SEEKING CONDONATION OF DELAY.

MOST RESPECTFULLY SHOWETH: -


1. The instant Application u/s 151 of CPC, 1908, is preferred on
behalf of the Defendant through its Authorized Representative
(hereinafter referred as the AR) namely Ms. Sanchi Chhabra, inter-
alia, seeking condonation of delay in filing Written Statement.

2. It is submitted that the captioned matter is pending adjudication


before this Ld. Court and the same is listed on 24.03.2025.

3. It is submitted that there is improper service of the copy of the


plaint of the captioned suit. The service of the plaint was not done
at the registered address of the Company. However, the Defendant
obtained the copy from the Delhi address. Thus, the delay is caused
in obtaining the copy of the plaint. Consequently, the delay of
_____ days has been caused in filing the accompanied written
statement.
4. The delay caused in filing the WS was neither intentional nor
deliberate but for the reason mentioned hereinabove.
5. If the said Application is not allowed then irreparable injury will be
caused to the Applicant which cannot be compensated through
monetary terms.

6. Therefore, in view of the foregoing, the delay caused in filing the


accompanied WS may be condoned in the interest of justice.

7. The instant applicant is bona-fide one and has been preferred in the
interest of justice.

PRAYER
In view of the abovementioned facts and circumstances, it is, most
humbly prayed before this Ld. Court may most graciously be
pleased to: -
(i) Pass an Order allowing the instant Application seeking
condonation of delay in filing the accompanied written
statement; and/or
(ii) Pass any other order deem fit and proper to the fact and
circumstances of the case and in the interest of justice.
