BRIEF SYNOPSIS AND LIST OF DATES

The present Writ Petition under Article 226 of the Constifution of India
is bdng filed on bclmlf ofABC, a transgender individual who identities
herself as female and is approximately 18 years of age. The compelling
circumstances for filing the present Petition are that the petitioner is
homeless, orphan and has no known living relatives, to the best of the
petitioner's knowledge. When she was about the age of 4-5 years, living
in Noida, she was abducted by a transgender named Babita, who was part
of a human trafficking group. There she was locked in a closed room.
During her captivity she was sexually abused by many people. Recently
the petitioner managed to escape that place and started livirig at WXYZ

June 2024 : She got herself examined i� Lok Nayak


hospital, New Delhi, with the help of an NGO.

26.06.2024 : The petitioner was apprised by the respondent


no.4 that the petitioner is HIV-Positive and also
have syphilis. With respect to medical treatment,
the petitioner was advised to admit in the hospital
but till date the respondent no. 4 have not admit
the petitioner. The petitioner had approached
respondent no. 4 multiple times. However, the
respondent no. 4 refused to admit the petitioner
for the reasons best known to them. It is pertinent
to mention that till the filing of the present
petition, the respondent mo. 4 have not started
the medical treatment of the petitioner.

That the Counsel appointed by the Delhi High Court Legal Services
Committee (DHCLSC) for the Petitioner contacted many NGO's for the
shelter of the petitioner, but all refused due to lack of any government
Identity card.

The petitioner has faced ~ultiple layers of discrimination due to her gender
identity, medical condition, and homelessness. Having endured sexual
abuse and currently battling syphilis and HIV, the petitioner is in urgent
need of medical treatment and social support. However, these essential
services are inaccessible to her due to the absence of Identity documents,
such as the Transgender Identity Card and Aadhaar Card.

The petitioner has approached regional office of UIADI at New Delhi in


order to have Aadhaar Card for herself. However, in absence of requisite
documents like Birth Certificate, etc. the concerned authorities have
refused to make the same for her. Being orphan, deprivation of an Aadhaar
Card and Transgender Identity Card hampering her day to day affairs.
Further the petitioner is being denied medical health care and shelter
resulting in infringing the fundamental rights of the petitioner enshrined in
the Constitution.

MOST RESPECTFULLY SHOWETH:

1. That the petitioner is a citizen of India and is competent to invoke


the writ jurisdiction of this Hon'ble Court as the fundamental rights
of the petitioner as enshrined in the Constitution ofindia have been
violated by the respondents.

2. That the respondent no. 1 to 3 is a State and respondent no. 4 is an


instrumentality of the state within the meaning of Article 12 of the
Constitution of India and thus amendable to the writ jurisdiction of
this Hon 'hie Court.

3. That the Petitioner, a transgender person, aged about 18 years, is


HIV-positive, orphan and homeless individual living in the National
Capital Territory of Delhi. The Petitioner, being a member of the
transgender community, has faced social, economic, and legal
discrimination, especially in the absence of valid government-
recognized identity, such as the Transgender Identity Card and
Aadhaar Card.

4. The Petitioner is currently an orphan with no immediate family


members. As a homeless individual, the Petitioner resides at various
footpaths and temporary accommodations in the city of Delhi.

5. That the petitioner at the tender age of 4-5 years, was abducted from
Noida by a Transgender named Babita, who was part of human
trafficking group. She was kept in a closed room and was subjected
to sexual abuse by many people. During that time the petitioner got
affected with HIV and syphilis. A copy of the medical report of the
petitioner is annexed herewith as Annexure P/1 (Colly).

6. That the petitioner recently managed to escape from the captivity of


the traffickers and since then living at New Delhi Railway Station
Platfonn, New Delhi.

7. The Petitioner has been trying to obtain an Aadhaar card and a


Transgender Identity Card but has faced significant impediments
due to the lack of essential documents like Birth Certificate, as well
as the unavailability of a stable address, which is a prerequisite for
Aadhaar enrollment.

8. The Petitioner's inability to obtain the necessary identity documents


has led to a denial of essential services, including access to health
care, shelter, and welfare benefits, thereby exacerbating the hardship
faced by the Petitioner as a marginalized member of the trans gender
community.
9. That the Petitioner is entitled to an Aadhaar card under the law and
is a citizen of India who, like other citizens, should have access to
basic welfare benefits, social services, and identification systems.
The non-issuance of Aadhaar on grounds related to the Petitioner's
gender identity is discriminatory and violates the fundamental rights
guaranteed under Articles 14 (Equality), 19 (Freedom of speech and
expr~ssion), and 21 (Right to life and personal liberty) of the
Constitution of India.

IO.That the Hon'ble Supreme Court in the case of National Legal


Services Authority (NALSA) v. Union of India (2014) 5 sec 438,
held that transgender persons have the right to self-identify their
gender and are entitled to be recognized as such by the state. The
Court directed that the state must take steps to recognize the gender

identity of transgender persons and provide them with documents


reflecting their gender identity.

11. That on 26.06.2024, the petitioner was apprised by the respondent


no.4 that the petitioner is HIV-Positive. With respect to medical
treatment, the petitioner was advised to admit in the hospital but till
date the respondent no. 4 have not admit the petitioner. The
petitioner had approached respondent no. 4 multiple times.
However, the respondent no. 4 refused to admit the petitioner for the
reasons best known to them. It is pertinent to mention that till the
filing of the present petition, the respondent mo. 4 have not started
the medical treatment of the petitioner.
12. That the Counsel appointed by the Delhi High Court Legal Services
Committee (DHCLSC) for the Petitioner contacted many NGO's for
the shelter of the petitioner, but all refused due to lack of any
government Identity card.

13. That there is no any other similar writ petition is pending filed by
the petitioner either before this Hon'ble Court or the Hon'ble
Supreme Court oflndia in respect of the reliefs claimed in the above
petition.

14.That the petitioner has no other alternative remedy except to invoke


the writ jurisdiction of this Hon'ble Court as there has been a flagrant
violation of the fundamental rights of the petitioner as the
respondents no 1 and 4 have completely ignored the principle of due
process of law.

15.That the petitioner craves leave of this Hon'ble Court to raise any
other further ground at the time of argument of this Writ petition.

PRAYER:

In view of the above, the Petitioner prays that this Hon'ble Court may be
pleased to:

a. Issue a writ of mandamus or any other appropriate writ, direction,


or order directing the Respondents to issue the Aadhaar card &
Transgender Identity card to the Petitioner forthwith.
b. Issue a writ of mandamus or any other appropriate writ, direction,
or order directing the respondents to provide shelter and medical
treatment.
c. Grant any other relief that this Hon'ble Court may deem fit and
proper in the interest of Justice.
