constitution of India at the time of its commencement in 1950.

Fundamental duties

➢ Originally, Constitution incorporated the duties of the


State (DPSPs) only and not for citizens

➢ first time, need and necessity of duties was felt during the internal
emergency (1975–1977).
SWARAN SINGH COMMITTEE RECOMMENDATIONS (1976)

➢ The idea of Fundamental Duties is inspired from


USSR.

➢ Suggested the incorporation of eight Fundamental


Duties in the Constitution

➢ Parliament may provide legislation for the imposition of


penalty or punishment for non-observance or
infringement of duties

➢ Paying taxes and voting in elections


SWARAN SINGH COMMITTEE RECOMMENDATIONS (1976)

➢Fundamental Duties were added in Part IV-A of


the Constitution by the 42nd Constitutional
Amendment Act, 1976 on the recommendations of
Swaran Singh Committee.

➢A new Article 51 (a) was incorporated .

• To abide By the Constitution and respect its ideals


and institutions, the National Flag and the National
Anthem.
2st duty

Art. 51 A – b

• To cherish and follow the noble ideals which inspired our


national struggle for freedom.
3rd duty

Art. 51 A – c

• To uphold and protect the sovereignty, unity and


integrity of India.
4th duty

Art. 51 A – d

• To defend the country and render national services when called


upon to do so.
5th duty

Art. 51 A – e

• To promote harmony and the spirit of common


brotherhood amongst all the people of India
transcending religious, linguistic and regional or
sectional diversities; to renounce practices
derogatory to the dignity of women.
6th duty

Art. 51 A – f

• To value and preserve the rich heritage of our composite culture


7th duty

• To value protect and improve the natural environment including


forests, lakes, rivers and wild life, and to have compassion for
living creatures .
