Sections of the Commission of Inquiry Act, 1952

Section 1 – Short Title, Extent, and Commencement:

The Act extends to the whole of India, except the state of Jammu and
Kashmir, and came into force on 1st May 1952.

Section 2 – Definitions:

Defines various terms used in the Act, such as "Commission",


"Government", and "Inquiry".

Section 3 – Power to Appoint Commission:

The government may appoint a Commission to investigate specific


issues, giving terms of reference and setting deadlines.

Section 4 – Power of Inquiry:

Specifies the powers of a Commission to summon and examine


witnesses, enforce attendance, and compel the production of
documents.

Section 5 – Procedure to be followed by the Commission:

Details the procedures the Commission must follow in conducting its


inquiry, including conducting hearings, questioning witnesses, and
recording evidence.

Section 6 – Power of the Commission to Issue Subpoenas:

The Commission can issue subpoenas or summons to compel individuals


to attend and give evidence.

Section 8 – Penalties for False Evidence:

Anyone who intentionally gives false evidence before a Commission can


be punished under the provisions of the Indian Penal Code (IPC).

Section 10 – Report of the Commission:

The Commission must submit a report on its findings and


recommendations to the government.
Section 11 – Government Action on the Report:

After receiving the report, the government is required to make the report
public and act on it, though they are not legally bound by the
recommendations.
