No-509/2024. That the Learned court was pleased to
ordered to rejected the Bail Application on 10/06/2024
being not pressed.(copy of order enclosed)

2. That in connection with the above referred case accused

petitioner namely Nur Hasan@ Nur Hasan Islam filed one
application u/s 438 Cr.P.C before the Learned Additional
District & Session Judge, Gangarampur at Buniadpur,

Dakshin Dinajpur vide Criminal Misc Case 80/2024,

 which was rejected. On 24th June,2024. (Copy of order
annexed herewith)
3. That in connection with the above referred case accused
petitioner namely Nur Hasan@ Nur Hasan Islam filed one
application u/s 438 Cr.P.C before the Honourable
Calcutta High Court vide Criminal Misc Case CRM (A)
2734 of 2024, which was rejected on 12th August,2024.
(Copy of order annexed herewith).

4. That in connection with the above referred case accused

petitioner namely Nur Hasan@ Nur Hasan Islam filed one
application for Bail before the Learned Additional District
& Session Judge(POCSO),Gangarampur at Buniadpur
which was rejected on 21st February,2025. (Copy of
order annexed herewith).

5. That in connection with the above referred case accused

petitioner namely Nur Hasan@ Nur Hasan Islam filed one
application for Bail before the Learned Additional District
& Session Judge (POCSO), Gangarampur at Buniadpur
which was rejected on 12TH MARCH,, 2025. Wherein the
learned Court was pleased to ordered as

“Today is fixed for hearing bail application.

Compliance report regarding service of bail application is received. Defacto
complainant does not appear. Ld. Spl. P.P-in-charge is present.
The record is now taken up for hearing bail application.
It appears that the application for bail of this was rejected on 21-02-2025 and
since then there has been no change in circumstances from the date of earlier
rejection except for the fact that charge has been framed and now the case is
ready for trial. In such circumstances,
I am not inclined to grant bail to the accused at this stage without attempting to
record the evidence of the defacto complainant.”

The humble petitioner most respectfully submits that:--

(a) That the accused petitioner is the permanent resident of
within the
Jurisdiction of this Honourable Court and small farmer
by
profession.
(b) That the allegation against the petitioner is that – on
07/05/2024 Faijur Rahaman lodged one written
complaint before the Gangarampur Police Station that he
along with his wife & two daughter resided at Delhi. His
daughter ****************aged about- 16+ residing in
the house of the accused Nur Hasan Islam.
He further alleged that accused accompanied her

daughter at DIGHA on 19/04/2024 & returned from

 there on 26/04/2024. That the de-facto complainant
further alleged that they left for Delhi subsequently
along with his daughter ***************. And he further
alleged that due to the threat over telephone his
daughter committed suicide at Delhi on 04/05/2024.
Those upon the strength of the written complaint lodged
by the defacto complainant Gangarampur Police Station
Case No:-222/2024 dated 07/05/2024 U/S 363/365/306
IPC & 6 of POCSO Act initiated against the accused
petitioner.
(c) That the present accused petitioner humbly submits that
he is innocent & no way connected with the present
case.
(d) That the complainant in his written complain in every
line narrated false & fabricated third story.
(e) That the accused no point of time accompanied the
victim girl with him alone. And he had not made any
threat /abetment for committing suicide.
(f) That the accused Petitioner is innocent & permanent
resident within the Jurisdiction of this Honourable Court.
(g) That the investigation of the case already been
completed as already more than 8 months elapsed & for
the purpose of investigation accused detention is no
longer required.
(h) That the accused petitioner voluntarily surrendered
before this Learned Court on 2nd January, 2025. And is in
Judicial Custody for 93 days as on 5th April, 2025.
(i) That previously no other Bail application (except the Bail
application stated herein above beginning of this
application) has been filed in respect of the present
accused petitioner before any Higher Court including
Calcutta High Court/Supreme Court of India.
(j) That the accused is totally innocents and are not guilty
of any of the offence as alleged by the complainant.
(k) That the petitioner is ready and willing to furnish the
necessary sureties as may be directed by this Honorable
Court & also bind himself as to the any conditions as
imposed by the Honorable Court .
(l) And for which the above named accused petitioner
prayed for an order for Bail.
It is therefore prayed that this Honorable
Court May be pleased to direct the
release of the petitioners on Bail in
