MEMORANDUM OF DEPOSIT OF TITLE DEEDS

THIS MEMORANDUM OF DEPOSIT OF TITLE DEEDS executed at

THIRUPORUR on this the day of FEBRUARY 2025 by: -

Mr. KARUNAKARAN, (PAN: BGIPK9804K) (Aadhaar No. 3821 3534

8623), Son of Mr. Karuppaiah, aged about 38 Years, residing at No.2/13,

Orivayal. Kadaladi, Marandai, Ramanathapuram, Tamil Nadu – 623 703.,

(hereinafter called as Mortgagor/Depositor which expression shall,

unless it be repugnant to the context or meaning thereof, be deemed to

include his/her/their respective heirs, legal representatives, successors

and assigns etc. for creation of Equitable Mortgage by way of Deposit of

the Title Deeds).

TO AND IN FAVOUR OF

HDFC BANK LTD, a banking company, incorporated and registered

under the companies act, 1956 having its Registered Office at Senapati

Bapat Marg, Lower Parel (W) Mumbai – 400 013, and a Branch Office, inter

alia, at First Floor, ITC Centre, 760, Anna Salai, Chennai – 600 002,

(hereinafter referred to as the Bank/Mortgagee which expression shall,

unless it be repugnant to the context or meaning thereof, be deemed to

mean and include its successors and assigns etc).

WHEREAS, the Mortgagor have / has been sanctioned a loan of

Rs.60,00,000/- [Rupees Sixty Lakhs Only] at Chennai by the

Mortgagee/Bank.

WHEREAS the Mortgagor has agreed that the repayment of the

said loan of Rs.60,00,000/- [Rupees Sixty Lakhs Only] shall be

secured by an Equitable Mortgage by way deposit of the Deeds of

immovable property/ies belonging to him/her/them.

WHEREAS, the Mortgagor has irrevocably agreed to create the

security interest in favour of the Mortgagee/ Bank as the Secured Creditor

in accordance with the provisions of Section – 58(f) of Transfer of Property

Act, 1882.

WHEREAS, the Mortgagor is / are legally authorized to deposit the

said Title Documents with intent to create equitable mortgage on the said

Immovable Property/ies.

NOW THIS MEMORANDUM OF DEPOSIT OF TITLE DEEDS

WITNESSETH.

That in consideration of the sum of Rs.60,00,000/- [Rupees Sixty

Lakhs Only] advanced / to be advanced / agreed to be advanced by

HDFC BANK LTD the Mortgagee as loan to Mr. KARUNAKARAN, the

Mortgagor/s, as security for due repayment of the said loan of

Rs.60,00,000/- [Rupees Sixty Lakhs Only] together with interest that

may become due and payable, the Mortgagor has/have this day deposited

with the Mortgagee / Bank the Title Deeds morefully described in

Schedule A relating to the property mentioned Schedule B herein under

mentioned with an intent to create an equitable Mortgage by way of

Deposit of Title Deeds of the said property owned by the Mortgagor,

including interest, commitment charges, cost charges and other monies

and may become due and payable from time to time by him/her to

Mortgagee / Bank.

Building with Ground Floor, First Floor and Second Floor, bearing Plot

No.144, admeasuring 1000 Sq.Ft., Comprised in Old Survey No.

294/9L, as per Patta New Survey No. 294/79, Patta No.7162, Situated

at Road No.6, ADITYARAM SUPER STAR, in the Lay-out known as

“ADITYARAM SUPER STAR”, Situated at Pudupakkam Village,

(Sathankuppam Hamlet), Kelambakkam Village Panchayat, Thiruporur

Panchayat Union, Vandalur Taluk Chengalpattu District, and

Bounded On the:-

North by : Plot No.149,

South by : Road No.6, ADITYARAM SUPER STAR,

East by : Plot No.143,

West by : Plot No.145.

And having linear measurements as follows:-

North to South on the Eastern Side : 40 Feet,

North to South on the Western Side : 40 Feet,

East to West on the Northern Side : 25 Feet,

East to West on the Southern Side : 25 Feet.

And situated within the Sub-Registration District of Thiruporur and

Registration District of Chengalpattu.
