1. Learned counsel for the petitioners argues that in the present

case grievance of the petitioners is qua the deployment of contractual

persons without appreciating the policy dated 26.10.2023 (Annexure P/10),

which has been issued by the respondent-department, the petitioners have

been directed that they will be appointed through Haryana Kaushal Rozgar

Nigam Limited whereas, the respondents themselves agreed before this

Court that the said policy regarding the transfer of employees to Haryana

Kaushal Rozgar Nigam Limited will not be applicable upon the employees

of HARTRON.

2. Learned counsel for the petitioners submits that the petitioners

have been directed by the department that their services will be terminated

after 31.03.2024 in case they do not agree to give consent within a period of

10 days to work through Haryana Kaushal Rozgar Nigam Limited.

4. Mr. Harish Nain, AAG, Haryana accepts notice on behalf of the

respondent-State and submits that the claim of the petitioners as to whether

the policy under which the petitioners are being transferred to Haryana

Kaushal Rozgar Nigam Limited, is applicable on the employees of

HARTRON or not which will be considered in accordance with law and an

appropriate order will be passed and till then, the direction given by the

respondents vide impugned order dated 07.02.2024 (Annexure P/11) to give

the consent so as to be employed through Haryana Kaushal Rozgar Nigam

Limited will not be enforced upon the petitioners.

5. Learned counsel for the respondents further submits that the

decision as to whether the petitioners are to be employed through Haryana

Kaushal Rozgar Nigam Limited will be taken within a period of 08 weeks

from the date of receipt of copy of this order and till then, the petitioners

will be allowed to continue in service on the same terms and conditions,

which exists as of now.

6. Learned counsel for the petitioners submits that keeping in

view the statement of the learned counsel for the respondents, present

petition may kindly be disposed of having been not pressed any further.

7. Ordered accordingly.
