 One of the challenging relationships in the mining industry is the one that exists between mining
companies and local communities. It's undisputable that mining can leave a devastating
footprint if not managed properly. Discuss (Hand written as well)
 Futures Mining (Pvt) Ltd is a mining company that holds an exclusive prospecting order under
the Mines and Minerals Act [Chapter 21:05]. It intends to undertake its mining activities at a
specific site located in a protected private forest in Nyanga District. Section 45 of the Forests Act
states that:
'Subject to this section and notwithstanding any other law or of any title to land no miner shall
cut, fell, injure or destroy - (a) any forest produce in or remove any forest produce from any
State land; or (b) any indigenous trees or timber in or remove any indigenous trees or timber
from private land; unless he is in possession of a valid mining timber permit issued to him by the
Board. The ‘Board’ being referred to above, is the Mining Timber Permit Board established by
section 46 of the Forests Act. Futures Mining (Pvt) Ltd intends to cut indigenous trees located in
an area covering 6,000 square metres for purposes of enabling it to commence its mining
operations. On the 22nd of March 2023, Futures Mining Private Limited submits an application
for a mining timer permit to the Mining Timber Permit Board. On the 17 of August 2023, the
company is informed (through a letter from the Board) that the application for a timber mining
permit has been denied, and the company should immediately vacate the area.
Future Mining Private (Ltd) approaches you for legal advice. Advise the company accordingly.

 Your client is a general worker at a local lithium mine in Mutoko, he was electrocuted earlier this
year, while on duty, resulting in months of hospitalization, then amputation of his left arm and
permanent disfigurement. He emphasizes that his condition prevents him from engaging work
which requires able bodied individuals.He approached you seeking legal advice on legal action
against his former employer. Kindly assist.

 Draft a clear framework addressing the Minister on how Zimbabwe can navigate the green
energy transition given that Zimbabwe has a lot of hydro-carbons including fossil resources and
is also richly endowed with the vast minerals that feed the green energy revolution.
