CONTRACT TO SELL

(Governing the Purchase and Sell of a Condominium Unit)

KNOW ALL MEN BY THESE PRESENTS:

This Contract to sell, made and entered by and between:

IXOR JOEL V. CABANBAN , Australian citizen, single, of legal age with postal address
at Unit 6/189 Sheridan Street, Cairns North QLD 4870, Australia, hereinafter known as the
“SELLER”;
-and-

MARIA NENITA U. DEL ROSARIO , Filipino/Italian citizen, married, of legal age


with postal address at Via A. Montanucci 148 00053 Civitavecchia, Rome, Italy,
hereinafter known as the “BUYER”;

SETS FORTH THAT:

WHEREAS, the SELLER is the true and absolute and registered owner of the
condominium unit located at Unit 0303-VD Chateau Elysee Condominium, Doña
Soledad Avenue Ext., Bicutan, Parañaque City, Metro Manila, covered by Condominium
Certificate of Title No. 010-2019007822;

WHEREAS, the SELLER selling the Condominiunm Unit at ONE MILLION


EIGHT HUNDRED THOUSAND PESOS (₱1,800,000.00) Philippine Currency.

WHEREAS, the SELLER and the BUYER has both agreed on the following
terms of payment:

Downpayment 01/13/23 to 01/31/23 ₱1,000,000.00


2nd Payment: 02/03/2023 ₱500,000.00
Balance: will be paid upon return to Italy
(₱100,000.00/month) for 3 months ₱300,000.00
TOTAL ₱1,800,000.00

WHEREAS, the Condominium Certificate of Title will only be transferred to the


buyer upon full payment of the total amount.

WHEREAS, the SELLER shall shoulder the Capital Gain Tax and agents
commission. The BUYER shall shoulder all other expenses necessary for the transfer of
the CCT.

IN WITNESS WHEREOF, the PARTIES have hereunto signed these presents in


the place and on the date hereinafter provided.
