GENERAL DIVISIONS OF LAW

SEC. 6 - Composition of the Board


● The Commission is composed of a chairman and two members.
● To be appointed by the President of the Philippines from the three recommendees per
position again from the five nominees for each position.

SEC. 7 - Powers and Functions of the Board


● Administer/Implement the provisions of this Act
● Administer oaths
● Adopt and official seal
● Issue, suspend, or revoke COR and PIC of PECE, ECE, and ECT
● Maintain a roster of PECE, ECE, and ECT

SEC. 8 - Qualifications of the Board Members

● Good moral character and integrity
● Holder of a valid COR and PIC as PECE
● Member of good standing in APO
● Active practice of ECE profession for at least 10 years
● No pecuniary interest in any school
● Not have been convicted of an offense

SEC. 9 - Term of Office


● 3 years minimum
● Member appointed should serve the unexpired term of the former member
● Continuous tenure is until 6 years

SEC. 10 - Compensation and Allowances of the Board


● Shall receive compensation and allowances comparable to that being received by the
Chairman and members of existing regulatory boards

SEC. 11 - Removal of Board Members


● Neglect of duty
● Incompetence
● Manipulation or rigging of the licensure exam

SEC. 13 - Licensure Examination


● All applicants seeking to be registered and licensed as ECE and ECT, shall undergo the
required examinations

SEC. 14 - Qualifications for Examination


● Citizen of the Philippines of a foreign country qualified to take
● Good moral character and had not been convicted
● For ECE examination: must be a holder of a degree of BSECE
● For ECT:
○ Graduate of an Associate, Technician, Trade or Vocational course in electronics
○ Completed at least the minimum third-year equivalent of BSECE

SEC. 15 - Scope of Examination for Electronics Engineers and Electronics Technicians


● Written tests on the following subjects:
○ Mathematics
○ Applied Sciences
○ Engineering Economics
○ Laws and Ethics
○ Electronics
○ Communications
○ Computers
○ Informations and Communications Technology
● ECT exams shall consists of written and/or practical tests
● Board may re-cluster, rearrange, modify, add to or exclude any subject and prescribe the
number of final examination/s per year after approval by the Commission

SEC. 16 - Ratings
● ECT and ECE: 70% in each subject
● Removal exam: A candidate who passes most subjects but scores below 70% (but at
least 60%) in others may take one removal examination
● fail to obtain a passing rating in
● The removal examination, he/she shall be considered as having failed the entire
licensure examination

SEC. 17 - Release of the Results of Examination


● Correct and rate the licensure examination papers and shall release the examination
results within fifteen (15) days after the said examination

SEC. 18 - Qualifications and Schedule of Registration for Professional Electronics


Engineer
● Applications may be submitted anytime
● Schedule an en banc oral interview of the applicant for the purpose of verifying
● If registered and licensed as ECE under RA No. 5734 for not less than 7 years after the
effectivity of this Act shall submit their certified experience records and certifications from
3 PECE
○ Valid COR and PIC as ECE
○ Valid/Current membership ID card from APO
○ Certified experience of at least seven (7) years, at least two (2) years of which
are in responsible charge of significant engineering work
○ 3 certifications signed by 3 PECE

SEC. 19 - Issuance of the Certificate of Registration and Professional Identification Card


● COR shall be issued to examinees who passed ECE and ECT
● COR shall bear the signature of the chairperson and members of the board
● Certificate shall remain full forced and effect until withdrawn, suspended, or revoked
● PIC should be issued to registrant who has paid the fee
● ID card will serve as evidence that the holder thereof is duly registered with the
Commission
SEC. 20 - Registration without Examination for Electronics Technician
● Within 5 years after the effectivity of this act, Board shall issue COR and PIC without
examination to applicants for registration as ECT if:
○ Graduate of at least a two-year Associate, Technician, Trade or Vocational
course in Electronics
○ Rendered at least seven 7 years of active self-practice and/or employment
○ Above submittals shall be accompanied by a certification from at least 3
registered PECE

SEC. 21 - Non-issuance of a Certificate of Registration and/or Professional Identification


Card for Certain Grounds
● To any person convicted
● Any person of immoral/dishonorable conduct
● Any person of unsound mind

SEC. 22 - Professional Oath


● Successful examinees and all whose qualified to without examination shall be required
to take professional oath

SEC. 23 - Revocation and Suspension of Certificate of Registration, Professional


Identification Card and Cancellation of SPecial Permits
● For any of the causes mentioned in the preceding sections
● Unprofessional & Unethical Conduct
● Malpractice
● Incompetence
● Any violation of this Act and its implementing rules and regulations, the Code of Ethics
and the Code of Technical Standards of Practice
● Where fraud, deceit, or false statement was found to have been employed in obtaining
said COR, PIC, or Special Permit

SEC. 24 - Reinstatement, Re-issuance or Replacement of Certificate of Registration and


Professional Identification Card
● 2 years after the revocation of COR and PIC may be reinstated the validity provided that
no crime committed during revoke
● New COR or PIC to replace lost and the likes may be issued

SEC. 25 - Roster of Professional Electronics Engineer, Electronics Engineer, and


Electronics Technicians
● Prepare and maintain a roster of the names, residence and/or office address of all
registered PECE, ECE and ECT indicating the status if:
○ Valid
○ Inactive due to death or other reasons
○ Delinquent
○ Suspended or revoked
SEC. 26 - Exemptions from Examination and Registration
● No examination and registration shall be required for foreign PECE, ECE or ECT for:
○ No qualified equivalent Filipino professional is available for the specific item of
work to be rendered by APO
○ Scope and funding for the work or project are such that it stipulates the
temporary employment
○ As defined in the General Agreement on Trade in Services and various
international treaties, agreements, and covenants ratified by the Philippine
Government, including the ASEAN and APEC Engineer Registry programs:
■ Said foreign professional is legally qualified to practice his/her profession
in his/her own country
■ The foreign professional's work is limited to the specific project for which
they were contracted
■ Foreign professional shall secure a Special Permit from the Board
■ Shall not engage in private practice on his/her own account
■ Every foreign professional contracted for the work or project, at least two
(2) corresponding Filipino professionals who are registered under this Act
shall be employed as counterparts by the Philippine Government
■ Special Permit herein granted shall be valid only for a period of not more
than six (6) months and renewable every six (6) months

ARTICLE 4 - PRACTICE OF PROFESSIONAL ELECTRONICS ENGINEERING,


ELECTRONICS ENGINEERING AND ELECTRONICS TECHNICIANS

SEC. 27 - Practice of Profession


● No person shall offer himself/herself in the Philippines as, or use the title PECE, ECE or
ECT
● Or use any word, letter figure, or sign whatsoever, tending to convey the impression that
he/she is a PECE, ECE or ECT
● Or advertise that he/she is qualified to perform the work of a PECE, ECE or ECT

SEC. 28 - Prohibitions and Limitations on the Practice of Electronics Engineering and


Electronics Technician Profession
● Practice of ECE and ECT must be determined on the basis of the individual's personal
qualifications
● No firm, company, partnership, association or corporation may be registered or licensed
as such for the practice of ECE and ECT
● Registered and licensed as PECE, ECE and ECT may form a partnership or association
or corporation provided:
○ Members shall be responsible for their own respective acts

SEC. 29 - Seal of the Professional Electronics Engineers


● All licensed PECE shall obtain and use a seal of a design prescribed by the Board
bearing the Registrant's Name, Registration Number and the title
● Plans and the likes shall be stamped on every sheet/page with said seal, indicating
therein his/her current Professional Tax Receipt (PTR)

● 2 concentric circles with outer circle: 48 mm in diameter ; inner circle: 32 mm in diameter
● Atom with a nucleus and electron on the upper portion
● Horizontal space bearing the word LICENSE NO.
● Portion of the inner circle below the diametral space shall bear the name of the person

● Upper portion of the annular space bears the words PROFESSIONAL ELECTRONICS

SEC. 30 - Code of Ethics and Code of Technical Standards of Practice


● Board shall adopt a Code of Ethics and the Code of Technical Standards of Practice for
ECE and ECT

ARTICLE 5 - SUNDRY PROVISIONS

CONTENTS:

SEC. 31 - Continuing Professional Education (CPE) and/or Development Programs


● All registered PECE, ECE and ECT shall comply with pertinent rules and regulations with
respect to Continuing Professional Education

SEC. 32 - Integrated and Accredited Professional Organization


● There shall be 1 integrated and Accredited Professional Organization of PECE, ECE and
ECT in the country
● Every PECE, ECE, and ECT, upon registration with the Commission as such, shall ipso
facto become a member of this APO
● The APO shall implement the continuing professional education
● All members of good standing of this APO shall be issued an annual membership card
indicating the membership number and validity period of the membership
● Failure to maintain membership in good standing in the APO shall be a cause for listing
of the individual as delinquent in the roster of professionals

SEC. 33 - Foreign Reciprocity


● No foreigner shall be admitted for registration as PECE, ECE, and ECT with or without
examination unless:
○ The country, state or province of which he/she is a citizen admits Filipino citizens
to practice as PECE, ECE, and ECT after an examination or registration process

SEC. 34 - Positions in Government Requiring the Services of Registered and


Licensed Professional Electronics Engineers, Electronics Engineers and Electronics
Technicians
● Within three (3) years from the effectivity of this Act, services of PECE, ECE or ECT
shall accordingly be filled only by registered and licensed PECE, ECE or ECT

ARTICLE 6 - PENAL PROVISION AND ASSISTANCE OF LAW ENFORCEMENT AGENCIES

SEC. 35 - Penal Provision


● A fine of not less than P100,000.00 nor more than P1,000,000.00 or
● Imprisonment of not less than 6 months nor more than 6 years, or both will be given to:
○ Any person who shall give any false or fraudulent statement
○ Present or use as his/her own a COR, PIC, Membership ID Card in the APO
and/or seal issued to another and any person
○ Shall present or use a revoked or suspended COR as PECE, ECE or ECT
○ Assume, use, advertise, or imply that one is a registered PECE, ECE or ECT
without proper registration with the Board
○ Any PECE who stamps or seals documents after their registration, ID, or
membership has been revoked or suspended
○ A PECE may not sign or seal plans or documents prepared by another engineer
unless it clearly indicates their specific contributions
○ No person other than the PECE or ECE in charge may sign for electronics
engineering work or functions not actually performed by them
○ Any holder of a COR and PIC as a PECE, ECE, or ECT involved in illegal
wiretapping, hacking, piracy, or unauthorized electronic eavesdropping, or using
unlicensed communications systems
○ Any person who violates this Act or its rules, regulations, Code of Ethics, or
Technical Standards
SEC. 36 - Assistance of Law Enforcement and Other Government Agencies
● Law enforcement agencies must assist the Board and Commission in enforcing this Act
and its codes by prosecuting violators. Government departments and agencies, including
local governments, are also required to cooperate and coordinate with the Board and
Commission in implementing this Act and its associated measures

ARTICLE 7 - TRANSITORY PROVISIONS

SEC. 37 - Transitory Provision


● The incumbent Board of Electronics and Communications Engineering must complete all
pending work within 6 months of this Act's effectivity
● After 6 months, the current Board will cease to exist
● The President of the Philippines will appoint the Chairman and members of the first
Board of Electronics Engineering before the Board's dissolution
● The new Board will formulate and promulgate the rules and regulations for implementing
this Act

SEC. 38 - Vested Rights: Electronics and Communications Engineers when this Law is
Passed
● ECE with a valid COR at the time this Act takes effect will be automatically recognized
as ECE. They will receive a new COR and PIC with the same license number, pending
payment of fees and compliance with Board and Commission requirements

ARTICLE 8 - FINAL PROVISION

SEC. 39 - Implementing Rules and Regulations


● With Commission approval, the Board, in coordination with the APO, will adopt rules,
regulations, and codes for PECE, ECE, and ECT. These will be published in the Official
Gazette or a widely circulated newspaper and take effect 15 days after publication

SEC. 40 - Appropriations
● The Chairperson of the PRC shall include in the Commission's program the
implementation of this Act, the funding of which shall be included in the annual General
Appropriations Act

SEC. 41 - Separability Clause


● If any provisions of this Act or any portion thereof is declared unconstitutional by any
competent court, the other provisions hereof shall not be affected thereby

SEC. 42 - Repealing Clause


● Republic Act No. 5734 is hereby repealed.

All other laws, executive orders, rules and regulations or parts thereof in conflict with the
provisions of this Act are hereby repealed or amended accordingly.

SEC. 43 - Effectivity
● This Act shall take effect 15 days following its full publication in the Official Gazette or
any newspaper of general circulation

1. Ma-recognize sila as PECE, ECE, and ECT officially through licensure and registration.
2. Mas rarami po yung job opportunity as the number of licensed and registered PECE,
ECE and ECT increases po. Making it easy for our PECE, ECE, and ECT's to earn
themselves a job.
3. ECE’s po are encouraged na ipagpatuloy po yung pag-aaral nila ng field nila which is
good po para ma-practice palagi yung skills nila.

Are there any negative implications in this Act as far as the ECE profession is concerned?

Negative Implications
1. Because po sa sobrang strict ng pagkuha ng license and such, na di-discourage po
yung iba na pasukin yung profession.
2. Yung pagpapatuloy po ng education as PECE, ECE and ECT pati pagpapa-license and
such are medyo pricey para sa mga incoming professionals na medyo sa lower-paying
positions.

Personal and Societal Impact


1. Solid foundation po ‘tong Electronics Engineering Law of the Philippines kasi mas sure
tayo as future ECE, mga current PECE’s, ECE’s, and ECT’s because only qualified
professionals lang ang members ng ating organization.

2. Para sa national economy naman natin, we will be able to contribute as professionals sa


mga development sa technology na makakapag-boost ng growth ng bansa natin.

3. As a citizen naman, mas nakaka-proud yung qualifications ng profession natin knowing


na sobrang taas ng standards, with an s, to be a PECE, ECE or ECT.

4. And since magandang foundation ang law na ‘to and maraming pwedeng maging
opportunities, mas magiging maayos din yung financial stability natin which has a big
impact to our life and our family.

5. Lastly, as a student, inaaral natin ‘tong law para mas maintindihan natin yung importance
and mas ma-encourage tayo para pagbutihin pa yung pag-aaral natin kung very
dedicated tayo to ba a PECE, ECE and ECT soon.
