Developing Legal Skills through Internship

Experiences: An Inevitable Stipulation in the

Life of Every Law Student
ABSTRACT
Internship is an important aspect of legal education as it bridges the gap between theory
learnt in the class and the practical application in working within the legal field. Law students
gain practical experience in different environments, such as law firms, corporate legal teams,
NGOs, or judicial settings. When on internships, students get to master the key skills implied
in legal research, drafting of documents, interaction with clients, and acquaintance with
courtroom procedures. Internships go way beyond building technical skills; they form an
important ground for mentorship and networking possibilities, which are crucial to the long-
run prospect of a good career. However, internships aren't completely problem-free. Very
often, interns face overburdening workloads and have to deal with complex ethical issues that
cannot be easily handled in professional domains 1. It takes a survey of those dynamics to look
into how legal internships shape a law student's professional journey. 2 It also provides
recommendations about how the legal internship setup and accessibility can be improved
worldwide such that it offers meaningful, well-rounded experiences meant to really prepare
students for their respective careers.

INTRODUCTION

In the fast-changing world of law, a practical experience plays a vital role in legal education.
The academic study using the old classroom approach teaches mainly on theory and theory
cannot answer the demands faced on legal practice. A student is considered to have acquired
all the required skills only through experience. 3 Legal Internships fill the gap between study
and practice. They offer students the opportunity to apply their knowledge in actual legal

settings. Internships are a very important step in the career of a would-be lawyer. Whether
working in law firms, public institutions, corporate legal departments, or judicial clerkships,
internships have become a sine qua non step forward for aspiring lawyers. Internships afford
the opportunity to experience various facets of the law, develop important competencies, and
adjust to a changing legal landscape4. This paper addresses the integral role that internships
play in the development of future lawyers, underlining their increasing significance in
modern legal education.

This places an in-depth investigation on how internships are helpful for the development of
practical skills among law students. Through such investigation and participation in various
internship environments, the study clearly reveals how such experiences help the students
link up their theoretical knowledge with actuality. This knowledge is valuable to law students
who want to bridge the gap between academics and practice, equally valued by legal
educators and institutions in trying to enhance their curriculum and internship offerings. It
goes a long way as legal practices evolve, having best practices along with them as to what a
law student needs for the complexities he or she would experience in their profession.5

Besides, it addresses the issues of undergraduate students who undergo their practical training
under the auspices of the law school, such as ethical dilemmas and lack of equal opportunity
to quality programs.6 The study suggests an urgent need for reforms in the structures of legal
education and internship. Suggestions that can be drawn from this research might be to help
law schools and legal employers create more just and nurturing internship environments,
promote not only the development of certain skills but also professional development and
ethics awareness. The final end contribution of this research would contribute towards the
continued stream of discussion that concerns changing legal education to enable future
lawyers with the capacity to navigate the laws effectively.

STATEMENT OF PROBLEM

This is an issue that many law students continually wrestle to fill: the gap between theory-
heavy education received in law school and what they need once they graduate to succeed in
the professional legal fraternity. While law school curricula tend to focus on statutes, case
law, and academic analysis, these curricula often fail to focus sufficiently on how those

principles are applied in the practical legal situations of everyday life. The theory and the
practice are being bridged through internships, providing the students with a chance to really
put the theory into practice. On the other hand, the students while undergoing internships are
facing shortcomings in a variety of capacities: for example, access to quality internships may
not be fair for all students; mentorship may be unstructured. They do not understand where
real ethical issues are in the situations when the application of legal knowledge is specifically
needed.

Likewise, the approach to legal internships is not standardized; that is, not all schools follow,
nor are the same practices followed in different regions. This disparity means that while some
students gain valuable experience in hands-on skills, others end up doing only routine
administration tasks that will not provide them with any depth of understanding in legal
practice. The paper aims at discussing how legal internships could be used to more
appropriately address these challenges-including skill development and mentorship; access to
the opportunities is balanced. The ultimate purpose is actually training law students to
succeed in their legal profession in the future.

LITERATURE REVIEW

The current literature on the legal internship focuses on the transition that a student has as
they move from theory to practice in their law programs. Current studies demonstrate that
experience-based learning, such as internships, vastly develops the core skills for the legal
profession: research legal, client communication, and ethical decision-making (Higgins,
2018; Kauffman, 2020).7

According to O'Brien and Reddick (2019, p. 4), internships are a way of skills development
for law students by providing them with the opportunity to apply critical thinking, problem-
solving, and communication skills, all demanded strongly by employers because it shows that
the student could practically apply their academic knowledge. Internships also help students
gain direct experience of the culture of the legal profession, which fosters professional
identity and a more suitable understanding of ethics in practice (Jones, 2021).8

Law and Education, 25(1), 15-34
8
Jones, R. (2021). Building Professional Identity: The Role of Internships in Law Education. Legal Studies Forum,
45(3), 189-203
Another significant characteristic of legal internships is mentorship. According to Smith
(2017), successful mentoring during internship significantly helps out students who proceed
for law training by offering them guidance in their career, providing them with support, and
networking. According to Stewart and Stoecker (2019), positive relations in mentoring
improve students' feeling and performance during internship.9

Other important themes observed in the literature are some of the challenges encountered
during the internships. These include mostly inequality in the access to good quality
internships and ethical dilemmas. Mostly law students have noted to be deficient in preparing
for ethical issues that may arise when placed in practice, which accordingly decides the
overall experience (Carr & Bender, 2020). Access to internships can also cause unequal
professional developments since some gain substantive legal experiences while others are left
with only administrative functions (Gonzalez, 2021).10

Many studies provide recommendations for best practice in legal internship programs. Some
of the recommendations include structured mentorship, clearer guidelines about internships,
and better collaboration between law schools and legal employers (Miller & Stokes, 2022).
Such changes would make law graduates better prepared to face the professional expectations
waiting for them.11

IMPORTANCE OF PRACTICAL TRAINING IN LEGAL EDUCATION

Practical training is one of the essential aspects of effective learning and is always considered
to bridge the gap between theory and practice. It is when a student is supplied with important
legal principles that it presents the real challenges of legal practice-highly situational skills
requiring hands-on training. While practical training, often in the form of an internship or
clinical program, may enable a student to do a lawyer's work directly-to draft a document, to
research a matter, and to advise a client. This hands-on learning helps solidify their
understanding of concepts and hone their analytical thinking, enabling them to find better
solutions for complex problems.

Journal of Legal Education, 72(1), 115-134.
Practical training also exposes students to different legal environments, which helps them
discover their professional interests. This goes a long way when it becomes time to make the
appropriate decisions in respect of their career, as they get to research fields of law that
interest them or in which they are keen. Working with others in legal professions could also
prove to be a source of enlightening insight into the everyday realities of practice, including
its challenges and ethical considerations. Such training would develop comprehensive student
understanding of the workings of the legal system for better resolution of complexities.12

Practical training is not only skill building but also networking opportunities. Internships and
clinical programs also afford students the opportunity to begin building relationships with
mentors, peers, and potential employers within the legal field. These interactions will
continue to be beneficial and offer a golden opportunity to recommend future job openings or
recommendations and career advancement. Employers typically tend to favor such candidates
who have practical experience-based preferences as they picture flexibility and preparedness
for the legal profession. Hence, practice experience becomes of utmost importance not just in
the process of skill learning but also in terms of employability and preparation of a law
student for his career.13

Internships: The Core of Legal Education

Internships are the very heart of legal education because they enable students to apply
whatever they have learned in class to real-world situations. While law school can give a
student a very solid foundation in the theory of law, the complexities of real-life legal
practice require skills that cannot be taught inside the four walls of a classroom. These
undergraduates learn by experience and develop hands-on application in the practice of law,
where they draft legal documents, conduct legal research, and sit through court proceedings.
This, in turn, helps them to develop their ability to think critically while ensuring that they
have a good and sound understanding of legal principles and theories, thereby making them
competent and self-assured lawyers.

Internships help to enhance students' personal and professional growth. They can assist
students in finding all the areas of law, thereby giving them a more focused sense of direction
about what really interests them and how they could move toward their career. Moreover,
internships help build such important skills as communication, negotiation, and responsible
ethical decision-making-all very important factors for success in the legal field. This also
provides opportunities to network, enabling students to connect with mentors and hence
increase their employability. Internships and candidates with internship experience are
always among the favorites of employers because experience demonstrates readiness for the
real world. However, internships are not part of academic requirements, although most
important for preparing law students to deal with reality in legal practice.

Types of Legal Internships: Roles, Responsibilities, and Benefits

Legal internships form a vital part of the professional development of law students, offering
them direct experience with different aspects of legal practice. These types of internships
vary in the roles, responsibilities, and benefits associated with them. The following sections
mainly focus on the basic types of legal internships and why they are an integral part of the
careers of aspiring legal professionals.14

- Law Firm Internships

The most common internship for law students is in a law firm. Interns in a law firm usually
work in environments where they are placed under attorneys involved in active practices.
Such interns help in activities that will eventually form litigation processes. 15 Some of the
activities such interns undertake include carrying out legal research, drafting legal memos
and briefs, and assisting to prepare cases for trial. Interns also accompany lawyers to
meetings with clients and can even be present in the courts at the time of court hearings to
experience firsthand legal procedures.
Benefits of internship in law firms:
• Getting first-hand knowledge of what is involved at a firm on a day-to-day basis.
• Developing legal writing and research.

• Building professional networks through attending and taking the opportunity to meet with
attorneys and other lawyers.

- Non-governmental organization

Public interest internships have students work with non-profit organizations, legal aid
societies, or other government agencies whose mission centers on social justice. In those
roles, interns will engage in case management and client outreach and will do legal research
on social justice issues and provide draft court documents.16 They can also provide education
to communities and advocate for legal rights among the underserved.
Benefits of NGO social org. include the following:
• They make a difference in social justice cases.
• Gaining experience that relates to other types of communities.
• Developing lobbying and interacting with community skills.

- Judicial Clerkships

Judicial clerkships afford the student an unparalleled view of the judicial process. Interns help
the judges conduct research into the law, draft bench memos, and write opinions. They also
get to observe cases being presented in the court and assist in case management apart from
offering some administrative support in the chambers. This affords students an in-depth
insight into legal decision-making.17
Advantages of judicial clerkship include:
•Significant experience and knowledge of the judicial system.
• Developing an analytical and writing ability through the practical exercise of legal analysis.
• Professional networking: The students make contact with judges and court staff.

- Corporate Internships

This placement will send the students to the legal department of a company where they are
assisting in corporate law, compliance, and contracts. The internship will include drafting and
reviewing contracts, regulatory research, and supporting negotiations of the legal team.

Interns may be expected to assist in compliance training and policy development for the
organization.
Corporate Internships
Corporate internships allow students to gain knowledge in the following areas:
Business acumen: relating the law and business.
Practical experience in the area of corporate governance and compliance.
Networking: establishing relationships in the realm of corporate law.

- Government Internships

For law students, focusing on public policy and regulation, government internships are good
sources to tap from. Interns can work on legal research, help draft briefs, assist in the analysis
of policies, or help with enforcement actions. They may also be exposed to administrative
hearings and public sector legal issues.
Advantages of government internships:
This way, interns are well-equipped with knowledge regarding legal frameworks concerning
public policy.
• Working on fundamental legal issues that have wide socio-economic implications.
• Establishing connections with the lawyers in the government and policymakers.

Skills Gained in Legal Internships

Legal internships offer students in law school the essential opportunity to acquire a vast array
of skills that will always be relevant in their future work. Some of the general skills interns
achieve include:

 Legal Research: The internal intern learns how to carry out an in-depth legal search
through various databases and resources to ensure that case law, relevant statutes, and
legal precedents are known.18
 Legal Writing: Memos, briefs, contracts, and other legal documents are drafted so as
to communicate complex concepts clearly and effectively.

internship experiences to develop critical legal skills.
 Contact with Clients. Interns generally observe meetings and consultations with
clients, through which they gain first-hand experience in communications with clients,
relationship building, and probing into the needs of the clients.
 Analytical Expertise: During internships, students are generally able to analyze
complex legal issues, assess the strengths and weaknesses of cases, and work out
strategic recommendations. This maintains the critical thinking and problem-solving
abilities.19
 Negotiation Skills: Many internships include exposure to negotiation processes
whether in settlement talks or contract agreement and help interns to learn how to
stand in for a client as well as voice oneself.
 Soft skill development – Legal internships enhance critical soft skills such as effective
communication, attention to detail, and problem-solving. Working in real-world legal
settings sharpens adaptability and teamwork under pressure. These skills are
invaluable in navigating complex cases and collaborating with diverse teams.
 Familiarity with Legal Processes: Practical knowledge of court procedures,
administrative processes, as well as the inner workings of the legal system—
something especially vital to moving forward in a legal career.
 Professional Ethics: The internship opportunities are very good for the knowledge
regarding the ethics and the duty that every lawyer should follow, that importance of
integrity in professionalism must be followed by lawyers.
 Time Management: Maintaining several assignments along with deadlines in a fast-
moving work environment, the professional develops solid organizational and time
management skills that facilitate a wide variety of careers in the legal profession.

The Role and Importance of Mentorship in Legal Internships.

Mentorship becomes an important constituent during legal internships because it conditions

the students' experiences and development. The mentors will guide the interns in their
capacity and capabilities as they navigate through the complexity of legal work, espousing

the nuances of legal work. The mentors may guide on specific legal issues or the broader
career paths including the manifold decisions that the interns are to take about their future. 20

The mentors provide constructive feedback on the work that interns complete and hone
research, writing, and client communication skills; give individualized attention to help an
intern develop skills while building his self-confidence in his abilities and professional
identity. By being role models, mentors demonstrate that ethical standards and
professionalism the interns can attain in their careers.21

Furthermore, the mentorship program offers access to networking. The mentor gives a chance
to the intern to connect and interact with other professionals in the field. This way, the interns
build connections that can be converted into job offers or even career advancement. Besides
the introductions, mentors share personal experience and insights regarding their career,
providing real-world contexts and furthering the understanding of the legal profession for the
intern.

There are always more new experiences a trainee is motivated to search for in order to ensure
continuing learning: reinforcement of key aspects, such as responsibility, integrity, and
ethical practice, the mentor guides the development of firm bases for successful legal careers.
In other words, mentorship adds considerable value to the creditability of legal internships,
support guidance, and knowledge for developing the next generation of legal professionals.22

A bridge between theory and practice in legal education

One of the very big cleavages within law education is between theory and practice, and law
schools are excellent in that they teach legal principles, but real and actual legal practice is a
demand for techniques and experiences that can't be duly taught in the classroom, and closing

this gap is necessary for developing competent and well-rounded legal professionals who
could adequately deal with the multifaceted demands of actual practice. 23

Some of the best experiential learning approaches- internships, clinics, and simulations-
function to bridge that gap. These are the moments when students get to put into practice
what they've learned in terms of legal theories and concepts with real life problems and
situations. For instance, the internship at a law firm unveils the reality of legal research,
which comes with client communication and courtroom procedures. This is where students
get a firsthand feeling of how theory applies to reality. This exposure supports the education
they receive in school but also equips them with critical skills such as problem-solving,
analytical thinking, and clear expression.

Practical training also makes students better understand how the law could affect society.
When the students have to deal with real clients, advocate for social justice, or work in
community legal education programs, they clearly experience how legal principles affect
individuals and the community. This correlation of theory with practice builds in the minds of
future lawyers a sense of responsibility as well as ethical awareness, urging them to consider
more the external implications of their work.

This gap can further be bridged by law schools allowing closer interactions between legal
instructors and practitioners. Guest lectures, workshops, and mentorship programs bring
students directly in touch with practitioners, who they will eventually join as experienced
lawyers, giving them an insight into current legal trends and practices. This shall enrich the
curriculum and help keep abreast with developments within the legal space, equipping these
students with the skills and talents to adapt to a changing profession.24

Another very important tool is simulation-based learning: mock trials, negotiations, and client
interviews to prepare all stages of the legal process. This secure environment allows the
student to hone their skills with feedback forthcoming, thus building confidence and

competence in students. In such an exercise space, law schools make their graduates more
ready for the realities in legal practice.

Bridging the gap between theory and practice is therefore something that each of these parties
to the act of law teaching shares. Experiential learning, collaboration and practical training
will propel legal education as a training field that produces knowledgeable graduates in legal
theory but more importantly able to apply the skills gained to real-life situations. This holistic
approach ensures that future legal professionals are well prepared to tackle the complexities
of the legal system and make a meaningful impact on society.

Problems That Law Students Face

1. Overburden of Work:

Law school is famous as a high-strain activity. The sheer volume of texts, cases, and statutes
to read through, to analyze, and to digest is intimidating. Assignments demanding the highest
degree of thoroughness and robust critical thinking capabilities overwhelm students.
Contending time demands require excellent management abilities, and most students spend
hours studying and researching. This could be nerve-wracking and tiring at times when
attempting to keep abreast with the material in the curriculum.25

2. Pressure and Competition:

Law school can be a pressure cooker since there is very high competition among the students
who attend. Grades could be critical, as they determine opportunities for internships,
clerkships, and job opportunities in future. This competitive environment can make it even
more anxiety-inducing to be isolated. More time is spent focused on beating your classmate
rather than being able to have a real relationship with someone. Fear of failure only serves to
add more anxiety, where there is a worry that one may not be good enough, both about
academic performance and mental health.26

of Legal Education, 71(3), 455-472.
26
Internship Experiences. Journal of Legal Education, 70(4), 551-569.
3. Stress and Mental Health Issues:

The excessive workload, intensity of competition, and academic pressure cause law students
to stress that often leads to the awful mental health issues. The common problems include
anxiety, depression, and burnout.27 Trapped in the pursuit of perfection and fear of failure,
many students continue with the cycle that impacts their studies and personal lives, as well.
The increasing awareness of these issues among law schools is yet to translate to meaningful
assistance in coping with some of these challenges for many students.

4. Limited Practical Experience:

Though they do a great job of preparing students in theory, most law graduates feel prepared
neither for the practicalities of law practice nor for being a practicing lawyer. Without direct
and practical experience, either through internship or clinics, a student is at risk of applying
little in practice what he has learned in class, shaking his confidence when entering the
workforce. Therefore, it becomes important to make the practice of law more practical so that
they feel ready to practice.28

5. Financial Burden: (only if its unpaid)

Very often a law degree costs very much; graduating students leave college or university
laden with thousands of debt dollars. This financial pressure can become a source of stress to
lead a student not to pursue a career that they would probably be interested in within the legal
sector, such as public interest law, or lower paying positions that might be more rewarding.
Again, making money to pay debts is a reason discouraging students from accommodating
the unpaid internship programs, which one must undertake to gain experience.

6. Effect of Networking Challenges (only amongst peers)

Building a professional network will always be the base of career success for lawyers, yet
most students do not know how to associate with experienced legal professionals. This
presents a challenge, especially for those who do not have the advantage of mentorship or
networking resources. In many cases, absent the connections, achieving job placements or
securing internships can become really challenging. Therefore, developing effective
networking skills and finding the right opportunities to build relationships is crucial to career
growth and advancement.

Assessing the Impact of an Internship on Career Development

Internships represent a particularly critical experience for development in careers, especially

for interns in fields with high competition, such as the professions of law and business, as
well as science. Main advantages that the experience offers students and graduating seniors
include the practical application of theoretical classroom skills in the execution of real work,
new set of skills, and expanded professional networks. Let's examine the main aspects on
which internships impact career tracks.29

- Practical Experience and Gaining New Skills

Internships offer the workplace experience that supports theoretical understanding. In such
cases, for instance, internships under law students would entail writing lawyerly documents,
doing legal research, and sometimes attending court proceedings, features of exposures that
classroom learning can never achieve. This experience makes them better in their resume as
well as equips them with critical skills like problem-solving, teamwork, communication, and
critical thinking that prepare them to enter the job market.30

Internships give the opportunity for remarkable networking with professionals and peers in a
given industry so beneficial to further lasting impacts in one's career. Most opportunities in
jobs are realized through contacts people have rather than looking for job postings. These
contacts during internsh9ips are key to providing direction towards one's career and
unlocking related future decisions in careers.31

- Increased Number of Available Jobs Career Advancement

Many organizations today hire interns just to test future employees. Many companies hire
former interns right after their graduation for the same reason. Many interns demonstrate their
abilities and fit into the company culture, which makes them more likely to be hired after
finishing the internship. This change from school to the workplace, especially to challenging
business environments, is greatly eased because employers would desire the same individuals
who have experience firsthand.32

- Developing Self-Esteem and Professional Identity

Apart from this, internships enable students to develop a professional identity. Involvement in
real-world workplaces provides an opportunity for reflection upon one's strengths and areas
for development and career aspirations. This is important to inform future career choices as
the individual can pursue roles that reflect values and aspirations.33
The experience of this internship has made me realize that, indeed, practical experience is a
significant boon in the study of law. Here are some insights from the legal minds:

- The Benefits of Internships

Many lawyers reveal that legal practice experience is highly importance in internships.
Lawyers remember how internships shaped the understanding of the legal process,
understandings of different client interactions, and then courtroom dynamics. To students,
they give the same advice: stay open-minded and take full advantage of the opportunity to

learn and grow. The hands-on experience is invaluable in shaping a well-rounded legal
career.

- Building Professional Relationships

There always is a need for networking during the time of interning. Many lawyers, who are
successful today, state most of their career advancement benefits emanate from the
connections they made during internships. Professional legal persons give recommendations
to the students and advise them to network seriously, find mentors and connect with their
colleagues at the work place. Even one single mentor or connection can lead to big career
opportunities. Thus, networking becomes the key to professional development.34

- Understanding of Professional Ethics

The themes placed much emphasis on ethical behavior; many of the legal practitioners
learned professional ethics through their internships, which are real-life ethereal dilemmas.
Therefore, they advise that students handle such situations with care as being ethical
standards build for success in the legal profession.35

- Continuous learning and adaptability

The law profession is dynamic, and the practitioners stress that a one can only survive when
training by continuous learning. They would also want interns to cultivate a growth mindset
and readily acquire new skills in changing the law and society. Flexibility and adaptation are
long-term measures of success in law.36

 Set clear objectives: Internship should have obvious aims and expectations and should
offer regular feedback in order to be able to evaluate the student's track of progress
and where improvement is needed.
 Match intern with mentor: A mentorship program connecting the intern to
experienced legal professionals would be able to guide and support the student more
effectively.
 Variation in the type of assignments: This way, interns are exposed to various areas of
law, increasing their competence.
 Provide Networking Events: Hosting events where the interns may engage with
lawyers and other individuals will enable them to enhance their network.
 Support Work-Life Balance: Realistic expectations about the level of expected work
hours and workload levels will ensure that there is an opportunity for balancing
professional life with personal wellbeing.

Conclusion

Legal internships have long been recognized as a part of education for law students. They
bridge the gap between theoretical knowledge and practical experience. This firsthand
exposure to legal processes, acquisition of essential skills, and development of a professional
identity help law students make advancement in their careers. Properly designed programs
that focus on mentorship, provision of diverse tasks, and continuous feedback will help
interns enhance their career prospects significantly.

The reflections from the practicing lawyers point out the internship's long-lasting effects on
professional and personal development, especially in ethics, adaptability, and networking.
Meaningful and supportive internships would indeed be helpful to the interns, but even more
so for the betterment of the profession. Internships stand today as a critical stepping stone for
making competent, ethical, and successful lawyers in the ever-changing legal landscape.
Limitations
 The disadvantage of this research is the small number of participants and their very
minor diversity, which would be problematic to apply for all the law students and
internship programs.
 Qualitative data obtained from interviews and a survey will be subjective because of
the response elicited from participants. It exposes more of personal views and
experiences than general trends.
 It is going to be a problem to gather ample information about internship programs due
to confidentiality agreements or institutional policies, which may limit the scope of
the analysis.
 The basis of research is self-reported experiences that may not totally uncover the real
nature of internships and what really happens in the development of legal skills.
