NORTH CAROLINA DEPARTMENT OF PUBLIC INSTRUCTION ‘wwrw dpi. ne.gow May 8, 2024 Joanna Souza, Exceptional Children Administrator New Hanover County Schools Joanna.souza@nhes.net SUBJECT: FFY 24 Significant Disproportionality Pursuant to federal regulations, each state is required to examine its data to determine if significant disproportionality based on race and ethnicity is occurring as described under §300.646(a)(1)(2)(3). The determination must be made with respect to: 1) the identification of students with disabilities, including specific disability categories. 2) the placement of students with disabilities in particular educational settings; and 3) the incidence, duration, and type of disciplinary actions for students ages 3-21. New Hanover County Schools has been determined to be significantly disproportionate in the following area(s): ‘© Identification: Emotional disturbance (3-21), BLT Public School Units (PSUs) identified as having significant disproportionality in any of the three areas for three consecutive years, without reasonable progress toward reducing the rate, are required to reserve federal funds to provide Comprehensive Coordinated Early Intervening Services (CCEIS) to serve children in the identified subgroups, PSUs identified with significant disproportionality must participate in a mandatory training session regarding the requirements for CCEIS. A training session will be held on May 14, 2024, from 1:30 PM to 3:30 PM. The virtual, live training can be accessed directly by this link, No registration is required. If you cannot attend this training, please contact your assigned fiscal consultant or regional coordinator as soon as possible so that an alternate training date can be scheduled. Definition of Disproportionate Representation in Identification: 2 3.0 risk ratio or alternate risk ratio in special education and six (6) specific disability categories. Resources to assist districts in calculating disproportionality. This document is designed to organize and retain annual versions of each data tool. Data Source: Comparison group - Total enrollment by 7 racial/ethnic categories LLEAS- Table 10 - Pupils in membership by Race and Sex Charter Schools Table 37 - Membership by Race and Sex IDEA data — ECATS December 1 certified child count (ages 3-21) by 7 racial/ethnic categories specific to each of the seven (7) areas reviewed: ~ All Disabilities combined -AU -£D 1D (IDMI, IMO & 1DSE) - OHI “si -SLD Process: ‘Step 1: Determination of Cell and “N” Sizes Step 1a: Determine an LEA's cell size 2 10 for a given race/ethnicity for the LEA’s overall children with disabilities (special education) population and each of the six disability categories identified above. For an LEA with a cell size 2 10 go to step 1b. For an LEA with a cell size < 10 stop. ‘Step 1b: Determine an LEA's “N” size 2 30 for a given race/ethnicity for the overall enrollment population. For an LEA with an “N” size 2 30 go to step 2 and use the risk ratio calculation to determine if an LEA has disproportionate representation. For an LEA with an “N” size of < 30 or a cell size of < 10 in the comparison group go to step 2 and use the alternate risk ratio calculation ‘Step 2: Determination of Disproportionate Representation Determine if an LEA has disproportionate representation for the current year, using either the risk ratio calculation or alternate risk ratio calculation (see step 1b above). ‘An LEA with 2 3.0 risk ratio or alternate risk ratio has disproportionate representation for the current year. fan LEA has disproportionate representation for the current year, go to Step 3. If not, stop; an LEA does not have disproportionate representation and, thus, does not have significant disproportionality nor does it receive 2 warning. ‘Step 3: Determination of Disproportionate Representation in Consecutive Years Determine if an LEA has had disproportionate representation for three (3) consecutive years.Ian LEA has had disproportionate representation for 3 consecutive years, go to Step 4. If not, stop; an LEA receives a warning for the current year and is in danger of having significant disproportionality in future years. Step 4: Determination of Reasonable Progress Made Determine if an LEA’s current risk ratio or alternate risk ratio has decreased, remained the same or increased in each of the two prior consecutive years to determine if the LEA has made reasonable progress. Ian LEA’s current risk ratio or alternate risk ratio has decreased, remained the same or increased by a < 0.2 percentage point in each of the two prior consecutive years and the LEA now has a risk ratio or alternate risk ratio 5.0, the LEA has made reasonable progress and receives a warning for the current year and is in danger of having significant disproportionality in future years. Ian LEA's risk ratio or alternate risk ratio has increased in each of the two prior consecutive years by a> 0.2 percentage point and/or the LEA now has a risk ratio or alternate risk ratio > 5.0, the LEA is determined to have significant disproportionality for the current year.
