SUBJECT: NOTICE OF VIOLATION

Madam:

Notice is hereby served upon you for having violated certain provisions of
P.D No.1586 or “Philippine Environmental Impact Assessment
System” and its Implementing Rules and Regulations based on the
evaluation report by EMB Caraga Personnel on September 19, 2024.

Commencing project without first PD 1586 and its IRR.

partnership found violating xxxx,
or the terms and conditions in
the issuance of the
Environmental Compliance
Certificate shall be fined in
amount not to exceed Fifty
Thousand Pesos (P50,000)
for every violation thereof

The foregoing considered, you are hereby required to explain in writing,


duly subscribed before a Notary Public, within ten (10) days from
receipt hereof, why you should not be penalized in an amount not to
exceed Fifty Thousand Pesos (P50,000.00) for every violations as cited
in the approved Environmental Compliance Certificate and Section 9 of
Presidential Decree No. 1586 and its Implementing Rules and to show cause
why no Order should be issued against you directing immediate cessation of
the project operation.

Moreover, you are hereby invited to attend a Technical Conference for the
following purposes:

1. Simplification of the issues and stipulation of facts; and

2. Execution of a commitment to abate or mitigate pollution, including


the implementation of remedial measures, within a period that shall
not exceed ninety (90) days.
The Technical Conference will be held on February 17, 2025, 1:00 PM, at
EMB Caraga Regional Office, Ambago, Butuan City.

Failure to appear or submit your explanation shall be construed as waiver of


your right to be heard and this Office shall institute appropriate legal action
against you based on the evidence on record.

Please be guided accordingly.
