (Fazio et al., 1986; Fazio, 2001; Marsh, 2009); these can be
inaccurate or incomplete, which can lead to a pattern of unintended
marginalization of people from certain groups.
Underrepresented A situation in which the number of women or members of a minority
group employed by a DoD Component constitutes a lower percentage of
the total number of eligible employees within the employment category
than the percentage women or the minority constitutes within the
civilian labor force of the United States.

Values Values are a person’s beliefs about what is important or desirable in life.
Values can be shaped over time by a variety of factors, including
personal experiences, one’s culture, and societal norms. Although
personal values differ from one individual to the next, shared
experiences and a shared military culture can lead to some common
values for many military personnel. In addition, to individual values,
the DoD and each of the Services publish a set of core values they want
personnel to adopt.
Warm handoff A transfer of care between two helping agencies, or a referral from one
helping agency to another, where a provider or representative from the
referral source directly introduces the patient or client to a provider or
representative at the receiving agency.
