ORDER

WHEREAS, in compliance of the order dated 17.11.2024 issued by the


Commission for Air Quality Management in NCR & adjoining areas, which predicted
that air quality would remain in the adverse range, the Dept. of WCD, GNCTD, had
issued an order F.No.76(15)/DWCD/ICDS(SA&P)/Orders & Circulars/2024-
25/13491-96) dated 18.11.2024, directing the closure of all Anganwadi centers
operating in Delhi with effect from 19.11.2024, until further orders.

WHEREAS, Hon'ble Supreme Court, vide its order dated 25.11.2024 m


WP(C) No. 13029 of 1985 titled as MC. Mehta vs. Union ofIndia &Ors.inter alia has
directed the Commission for Air-Quality Management (CAQM) to consider -

' ... grant of relaxation of actions in terms of clause 5 & 8 of stage IV


measures (only in the relation to educational institutions) as well as clause 11 ofstage
Ill measures. The Commission may consider of grant of exemption to certain classes
from the aforesaid actions./measures. The commission will have to consider the grant
of relaxation/exemption as regards the actions under the force, three clauses for
various reasons, including (i) A large number of students, being deprived offacility
of midday meals as the school and Anganwadi are closed. (ii) ....... '

WHEREAS, CAQM in compliance of the Hon'ble Supreme Court's


directives has vide its order F.No.120017/27/GRAP/2 021/CAQM-l 112(DT) dated
25.11.2024 ordered with immediate effect until further orders -

'Clause 11 of GRAP stage-Ill, clause 5 of GRAP stage-IV and clause 8 of


GRAP stage-IV (to the extent it relates to colleges/ educational institutions) are
relaxed to the extent that state government in the NCR and the GNCTD shall ensure
that all laws classes up to 12th standard in schools and those in colleges/educational
institutions are conducted in a 'hybrid' mode i.e. both in physical and also in an
online mode, wherever online mode is feasible in the territorial jurisdiction of the
NCT ofDelhi.. ... '

WHEREAS, the closure of Anganwadi centers has disrupted the provision of


crucial services, particularly depriving children aged 3 to 6 years of essential
supplementary nutrition, including morning snacks and hot cooked meals, which are
vital for their growth and development.
• WHEREAS, it is also not possible to run the Anganwadi centres in a hybrid
mode due to absence of infrastructural setup at the centre as well as to the
beneficiaries.

WHEREAS, the anganwadi centres are located in close vicinity to the homes
of the children who attend it for 4 hours per day and there may not be any difference
in the air quality of their home and the anganwadi centres.

NOW, THEREFORE, in the interest of safeguarding the well-being and


development of children and ensuring the continuity of essential services provided by
the Anganwadi centers, it is hereby directed that all Anganwadi centers operating in
Delhi shall resume normal operations with effect from 26th November 2024.

All District Officers and Child Development Project Officers (CDPOs) are
directed to ensure the smooth resumption of services at Anganwadi centers and to
ensure full adherence to health and safety protocols during the reopening process.

This order is issued with the approval of the Competent Authority.
