26th Amendment

The 26th Amendment to the Constitution of Pakistan is


a significant legislative package passed by Parliament
between October 20-21, 2024 ¹. This amendment brings
about key changes to the judicial, parliamentary, and
executive frameworks of Pakistan.

*Key Provisions:*
- _Removal of Suo Motu Prerogative_: The Supreme
Court's power to initiate cases on its own has been
abolished ¹.
- _Tenure of Chief Justice_: The Chief Justice of
Pakistan's term has been capped at three years ¹.
- _Judicial Commission of Pakistan_: The JCP has been
reconstituted to oversee judicial appointments ¹.
- _Constitutional Bench_: A separate constitutional
bench will be formed in the Supreme Court ¹.
- _Limiting Court's Power_: Courts can no longer
question recommendations from the Cabinet to the
President or Prime Minister ¹.
- _Parliamentary Oversight_: Parliamentary oversight
has been increased ¹.
- _Special Committee_: A 12-member Special
Committee will be formed to nominate the Chief
Justice, with proportional representation and a two-
thirds majority requirement ¹.

*Other Significant Changes:*


- _Right to a Healthy Environment_: Article 9A has been
introduced, declaring every person's right to a clean,
healthy, and sustainable environment ¹.
- _Elimination of Riba_: The amendment aims to abolish
Riba (interest) by January 1, 2028 ¹.
- _Chief Election Commissioner_: The Chief Election
Commissioner will remain in office until a replacement
is appointed ¹.
- _Provincial Advocate Generals_: Provincial Advocate
Generals and counsel can participate in legal discussions
in their respective Provincial Assemblies ¹.
