2.2 Description:
The rental property includes 1 studio room of 25m2. The property also includes the following appliances
and fixtures: [a refrigerator, a hob, extractor fan, a microwave a TV, a double bed, a wardrobe, a desk
and a chair]. The bathroom has a shower, toilet and wash basin.

3. Rental Duration

3.1 Start of the Lease:


The lease begins on: 1.11.2024

3.2 End of the Lease:


The lease is indefinite and will continue as long as the tenant fulfills their payment obligations and other
terms of the agreement.

4. Rent

4.1 Rent Information


Rent Type = Warm Rent (Warmmiete)
The basic monthly rent (Kaltmiete) = 650 Euros
Operating costs (Nebenkosten) = 150 Euros
Total rent = 800 Euros. (This is the total amount due monthly).

4.2 Security Deposit:


The security deposit amounts to 800 Euros. The tenant may choose one of the following payment
options:
- In Full: The entire amount is due immediately upon signing the contract.
- In Two Installments:
- First Installment: [Half of the amount] is due immediately upon signing the contract.
- Second Installment: [Half of the amount] is due no later than three months after moving in.

Conditions for Refund: The security deposit will be refunded within [three months] after the end of
the lease, minus any deductions for damages or unpaid rent, according to § 551 BGB (German Civil
Code).

5. Payment Conditions

5.1 Payment of Rent and Security Deposit:


The full rent for the first month and the security deposit (in full or part) must be paid immediately after
signing this agreement or at least two weeks before the move-in date.

5.2 Default in Payment:
If the tenant fails to make the required payments within this period (As stated in clause 5.1), the
landlord has the right to terminate the agreement and cancel the lease without further obligations.

6. Use of the Rental Property

6.1 Purpose of Use:


The property is to be used solely for residential purposes, according to § 535 BGB.
6.2 Subletting:
Subletting requires prior written consent from the landlord, as stipulated in § 540 BGB. Such consent
may not be unreasonably withheld.

6.3 Defects Report:


The tenant must promptly inform the landlord of any defects or necessary repairs, according to § 536c
BGB.

7. Tenant's Obligations

7.1 Payment of Rent:


The warm rent must be paid promptly. A late fee of [10 Euros] will be charged if payment is not made
within [Seven] days after the due date, according to § 286 BGB.

7.2 Maintenance and Care:


The tenant is responsible for general maintenance and minor repairs according to § 538 BGB. Major
issues must be reported to the landlord immediately.

7.3 House Rules:


The tenant agrees to adhere to the following house rules:
- Quiet Hours: Quiet hours are from 10:00 PM to 7:00 AM. Noise levels should be minimized during
these times to avoid disturbing neighbors, according to § 535 BGB.
- Waste Disposal: Waste must be sorted and disposed of according to local regulations. The tenant
must use the designated bins for recycling and garbage, according to § 554 BGB.
- Common Areas: Common areas must be kept clean and free of personal items. No items may be
stored in stairwells or hallways.

- Pet Policy: Pets are not allowed without prior written consent from the landlord. If permitted, the
tenant must ensure pets do not disturb neighbors or cause damage.
- Smoking Policy: Smoking is prohibited inside the rental property. Any designated smoking areas must
be respected.
- Report Damage: Damage to the property or common areas must be reported to the landlord
immediately, according to § 536c BGB.
- Renovations and Modifications: The tenant may not make any renovations or modifications to the
property without the landlord's written consent, according to § 535 BGB.

7.4 Liability for Damage:


The tenant is liable for damages to the property that exceed normal wear and tear, according to § 280
BGB.

7.5 Insurance:
The tenant is advised to obtain renter’s insurance for personal property and liability coverage. The
landlord is not responsible for the tenant’s personal belongings.

8. Landlord's Obligations

8.1 Maintenance of the Property:


The landlord is responsible for maintaining the property and carrying out repairs not caused by the
tenant’s improper use, according to § 535 BGB.

8.2 Access to the Property:


The landlord may enter the property with [24 hours] notice for inspections or necessary repairs,
according to § 555a BGB.

8.3 Defect Resolution:


The landlord must promptly address defects reported by the tenant, according to § 536 BGB.

8.4 Energy Certificate:


The landlord will provide the tenant with the energy certificate for the property immediately upon
request, in accordance with § 16a of the Energieeinsparverordnung (EnEV). Additionally, a copy of the
energy certificate will be attached to this contract to comply with the legal requirements.

9. Inspection Report

9.1 Inspection Report:


A detailed inspection report will be provided to the tenant on the second day after moving in. The
report will document the condition of the property at move-in and will be signed by both parties.

10. Utilities and Services

10.1 Utilities:
The rent includes all utilities such as water, heating, and waste collection. The tenant is responsible for
any additional services such as internet or telephone.

11. Inventory List

11.1 Inventory:
An inventory list of all items provided with the rental property will be attached to this agreement. The
tenant is responsible for maintaining these items in good condition.

12. Maintenance Responsibilities

12.1 Regular Maintenance:


The tenant is responsible for routine maintenance tasks such as changing air filters and maintaining
other appliances. Any major maintenance issues must be reported to the landlord.

12.2 Cosmetic repairs, maintenance and repairs


- The tenant is obliged to treat the rented rooms and their furnishings with care and keep them free
from vermin and to ensure that the rented property is properly cleaned and that the rooms let to him
are adequately ventilated and heated.
- The lessee must ensure that cold and hot water are drawn from each fitting for at least 30 seconds at
least every third day. This is necessary to prevent a concentration of legionella. If you are absent for a
longer period of time, especially after the semester break, you must run the water for about 5 minutes.
- The tenant is obliged to carry out the cosmetic repairs professionally.
- The balconies and exterior walls may not be painted arbitrarily

13. Subletting Conditions

13.1 Subletting Details:


The tenant may sublet the property with written consent from the landlord. The tenant remains
responsible for the property and any actions of the subtenant.

14. Dispute Resolution

14.1 Resolution Process:


In case of disputes, both parties agree to attempt mediation before pursuing legal action. The mediator
will be [the roomwise GmbH designated agent responsible for the binding].

15. Data Protection

15.1 Data Privacy:


The landlord will handle the tenant's personal data in accordance with GDPR regulations. Data will be
used solely for managing the rental agreement and will be kept confidential.

16. Change of Contact Information

16.1 Update Information:


- The tenant must inform the landlord of any changes to their contact information within [five] days of
the change.

17. Additional Terms

17.1 Special Clauses:


Any special clauses or agreements not covered in this agreement will be documented in writing and
signed by both parties.

17.2 Undertaking of Repairs and Amendments (If Applicable)


In instances where the tenant has not conducted an in-person viewing of the property prior to signing
the lease agreement, an Undertaking for Repairs and Amendments shall be provided by the landlord.
This undertaking serves to ensure the tenant’s protection under the provisions of the rental agreement

and to uphold transparency regarding the condition of the property. The landlord commits to addressing
any material defects or discrepancies that may not have been observable during the virtual viewing.
This undertaking is issued in compliance with § 535 of the German Civil Code (Bürgerliches Gesetzbuch,
BGB) and is supported by relevant regulations from the local housing authority
(Wohnungsaufsichtsbehörde). It establishes the landlord's obligation to maintain the property in a
condition that is suitable for habitation and to carry out any necessary repairs without undue delay. A
comprehensive inspection of the property has been conducted by roomwise GmbH, confirming the
property's condition. In the event that discrepancies arise post-occupancy, the terms outlined in this
undertaking may be invoked to facilitate necessary repairs or amendments.

This undertaking is further insured through HUK-COBURG, with the insurance number 615/499280-A,
providing additional assurance to the tenant regarding the landlord's commitment to resolving any
issues that may arise.

This clause is incorporated to provide the tenant with additional security and to establish a transparent
protocol for addressing potential issues that may emerge due to the absence of an in-person viewing.
The undertaking is intended to align with best practices as stipulated by the local housing authority,
thereby ensuring compliance with housing regulations and safeguarding tenant rights.

18. Custody of Brought Goods


- If the tenant leaves the apartment after the end of the tenancy without agreeing on a handover date
and leaves behind things that he/she has brought in with the intention, which can be seen from the
circumstances, to finally give up possession of the room, the landlord can take the things of the tenant
into custody and rent the room to others.
- The lessee must pay the lessor the costs of storing his or her belongings, the minimum amount of
which has been agreed to be EUR 3 per day. The lessor is only liable for the loss, destruction or damage
of the items in the event of intentional or grossly negligent conduct by his vicarious agents.
- If the lessee does not collect the items nor give a valid reason for the negligence within 14 days after
moving out, this behavior is deemed to be a surrender of ownership of the items. After the 14-day
period has expired, the landlord can have the items removed at the tenant's expense.

accordance with § 555c BGB (Modifications and Addendums to the Rental Agreement) prior to the
finalization of any rental contracts.
