LEGAL PROFESSION & PROFESSIONAL ETHICS: MEANING, IMPORTANCE & SOURCES

Meaning of Legal Profession

In society, people occupy different occupations for their livelihood or for their
satisfaction. The occupations may be broadly divided as productive occupations and
service occupations.

The occupations which require advanced education and special training are called
professions. Law, teaching, architecture, medicine, etc. are called as professions.
They are intended to serve mankind.

The profession of law is one of the oldest and noblest professions. The person in
legal profession is called an advocate or lawyer. An advocate is an officer of justice
and friend of the court.

Advocate plead / represent the case of any Person before the Court in favourable
manner on behalf of his/her Clients. He / She collects legal material relating to the
case of his client and argue in the courts to help the Judges to deliver judgments.
The Central function that the legal profession must perform is nothing less than the
administration of justice.

Meaning of Professional Ethics

Ethics is the science of morals rules of conduct. Ethics examine human conduct and
lays down rules of duty and ideal conduct, dealing with the value of life. Ethics
determine the standard of right and wrong.

Professional ethics consists of a code of conduct for regulating the behaviour of the
individuals who are in that profession. Professional ethics for lawyers are the code
of conduct written or unwritten for regulating the behaviour of a practising lawyer
towards himself, his client and towards the court.

The norms of morals of the practising lawyer shall be fixed keeping in view the
dignity and high standard of integrity towards service to his client as well as public.

Importance

1. An advocate serves the public by giving legal advices by explaining the


complicated and confusing provisions of different Acts and Rules to citizens who
seek his service.

2. An advocate assists the parties in drafting the economic transactions like


contracts, agreements, deeds, wills etc.

3. An advocate also provides professional services regarding taxation and trade
performance.

4. An advocate should provide free legal aid to the poor and deserving people on
compassionate grounds.

5. An advocate has to protect the fundamental and human rights in addition to


propagating them among citizens.

6. An advocate is a forerunner of the society. He has to fight for law reforms and
social change and at the same time extend his services to maintain law and order.

Sources

In legal profession the advocates should possess fair and honest character and
conduct. For this, high principles of professional conduct should be framed. To
provide such principles for the noble profession, the Government of India enacted
the following specific Acts regarding the legal profession relating to the Code of
Conduct and other issues which must be strictly and scrupulously abode by the
advocates.

2. Advocates Act, 1961 (Act No. 25 of 1961
3. Bar Council of India Rules
4. Advocates (Removal of Difficulties) Orders, 1963, 1966, 1968
5. Contempt of Courts Act, 1971 (Act No. 70 of 1971)
6. Advocates (Right to take up Law Teaching) Rules, 1979
7. The Legal Services Authorities Act, 1987
8. The National Legal Services Authority Rules, 1995
9. The Supreme Court Legal Services Committee Regulations, 1996
10. Supreme Court Rules, 1966
11. Supreme Court Bar Association Rules
12. Advocates' Welfare Fund Acts and Rules of different States

The above Acts, Rules and Regulations are related specifically to legal profession.
All advocates should know the above laws for the success in their profession.
