Community Justice & Immigration Justice

community justice immigration and justice community justice is a model of justice that
emphasizes the reparations to the victim and the community it combines three key objectives
including community policing environmental crime prevention and restorative justice so what is
the philosophy of community justice this actually deviates from the traditional role of criminal
justice which usually includes apprehension conviction and punishment of the offenders the
ultimate goal here is improvement of quality of life and an emphasis on communities with high
crime rates collective efficacy also plays a major role which means mutual trust among
neighbors combined with willingness to intervene on behalf of the common good the strategy of
justice combines community policing environmental crime prevention and restorative justice
what is community policing community policing actually focuses on crime prevention through
the identification of the root of the problem within that community this can be done through foot
patrol or bike patrol and it usually has interaction between police officers and the community
they serve environmental crime control pinpoints crime hot spot sand identifies physical
attributes that can be altered to deter crime including street lighting traffic patterns among other
things the goal here is to take away opportunities for people to commit crimes in that area
restorative justice on the other hand wants to restore the community back to how it was before
the offender created the crime this means that the victim the community and the offender often
meet in order to come up with accountability measures community safety guidelines and
competency development some community justice programs include crime mapping citizen
advisory groups citizen partnerships between justice agencies and citizen groups local
organizations working together to develop crime prevention strategies citizens and victims being
involved in sentencing decisions and the offender serving community service sentences common
justice is a program that uses engagement preparation conferencing or dialogue and supervision
and follow-up in order to bring community members victims and offenders together to address
the harm that has been done and how to make things right with the parties involved community-
based crime prevention strategies include service delivery strategies that attempt to prevent crime
by helping those most at risk of committing crime by obtaining jobs stable housing and
rehabilitation efforts suppression strategies on the other hand are used in an attempt to deter
people from crime by using supervision and threats of punishment so what is the difference
between community justice and criminal justice there are four distinctions the first is
neighborhoods traditional criminal justice develops standardized approach to crimes community
justice on the other hand uses tailored strategies to fit importantdifferencesacross neighborhoods
problem solvingtraditionally is focused on the offenderthe guilty or punishedand the innocent
aren't found not guiltycommunity justice however focuses on theproblem behind the crimeand
tries to resolve it restorationcommunity justice focuses on restoringthe losses suffered by the
victimas a result of the crime justicereinvestmentcommunity justice actually focuses
onreinvesting fundsinto the communities through programmingfor workhousing education and
health careeffortswhat are some of the pros of communityjusticecommunity justice tends to look
atcrimes as problems that are localcrime concentrates in certain areas andviolence stems from
socialdisorganization in that areaso the focus is on the quality of lifein those specific
communitieswill decrease social disorganization andultimately reduce crime ratescommunity
justice also looks at crimefighting as oftendamaging to the quality of life in
thosecommunitiesremoving offenders from the communityoften disrupts familiesand causes a
sense of alienationcommunity justice sees proactive ratherthan reactive strategiesas needed
preventing crimes is the mosteffective way to obtain justiceit also saves money on
incarcerationcosts and saves the costof the community in victim restorationwe also need to
highlight the negativeaspects of community justiceone big fear is the violation ofindividual
rightsdifferent communities determine theallocation of resources and servicesthus the fear is that
the communityjustice efforts will lead to a violationof equality under the lawinserting the third
party the communitymembers in this caseinto a legal dispute can causeuncertainty in the
application of law aswellsocial inequality is another big fearbecause there is no guarantee that
theimbalance of resources in communitieswon't create community justice systemsthat are full of
inequalitiesanother big issue is increasing cost ofthe criminal justice systemeach year the u.s
spends nearly ahundred billion dollarson the criminal justice system it isunclear how community
justice effortswill be paid forand there is resistance to thereallocation of fundsfrom already
existing efforts to reducecrimewe must now shift our focus toimmigration and justicewhat is the
role of immigration withincriminal justicewell actually the u.s department ofhomeland security
uses the criminaljustice system todayin a wide variety of ways immigrationand customs
enforcementice partners with certain local andstate-level law enforcementagencies and
correctional facilities inorder to identify immigrants withoutlegal statusin the united states and
begin theprocess of deportationsome researchers have named this the keyimmigration
systemwhat is the immigration system it isimmigrant enforcement that is no longerlimited to
apprehending prospectivemigrantsalong physical borders instead newtechnologies and penal
interventionsmanage non-citizens within nationalterritoriesthe commemoration system in which
theimmigrant enforcement system isintegrated with the day-to-dayoperationsof the criminal
justice system thisincludes through policingand correctional facilitieslet's talk about ice and law
enforcementtodayseveral law enforcement agencies acrossthe united stateshave partnerships with
ice where theyare given the authority to identifypotential immigrantswho have unlawful status
within thecountry and begin the process ofdeportationone way this is done is through policiesthat
do not allow for those with nosocial securityto obtain a driver's license this meansthat even if
immigrants without legaldocumentationwanted to abide by the law they cannotdo soessentially it
criminalizes theimmigrant communityeven more than they already are policedepartments cannot
control the lawbut they do enforce it and typicallytraffic citationsare large priorities for
policedepartments because they are assignedticket quotasthrough the partnership between ice
andlaw enforcement agenciesimmigrants without legal status are athigher risk of
deportationbecause they are not allowed to obtaindriver's licenses thusbreaking traffic laws one
keypolicy that is in place to allow for lawenforcement and ice collaborationis the 287g program
this programallows for collaboration between ice andlocal law enforcement agenciesand
correctional facilities in order toprocess the identificationand removal of immigrants who do
nothave legal status within the u.scorrectional officers are given thepower to inquire about an
inmate's legalstatusand begin the process of deportation ifthey do not show proof of legal
statusthe 287g program is used across thecountryin tennessee between 2007 and 2011nearly 8
500 immigrants were identifiedwithin the correctional systemand began the process of removal
nearly80 percent of those identifiedwere from misdemeanors 60 of which werefor traffic
violationsthis program is a direct result of theprivatization of prisonsand the contracts that ice has
withthese corporationsthe gelling of undocumented immigrantshas become a billion dollar
businessice contracts several facilities most ofwhich are along the southwestern regionof the
united statesbecause of the facilities that areprivate there is little oversight andtransparency
offeredas to the conditions and care providedto the inmates within the facilityseveral stories have
been documentedthat demonstrate the inhumane conditionsfound within some of these
privatefacilitiesseveral deaths have occurred in thesefacilities as welland some inmates have
taken to hungerstrikes in order to bring widespreadattentionto these issues those who defend
theprivatization of prisonsargue that they reduce the overall costto the governmentspending by
outsourcing theincarcerations of so many peoplehowever there have been conflictingreports as to
how much their governmentactually savesthrough these contracts some reportsclaim 20savings
while others claim as little as one percent overall the immigration system is widelyintertwined
with the traditionalcriminal justice system of today
