DECLARATION OF HEIRSHIP

AND WAIVER OF RIGHTS WITH SALE

KNOW ALL MEN BY THESE PRESENTS:

This instrument was made and executed by an Heir of EGLECERIA PALACIOS CASTILLO,
married to ARSENIO CASTILLO, namely ANGELITO PALACIOS CASTILLO, of legal age, married,
Filipino, and a resident of Purok Pahu, Brgy. Bayabas, Valladolid, Negros Occidental, hereinafter
called DECLARANT-HEIR.

That during the lifetime of EGLECERIA PALACIOS CASTILLO, she was awarded by the
Department of Agrarian Reform a parcel of agricultural land with the Certificate of Land
Ownership Award No. 00690638, and entered in the Registry of Deeds of Negros Occidental on
the 27th day of June 2003, particularly described as follows:

A parcel of land Lot 672-A of the subdivision plan (LRC) Psd-233308, being a portion of Lot
672, Valladolid Cadastre; LRC Cad. Rec. No. 25, situated in the Barrio of Bayabas, Municipality of
Valladolid; Province of Negros Occidental, Island of Negros. Bounded on the NE., and SE., points
1 to 5 by Lot 673, Valladolid Cadastre; on the SW., and SE., points 5 to 7 by Lot 672-B; on the
SW., points 7 to 8 by Lot 672-D, both of the subdivision plan; and on the NW., points 8 to 1 by Lot
667, Valladolid Cadastre. Beginning at a point marked “1” on plan being N. 43 deg. 31’E.,
1518.17 m. from BBM 23, Valladolid Cad; thence S. 54 deg. 56’E., 73.40 m. to point 2; thence S.
33 deg. 59’W., 67.15 m. to point 3; thence S. 48 deg. 22’E., 105.80 m. to point 4; thence S. 19
deg. 09’W., 86.36 point 5; thence N. 62 deg. 38’W., 124.5 m. to point 6; thence S. 32 deg. 00’W.,
62.00 m. to point 7; thence N. 59 deg. 15’W., 107.26 m. to point 8; thence N. 40 deg. 25’E.,
250.00 m. to point of beginning; containing an area of THIRTY THREE THOUSAND (33,000)
SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked
on the ground as follows: points 1 to 4 by B.L. and the rest by P.S. all cyl. conc. mons. 15x60 cm;
bearings true; declination 1 deg. 20’E., date of the original survey, Feb. 1913-May 1914, and
that of the subdivision survey, executed by Renato Cagayanan, Geodetic Engineer on Aug. 22,
1975.

That the DECLARANT-HEIR desires to RELINQUISH ABSOLUTELY ALL RIGHTS OF HIS


PORTION of the said parcel of land with an area of SIX HUNDRED TWENTY-FIVE (625) SQUARE
METERS, more or less, including all improvements thereon belonging to the Declarant as Heir of
EGLECERIA PALACIOS CASTILLO.

That for and in consideration of SEVENTY-FIVE THOUSAND PESOS (Php 75,000.00)


Philippine Currency, paid in hand by the Transferee CRISPINO Q. CEPIDA JR., of legal age,
married, Filipino, and a resident of Dela Rama Street, La Carlota City, Neg. Occ., the receipt of
which is hereby duly acknowledged by the latter to their entire satisfaction. This WAIVER by
these presents do hereby transfer and convey absolutely and irrevocably all of the DECLARANT-
HEIR’s rights, interests, and participation over his portion of the said parcel of land.

That the waiver hereby warrants valid to and possessions of the above-described portion
of the parcel of land, equivalent to SIX HUNDRED TWENTY-FIVE (625) SQUARE METERS, more or
less unto and in favor to Transferee CRISPINO Q. CEPIDA JR. and his successors, and assigns
against all claims whomsoever.
