JKUSOBE CONSTITUTION
PREAMBLE
We the Students of the Jomo Kenyatta University of Agriculture and Technology, School of
Business and Entrepreneurship establish the Jomo Kenyatta University School of business and
Entrepreneurship (JKUSOBE) as the representative body for the students. The students have the
right to representation, in order to improve and protect the quality of education, and to better the
overall environment of the Jomo Kenyatta University of Agriculture and Technology (JKUAT).
By maintaining student rights and interests, encouraging student involvement, and improving
general student welfare will improve this institution. We do ordain and establish this Constitution
for the Jomo Kenyatta University School of Business and Entrepreneurship (JKUSOBE).
ARTICLE I: NAME
The name of the student organization that represents the student body shall be the Jomo Kenyatta
University School of Business and Entrepreneurship, hereafter referred to as JKUSOBE.
The Jomo Kenyatta University School of Business and Entrepreneurship is the officially
recognized student organization of the Jomo Kenyatta University of Agriculture and Technology,
School of Business and Entrepreneurship that represents the students of JKUSOBE both in the
internal and external community and acts as the instrument through which students are able to
provide input into the internal policies of the Jomo Kenyatta University of Agriculture and
Technology. The JKUSOBE has the authority to represent the students of the Jomo Kenyatta
University of Agriculture and Technology, School of Business and Entrepreneurship, through the
election of Student representatives.

Club Vision
Promote social, cultural, educational, and recreational activities for students of the Jomo Kenyatta
University of Agriculture and Technology, School of Business and Entrepreneurship.
Club Mission
Provide students with a forum for discussing students’ related issues and offer the opportunity for
leadership development in an individual.
Club Objectives
Section 1. Any person enrolled as a student for academic credit in any course offered under the
auspices of the Jomo Kenyatta University of Agriculture and Technology, School of Business and
Entrepreneurship shall be allowed to be a member of JKUSOBE.
Section 2. For membership, one has to pay a membership fee of Ksh. 150 and any other subsequent
contributions that shall be agreed on by the club depending on the planned events and activities.
All members as defined above shall be eligible to vote in student elections and referendums.
Section 3. All Jomo Kenyatta University of Agriculture and Technology, School of Business and
Entrepreneurship students shall have the right of inquiry, speech, and petition before the
JKUSOBE.
Section 1. Students elected or appointed to any position on the JKUSOBE are required to have and
maintain an impressive merit.

Section 2. The JKUSOBE shall be composed of thirteen (13) voting members, one (1) Secretary
General, one (1) appointed vice-chairperson and one (1) Treasurer
The Jomo Kenyatta University of Agriculture and Technology, School of Business and
Entrepreneurship club shall be comprised of two (2) divisions:

Involvement in Student Government is a great way to develop your leadership skills, influence
campus decisions, and get involved in your campus community. This election must be held no
later than the sixth week of the January-April semester immediately after the election of the school
representative.

Appointments

The Vice Chairperson is appointed by the JKUSOBE Chairperson with the aid of the Secretary
General following the January-April semester election. Also, any position not filled during the
election or which becomes available during the year, may be filled on an interim basis. In these
cases, the JKUSOBE Chairperson with the aid of the Secretary General appoints a student to fill
the unfilled position until the next election.

Secretary General, followed by the JKUSOBE Treasurer, followed by the JKUSOBEA Sports and
Entertainment Secretary.
Section 2. In the case of a vacancy of any other position, the JKUSOBE chairperson may appoint
an interim member from the student body to serve until the vacancy is filled. The chairperson shall
carry out a minimum two (2) week advertised search to fill the open seat, which is open to all
eligible members of the student body. After the search is completed, the interim member, if they
served on the JKUSOBE prior to their appointment, will return to their respective seat.
Section 3. After either dismissal by the government or official receipt of the resignation, the
JKUSOBE shall select a successor from among the student body. The JKUSOBE chairperson shall
make the appointment. The appointee must meet all membership qualifications for the vacant
position. This candidate must be confirmed by a simple majority vote of the members of the
JKUSOBE.
Section 4. No member of the JKUSOBE shall hold more than one elected JKUSOBE office at any
time.
Section 5. Members appointed to any position on the JKUSOBE before the September- December
semester election shall serve until the next regularly scheduled election. Member appointed after
the September- December semester election shall serve the remainder of the term.
Section 6. Those positions on the JKUSOBE for which election is not regularly scheduled in the
September- December semester may be appointed before next coming election.
Section 7. All members serving on the JKUSOBE shall not miss more than three meetings without
approval by the Executive Board of the JKUSOBE. If a member has missed more than three
meetings, the JKUSOBE shall have the ability to declare the seat vacant and appoint a new member
who shall serve until the next election.
Section 1. All student body legislative power shall be vested in the JKUSOBE.
Section 2. The chairperson of JKUSOBE shall, at the time of seeking office be able to serve for
the entire academic year. The chairperson shall preside at the JKUSOBE meetings. The Secretary

General is responsible for developing and distributing the agenda for each JKUSOBE meeting.
The chairperson is an ex-officio member of all JKUSOBE Committees. The chairperson shall have
the power to nominate any student, in governmental service or not, into any committee or appoint
persons to vacancies, subject to the approval of the JKUSOBE at-large.
The chairperson shall appoint Vice-Chairperson, to be approved by the JKUSOBE at-large, within
two (2) business meetings of his/her tenure.
Section 3. The Vice-Chairperson of the JKUSOBEA shall, at the time of seeking office, be able to
serve for the entire academic year. The Internal Vice-President is an ex-officio member of all
Student Government Committees and will supervise the coordination of and between committees.
The Vice-Chairperson shall create a written report at the end of each semester detailing all
JKUSOBE committee activity. The report shall be given to the JKUSOBE members, the Student
Body, and the patron.
Section 4. The Secretary General of the JKUSOBE shall serve as a voting member on both the
JKUSOBE and the Executive Committee. The Secretary General is responsible for developing and
maintaining relationships between the JKUSOBE and legislators, administrators, students, the
Jomo Kenyatta University of Agriculture and Technology community.
The Secretary General, as the Chair of the Rules and Constitution Committee, will be responsible
for the upkeep and maintenance of the Jomo Kenyatta University School of Business and
Entrepreneurship club Constitution and Bylaws.
The Secretary General shall have final decision in any discrepancies or disputes over the
Constitution and its bylaws, subject to a 2/3 veto of the JKUSOBE.
Section 5. The Finance Secretary shall head with the full consultation and advice from the
JKUSOBE, as chairperson for the Student Organization Funding Association (SOFA) and the
Student Activities Committee (SAC) to the JKUSOBE at-large for confirmation. The membership
of SOFA and SAC shall submit nominations to the Secretary General for consideration in regards
to the chairmanship of each committee.

The Treasurer shall keep a record of all expenses and income of the JKUSOBE. The Treasurer will
obtain all student fees information through the patron and dean of Student Affairs.
Section 6. The secretary shall be in charge of recording minutes of all meetings organized and
attended, in addition to which he/she will give a confirmation of the past events and meetings
which must be seconded by not less than two members who were present in the previous meeting.
The secretary shall also liase with the treasurer in keeping financial records and expenses to assure
accountability.
Section 7. The Sports and Entertainment secretary shall serve as a voting member on both the
JKUSOBE and the Executive Committee, who shall advise on Academic procedure. During the
course of a meeting, the work of the Sports and Entertainment Secretary should be limited to giving
advice to all members on JKUSOBE on matters of Sports and Entertainment. Additionally, he/she
shall fully take part in coordinating games, sports and entertainment activities within the club and
school.
Section 7. The Public Relation manager is responsible for the communication and conveyance of
information between the club and the student body. He /she shall also manage the created social
media platforms of JKUSOBE.
Section 8. The Students Welfare Representative shall at all times perform and represent the affairs
of the students in all the activities and occasions planned.
Section 9. The Departmental Representatives of the JKUSOBE shall report to the Secretary
General of JKUSOBE and will be responsible for membership. Each Representative will have a
vote at the JKUSOBE.Departmental Reps are responsible for investigating/expressing student
concerns and opinions within their respective department or interests.
Any committee can be formed by the Executive regarding its need and the activities recommended.

Section 1. Any member of the Executive or Student Body may offer, in writing, a proposed
amendment to the JKUSOBE five (5) days before the next regular meeting. Copies of the proposed
amendment will be given to the JKUSOBE chairperson, and SGA Secretary General.
Section 2. All proposed amendments must receive a two-thirds majority of the JKUSOBE at-large
on the next meeting of business. Amendments, once approved by the JKUSOBE, shall be
advertised and then brought before the entire Student Body to be voted upon, in the next election
or special election. Amendments approved by the JKUSOBE shall require a two- thirds majority
vote by the voting Student Body in order to be ratified.
Section 3. Revisions of the JKUSOBE constitution shall be proposed in the same fashion as
amendments.
ARTICLE X: NON-DISCRIMINATION
No student shall be discriminated by or receive special treatment from the JKUSOBE on account
of race, age, gender, sexual orientation, national origin, disability, religion, or political affiliation.
Section 1. The JKUSOBE shall be empowered to adopt its own rules and procedures, through
bylaws, consistent with the JKUSOBE Constitution.
Section 2. Bylaws and amendments to the bylaws may be introduced in writing by any voting
member and passed by a simple majority vote of the JKUSOBE members present and voting.
Section 3. Refer to the JKUSOBE bylaws for complete policy, rules, and procedures.
Section 1. The JKUSOBE chairperson has the right to make purchases on behalf of the JKUSOBE
without approval from the JKUSOBE as along as the expenditure is immediately reported to the

JKUSOBE Treasurer and is less than or equal to one percent of the general budget of the
JKUSOBE for the given fiscal year.
Section 2. All expenditures and budgeting shall be done by the treasurer and the committee and
approved by the chairperson as agreed by the executive or members depending on the planned
activities.
Section 1. In the spring semester, an election shall be held with the purpose of filling the following
positions: The Executive Committee, including the chairperson, the Secretary General, the
Treasurer, secretary, Sports and Entertainment secretary; the departmental representatives, and the
Public Relation manager.
Section 2. All positions not filled by election during the spring shall be elected in the fall. This
election must be held no later than the sixth week of the fall semester.
Section 3. The candidates for office shall be elected to the students upon receiving the most votes
cast in an at-large election of the student population and confirmation on part of the candidate.
Section 1. The successful candidates elected during the January-April semester shall be installed
no later than the last day of classes for the spring term. Successful candidates elected during the
fall shall be installed in office at the meeting following the completion of the election.
Section 2. Members elected during the January-April semester shall serve until the start of the
January-April semester following their election.
Section 3. No Executive Officer may hold the same elected position more than two (2) years total.

Disciplinary action may be taken against any elected or appointed JKUSOBE official, in
accordance with the Bylaws and Student Disciplinary Code as directed by secretary general.
This Constitution shall take effect immediately after ratification by a majority vote of the student
body.
