court for execution and the same is fixed for 05.11.2024.

2. That the plaintiff Sh. Ram Singh had expired on 16.8.2024

The death certificate is annexed herewith as Annexure A.

3. That the deceased plaintiff Ram Singh left behind

following legal heirs/ representatives:-

1. Tara wati (wife)

2. Rajesh (Son)
3. Manoj (Son)
4. Aruna (Sister)

The copy of the adhar card is annexed herewith as

4. That besides the aforesaid persons, there is no other legal

heir/representative of the deceased plaintiff.

Application On Behalf Of Plaintiff for seeking permission to

condonation of delay on filing of application under order 22
rule 3 CPC.

Most Respectfully Showeth:-

1. That applicant’s are the legal representative of the

plaintiff since deceased who expired on 16.08.2024 and
the applicants were became busy on the last rites and
ceremonies of his father and later on death certificate was
issued on 12/9/2024.

2. That later on Tarawati was fell ill from chicken gunia and
was on bed for at least 20 days and hence could not came
to this Hon’ble court so as to move the present application
on time before this Hon’ble court, hence this application.

3. That the reason of delay is neither intentional nor

deliberate, but only due to the abovementioned reason.

PRAYER

It is therefore, most respectfully prayed before this Hon’ble Court,

that in view of the abovementioned facts and circumstances of the
present matter, this Hon’ble Court may be pleased to condone the
filing of application under 22 Rule 3 CPC, in the interest of justice.
