ORDER

Petitioner/accused has moved this petition U/s.438 of

Cr.P.C. seeking anticipatory bail in Crime No.129/2019 of

Raichur Rural Police Station.

2) The brief facts as averred in the petition are that:

On 09.09.2019 PSI of Raichur Rural P.S. received credible

information of illegal selling of liquor in a public place at

Basaveshwar Colony, along Shivakumar CHS­305, Gopal CHC­

135, Raviraj CHC­320, Bhaskar CPC­590 & panchas Srinivas &

Urkundappa conducted a raid near Basaveshwar Colony open

well, in front of the house of one person was found selling liquor

to the customers, they raided, on seeing the police ran away

from the spot. From the villagers he came to know that the

person who ran away is Nagaraj S/o Suresh. He has seized the

various brands of liquor in the presence of panchas and

brought it to the Raichur Rural P.S., and registered the case at

Crime No. 129/2019 and submitted FIR to the court.

3) Petitioner is the accused in this case has contended

that he is law abiding citizen and innocent of the charges

leveled against him and he has not committed any offences

much less what is alleged in the F.I.R. He has been falsely

implicated in the case and he has no nexus to the liquor

pouches seized by the police. He is ready to offer solvent surety

for his enlargement on bail and he apprehends the harassment

in the hands of police in the event of arrest and prayed that he

be released on anticipatory bail in the ends of justice.

4) Notified the matter to Public prosecutor. Learned

Public prosecutor filed objections contending that without

taking licence from the competent authorities accused was

found selling the liquor openly in a public place. Therefore, it is

a serious offence especially public health is involved. Therefore,

if he is released on bail, he may indulge in repetition of such

crime, threaten the witnesses, likelihood of interfering in the

smooth investigation and likelihood of fleeing from justice and

sought for rejection of the same.

5) Heard the arguments.

6) Now, the points that arise for my consideration are

that:

1. Whether the Petitioner/accused has made


out sufficient grounds for his enlargement
on bail U/s.438 of Cr.P.C. as prayed?

2. What Order?

7) My answers to the above points are as follows:

Point No.1: In the “affirmative”.

Point No.2: As per final orders, for the following

REASONS
Point No.1:­

8) I have gone through the certified copy of FIR with

complaint and seizure Mahazar, it reveal that on 09.09.2019 at

8.00 p.m. on credible information of illegal selling of liquor in a

public place at Basaveshwar Colony, Yeramuras, complainant

along with staff and panchas conducted a raid and found that

accused was selling the liquor standing in front of the house, on

seeing the police abandoning contraband materials ran away

from the scene of occurrence. From one Govind, he came to

know that name of the accused is Nagaraj S/o Suresh. He has

seized various brands of liquor pouches more­fully mentioned in

the mahazar, worth Rs.11,130/­ sealed it, brought to the

Raichur Rural P.S. and registered the case. Merely because case

is registered against accused are u/s 32, 34 of K.E. Act. But

these offences are not serious offences punishable with death or

imprisonment for life, at the best we can say that it is non­

bailable offences and triable by court of Magistrate only. No

doubt, selling the liquor in a public place without having licence

is a serious offence. The defence set out by the accused is of

total denial that he has no nexus to the liquor pouches were

seized by the police. Only in cases where the accused are

brought before the court or booked with the case with an

allegation of heinous offence while granting anticipatory bail

court should be little cautious. Therefore, heavy burden is on

the prosecution to make out sufficient grounds to refuse to

grant anticipatory bail. Mere all the allegations made in the

complaint are expected to be proved by the prosecution during

the trial by producing satisfactory evidence. No doubt

investigation is in progress. Selling of liquor without obtaining

licence from the competent authorities in a public place is a

serious offence as public health especially health of youth is

involved in the case. But it does not mean that accused was

actually indulged in case, because his defence is of total denial.

He has made it clear that in the event he is released on bail he

would abide by the conditions to be imposed by the court and

assist IO in his investigation. Petitioner has contended that

police are making hectic efforts to arrest him he reasonably

apprehends harassment in the hands of police in the event of

his arrest which prompted him to make an application seeking

anticipatory bail. Therefore, under what circumstances

application is moved is also a factor need be appreciated while

granting anticipatory bail. Apart from it, accused is the

permanent resident of Yarmaras village in Raichur taluka

having residential house and properties. The apprehension of

learned PP that if the accused is released on bail there are

chances of absconding in that event it is very difficult for the

prosecution to secure his presence during the trial cannot be

appreciated at all. Suffice at this court need to consider that

whether the petitioner is entitled to get anticipatory bail or not.

Apprehension of learned P.P. that if accused is released on bail,

he may interfere in the investigation and likelihood of fleeing

from justice cannot be appreciated at all. This court is of the

view that if he is released on bail, no prejudice will be caused to

the case of prosecution. Therefore, absolutely no grounds are

made out prima facie to reject the application. Having regard to

the material allegation made in the complaint and other

allegations absolutely there are no circumstances worth to

believe that if accused is released on bail he may indulge in

such crime, interfering in the smooth investigation and

likelihood of fleeing from justice, if no such threats are there

certainly facts and circumstances do warrant exercise of

discretion in favour of the petitioner by granting anticipatory

bail as prayed for u/sec 438 of Cr.P.C. Accordingly, I answer the

point No.1 in the “affirmative”.

Point No.2:­

9) For the forgoing reasons, I proceed to pass the

following:

ORDER

Petition filed by the petitioner U/s.438 of Cr.P.C. is

hereby allowed.

Petitioner/Accused shall be enlarged on anticipatory bail

in the event of his arrest by the police in Crime No.129/2019 of

Raichur Rural police station, on his executing a Self­bond for

Rs.50,000/­ with one surety for like sum subject to following

conditions:

1) He shall not tamper the prosecution witnesses.

2) He shall assist the I.O. in his investigation.

3) He shall not threaten the prosecution witnesses


in any manner.

4) He shall mark his attendance before the S.H.O.


of Raichur Rural police station, on every
Monday and Friday between 4:00 P.M. and 6:00
P.M. for six weeks.

5) He shall not leave the district of Raichur


without prior permission of the jurisdictional
court till filing of the charge sheet.

Anticipatory bail order extended in favour of petitioner


shall be in­force till he gets regular bail from the competent
jurisdictional court.
