Thank you for your correspondence dated 18-April-2024 about the above infringement notice
(ticket).

After reviewing your explanation, and the reasons for the ticket, we have decided to proceed
with enforcing the fee.

Our commitment and the reason for bus lanes


Due to the high number of vehicles at peak times, Auckland’s Road Network operates at
capacity. Travelling by bus allows more people to move around the city.

Special Vehicle Lanes (SVL) only assist buses to travel around the city faster if they are not
congested.

To ensure SVL are clear we issue infringement notices to drivers who use them incorrectly
to deter this unlawful activity. As a result, faster public transport times will attract more
patronage on public transport which will reduce congestion on our roads.

Auckland Council fully supports the Government’s initiatives on Climate Change and
Emission Objectives.

Modal shift changes along arterials, including encouraging micro mobility as first and last leg
travel options, is one way Auckland Transport can meet its Climate Change and Emission
Objectives.

Reasons for the ticket


You were observed driving in the special vehicle lane (bus lane) on Main Highway, Ellerslie
for further than the 50 metres allowed.

This bus lane operates 24 hours a day.

Drivers of other vehicles may cross the lane when turning or parking, provided they use the
minimum length of lane necessary to a maximum length of 50 metres.

The relevant legislation is the Land Transport (Road User) Rule 2004 section 2.3 (1)(f)

The officer has viewed the footage, and, on this occasion, you have travelled the full
distance of the enforcement zone measuring 89 metres.

Enclosed please find still photographs taken from the footage.

What you need to do


If you do not accept this decision, you can request a court hearing by completing the
enclosed Court Hearing Request form and returning it to us.
We will then advise you of the next steps.

Note
You will be served with a reminder notice which will give you a further 28 days to either
dispute or pay the infringement.

Need to Know
If we do not receive the completed form, or payment, by the pay-by date shown on the
reminder notice the infringement notice will automatically lodge with Baycorp for collection.

This will give you an additional 80 days to pay, make an arrangement or dispute the notice.

Please be advised that Baycorp collects on behalf of Auckland Transport, this process is to
allow you more time to pay before the matter is lodged with Ministry of Justice for collection
where additional costs will apply.
