CONSTITUTION OF INDIA [UNACADEMY NOTES][INTRO :- LECTURE 1)]

 29th November, 1949 – constitution of India was adopted.


 15 articles mentioned in Article 349 came into force on this day 29th November, 1949.
 26th January, 1950 – Constitution came into force.
 Rest of the articles of Indian constitution came into force on this day - 26 th January, 1950.
 CONSTITUTION IS THE FUNDAMENTAL AND ORGANIC LAW OF THE NATION.
 Fundamental law – most basic law; Organic law – It has life – Amendments are possible.
 It establishes Conception (Idea of conceiving the government, establishment, development),
Character (Nature of govt., Republic) and Organization (structure, roles) of government.
 It determines the Extent of powers of government and the Manner in which these powers
are to be used by the established government.
 CONSTITUTION, CONSTITUTIONL LAW, CONSTITUTIONALISM, CONSTITUTIONL VALIDITY :-
 CONSTITUTION = Constitution describes the documented laws, rules and regulations.
 CONSTITUTIONAL LAW = It is a broader term as it comprises of the Constitution, the Statutory
Regulations and the Judicial Decisions.
CONSTITUTION OF INDIA + RELEVANT STATUTORY LAWS +
RELEVANT HIGH COURT AND SUPEREME COURT JUDGEMENTS + AMENDMENTS.
(RELEVANT STATUTORY LAWS :- ACTS OF PARLIAMENT)
 CONSTITUTIONALISM = It is the basic idea behind the constitution. It lays down the spirit of
the constitution of India. Constitutionalism is the behavior that encourages better
government and limits the overuse of powers by working for the welfare of society.
 CONSTITUTIONAL VALIDITY = The provisions of other laws must not be in contravention with
the Constitution of India. (Example: - Article 497, 377 partially, triple talaq.)
 IMPORTANT DATES AND EVENTS :-
 Year, 1934 M.N.ROY proposed the idea of CONSTITUENT ASSEMBLY.
 NOVEMBER, 1946 Constituent Assembly was constituted.
