the Global Economy.

Week Progress Report:

Competition law plays a crucial role in regulating market power, ensuring fair
competition, and preventing monopolistic behavior. Dominant firms, due to their
significant influence over markets, are often scrutinized under competition laws to
prevent anti-competitive practices. This analysis explores how different
jurisdictions regulate competition, the impact of market dominance, and the role of
major firms in shaping global economic dynamics.

1. Understanding Competition Law Competition law, also known as antitrust law,


aims to promote competition by prohibiting unfair business practices such as
cartels, collusion, and abuse of dominant positions. Key components of
competition law include:

 Anti-Cartel Regulations: Prevents price-fixing, bid-rigging, and market-


sharing agreements.

 Abuse of Dominance: Restricts practices such as predatory pricing,


exclusive dealing, and unfair tying arrangements.

 Merger Control: Evaluates mergers and acquisitions to prevent market


monopolization.

2. Market Power and Dominant Firms Market power refers to a firm's ability to
influence market conditions, including pricing and output levels, without facing
significant competition. Firms with excessive market power can distort
competition, leading to inefficiencies and reduced consumer welfare.

3. Comparative Analysis of Competition Laws Across Jurisdictions

 United States (Sherman Act & Clayton Act)

o Prohibits monopolization and anti-competitive agreements.

o Focuses on consumer welfare and economic efficiency.

o Investigates dominant firms like Google, Amazon, and Meta for


anti-competitive behavior.

 European Union (EU Competition Law - Articles 101 & 102 TFEU)
o Emphasizes maintaining market fairness and preventing abuse of
dominant positions.

o Has imposed substantial fines on tech giants such as Google and


Microsoft for breaching competition rules.

o Strict merger control to prevent excessive market concentration.

 China (Anti-Monopoly Law)

o Focuses on preventing monopolistic practices while fostering state-


controlled competition.

o Targets digital platforms like Alibaba and Tencent for anti-


competitive conduct.

o Enforces heavy fines and structural remedies for market abuses.

 India (Competition Act, 2002)

o Prohibits anti-competitive agreements and abuse of dominant


position.

o Conducts investigations through the Competition Commission of


India (CCI).

o Recently scrutinized firms like Google for unfair trade practices in


digital markets.
