MOST RESPECTFULLY SHOWETH:-

1. That the marriage between the petitioner no.1 and

petitioner no.2 was solemnized on 17 July, 2022 at The

Maidens Crown Banquet Hall, Peeragarhi as per Hindu

rites, customs and ceremonies. Affidavit to this effect is

attached herewith.

2. That the status, age and place of residence of the

petitioner no.1 and the petitioner no.2 before marriage

and at the time of filing of the present petition were/are

4. That the marriage between the both the petitioners were

duly consummated and cohabited but no child was born

out of the said wedlock.

5. That both the parties to the present petition have a lot of

temperamental differences between them due to which

they started living separately since 18.09.2022 both

the parties are living separately from each other

continuously.

6. That both petitioners from the connivance of the elder

relatives of their family and society, both the petitioners

have decided to dissolve their marriage by taking

decree of divorce by way of mutual consent from the


competent court of law and accordingly both the

petitioners entered into the compromise/mutual

settlement agreement and executed a

MOU/Settlement agreement on ……/11/2024 in this

regard and the petitioners decided to take divorce on

the following terms and conditions:-

a. That it is mutually settled between the parties that

Wife/petitioner no. 1 and Husband/petitioner no. 2

shall get dissolved their marriage by a decree of

mutual consent without leveling allegations and

counter-allegations against each other in

accordance with law before the court of competent

jurisdiction at Delhi.

b. The petitioner no. 2/husband had already paid a

total sum of Rs. 15,00,000/- (Rupees Fifteen Lakhs

Only) to the petitioner no. 1/wife in full and final

settlement to the satisfaction of the petitioner no. 1

qua all her claims of (past, present or in future) and

also towards all other claims of the petitioner no. 1

that includes claims with respect to Stridhan,

permanent alimony, gifts, expenditure, inheritance


or any other claim whatsoever have been amicably

resolved and settled.

c. It is further acknowledged that a sum of Rs.

15,00,000/- (Rupees Fifteen Lakhs only) has already

been paid by the petitioner no. 2 to the petitioner

no. 1 by way of Cheque number 057148 vide dated

04/11/2024 while amicably settling the matter

between both the parties .

d. It is further agreed that no more payment is

pending to be given to the petitioner no. 1/ wife by

the petitioner no. 2/ husband on any occasion or at

the time of recording of statements in second

motion petition U/s 13B(2) of Hindu Marriage Act

which shall be filed by the parties jointly, as per law

and also both the parties may move an application

for waiver off stipulated time.

e. It is further settled between the parties that the

petitioner no. 2 has already handed over all the

articles of marriage to petitioner no. 1 and vise-

versa petitioner no. 1 has handed over all the

marriage articles to petitioner no. 2 and no such


article is left to be exchanged between both the

parties.

f. That both the petitioners undertake and agreed

that they both shall not file any litigation in future

qua the marriage in any court of law.

g. That all the disputes between the petitioners to the

agreement/settlement has been resolved and it has

been agreed that the petitioner no.1/Wife shall not

claim any maintenance, stridhan, Articles

(moveable & immovable) & jewellery etc. on her

behalf in future.

h. That both the petitioners have agreed that they

shall not file any case or complaint against each

other or their family members in future before

police, or court of law and the complaints or cases

already pending in any court of law or any authority

shall be withdrawn by both the parties to the

agreement.

i. That the mutual consent has not been obtained by

force, fraud or undue influence and the same is out


of free will of both the parties and with consents of

their guardian/parents.

j. That in case any of the petitioner is not fulfilling the

terms and conditions of the aforesaid agreement

then the other party/petitioner shall reserve right to

take legal action against the other party/petitioner.

7. That both the petitioners are bound on the terms and

conditions of the aforesaid agreement.

8. It is agreed between the petitioners that if either of the

petitioner commit breach or default of this mutually

agreed settlement after the recording of the first motion

or backs out then the other party will have the right to

take legal action. It is further understood by the

petitioners that for breach of undertaking given to the

concerned court or willful /deliberate violation of a

consent order/ decree, the defaulting party/ petitioner

will be liable to be punished/ penal contempt of Court.

9. That the petitioners have agreed on each and every

terms as recorded in the said settlement /agreement,

after carefully reading over and fully understanding and


appreciating the contents, scope and effect thereof, as

also the consequence of the breach thereof, including

payment of the fine/penalty as mentioned above.

10. That there is no possibilities of reconciliation

between the parties and as such the parties have

decided to obtain the divorce by mutual consent and as

such their marriage be dissolved.

11. That the consent of the parties has not been

obtained under undue influence, coercion, fraud, or

pressure but the same is out of their free will.

12. That the petition has not been presented in

collusion between the parties.

13. That there is no reason or ground whatsoever which

may legally bar the relief prayed for.

14. That there is no other legal impediment in granting

the relief of divorce to the parties as prayed herein.


15. That the marriage between the petitioners was
solemnized at The Maidens Crown Banquet Hall,
Peeragarhi, Delhi and the petitioner no.1 presently
resides at G2-12-13A Budh Vihar, Phase I, North West
Delhi-110086 with her parents under the jurisdiction of
P.S.: Budh Vihar which is well within the territorial
jurisdiction of this Hon’ble court, hence this Hon’ble
court has got original territorial jurisdiction to try,
entertain and decide the present petition.

16. That the requisite court fee has already been

affixed on the petition.

PRAYER:-

It is, therefore, most respectfully prayed that this


Hon’ble court may graciously be pleased to allow the
present petition Under section 13 (B) (1) of the Hindu
Marriage Act as amended upto date, in the interest of

i. That the mutual consent has not been obtained by

force, fraud or undue influence and the same is out

of free will of both the parties and with consents of

their guardian/parents.

j. That in case any of the petitioner is not fulfilling the

terms and conditions of the aforesaid agreement

then the other party/petitioner shall reserve right to

take legal action against the other party/petitioner.

6. That both the petitioners are bound on the terms and

conditions of the aforesaid agreement.

7. It is agreed between the petitioners that if either of the

petitioner commit breach or default of this mutually

agreed settlement after the recording of the first motion

or backs out then the other party will have the right to

take legal action. It is further understood by the

petitioners that for breach of undertaking given to the

concerned court or willful /deliberate violation of a


consent order/ decree, the defaulting party/ petitioner

will be liable to be punished/ penal contempt of Court.

8. That the petitioners have agreed on each and every

terms as recorded in the said settlement /agreement,

after carefully reading over and fully understanding and

appreciating the contents, scope and effect thereof, as

also the consequence of the breach thereof, including

payment of the fine/penalty as mentioned above.

9. That there is no possibilities of reconciliation between

the parties and as such the parties have decided to

obtain the divorce by mutual consent and as such their

marriage be dissolved.

10. That the consent of the parties has not been

obtained under undue influence, coercion, fraud, or

pressure but the same is out of their free will.

11. That the petition has not been presented in

collusion between the parties.

12. That there is no reason or ground whatsoever which

may legally bar the relief prayed for.

13. That there is no other legal impediment in granting

the relief of divorce to the parties as prayed herein.


14. That the marriage between the petitioners was

solemnized at The Maidens Crown Banquet Hall,

Peeragarhi, Delhi and the petitioner no.1 presently

resides at G2-12-13A Budh Vihar, Phase I, North West

Delhi-110086 with her parents under the jurisdiction of

P.S.: Budh Vihar which is well within the territorial

jurisdiction of this Hon’ble court, hence this Hon’ble

court has got original territorial jurisdiction to try,

entertain and decide the present petition.

15. That the requisite court fee has already been

affixed on the petition.
