Memorandum of Understanding summarization

• COMPANY NAME: EASTLAND SHIPPING LIMITED NEW ZEALAND


• 30 days’ Vacation Or Leave after successfully completion of one year service Job
locations: 250 Gloucester Street, Taradale, Napier 4112, New Zealand
• Work Location Address: Napier, New Zealand
• Contract Duration: two years {possibility of visa extension before contract expired}
• Accommodation: It will be provided till contract expired (Personal accommodation not
share with anybody}
• Personal & family education benefit: Yes
• No tax deduction: income will be borne by the Company and paid to the Government
directly and there will be no deduction from employee monthly salary till contract will
expired
Terms & Condition Details

WHEREAS the Employer desires to retain the services of the Employee, and the Employee desires to
render services, these terms and conditions are set forth.

IN CONSIDERATION of this mutual understanding, the parties agree to the following terms and
conditions:

1. Employment
The Employee agrees that he or she will faithfully and to the best of their ability carry
out the duties and responsibilities communicated to them by the Employer. The
Employee shall comply with all company policies, rules and procedures at all times.
2. Position
As Assistant Manager it is the duty of the Employee to perform all essential job
functions and duties. From time to time.

3. Compensation
As compensation for the services provided, the Employee shall be paid a wage of
$9,850 NZD per month

SALARY & ALLOWANCE BREAKDOWN


• Monthly salary: 9,850 NZD
• Feeding Allowance: 6,400 NZD
• Total Monthly Salary: 16,250 NZD

4. Benefits
The Employee has the right to participate in travelling emergency benefits plans offered
by the Employer. The employer currently offers [list of benefits details below]. Access to
these benefits will only be possible after the probationary period has passed.
YEARLY BENEFIT

• Monthly salary: 9,850 NZD


• Feeding Allowance: 6,400 NZD
• Yearly Vacation allowance: 15.000 NZD

TOTAL AMOUNT 31, 250 NZD

Emergency During Employment


If employee intends to travel on emergency to his home country due to any
circumstances that required emergency, we don’t have any objection; employee will be
permitted to go on emergency not more than two times per year

EMERGENCY BENEFIT DETAILS


Free Air Ticket Tro & Fro will be paid by company
Monthly salary: 9,850 NZD
Feeding Allowance: 6,400 NZD
Emergency Allowance Payment: 10,000 NZD
T OTAL AMOUNT 26,250 NZD

5. Probationary Period
You will be under probationary period of three months which organization will use
medium of probationary period to give you adequate training, the Employee is eligible
for all benefits and salary during probationary period.

6. Medical treatment
In the event of the Employee’s illness or accident caused by work during the period of
the contract, the Employer shall both provide all necessary medical treatment free of
charge to the employee or any of his family members.

7. Termination
It is the intention of both parties to form a long and mutually profitable relationship.
However, this relationship may be terminated by either party at any time; employee will
serve us two months written notice also The Employee should return any Employer
property upon termination.

8. Non-Competition and Confidentiality


As an Employee, you will have access to confidential information that is the property of
the Employer. You are not permitted to disclose this information outside of the
Company.

During your time of Employment with the Employer, you may not engage in any work
for another Employer that is related to or in competition with the Company. You will fully
disclose to your Employer any other Employment relationships that you have and you
will be permitted to seek other employment provided that (a.) it does not detract from
your ability to fulfill your duties, and (b.) you are not assisting another organization in
competing with the employer.

It is further acknowledged that upon termination of your employment, you will not solicit
business from any of the Employer’s clients for a period of at least two years.

9. Entirety
This contract represents the entire agreement between the two parties and supersedes
any previous written or oral agreement. This agreement may be modified at any time,
provided the written consent of both the Employer and the Employee.
10. Legal Authorization
The Employee agrees that he or she is fully authorized to work in NEW ZEALAND and
can provide proof of this with legal documentation. This documentation will be obtained
by the Employer for legal records.

11. Severability
The parties agree that if any portion of this contract is found to be void or
unenforceable, it shall be struck from the record and the remaining provisions will retain
their full force and effect.
12Jurisdiction
This contract shall be governed, interpreted, and construed in accordance with the laws
of New Zealand government
13 Visa & Transportation
Considering the cross country employment rules, it is not within the company's capacity
to apply for visa on employee's behalf, hence the employee is required to procure
his/her visa from their home country's designated immigration office, and upon
notification by the employee about securing the visa with proof of expenses paid during
the course of his/her visa application, the company will lawfully obliged to refund the
entire funds paid back to the employee one week before coming to new Zealand

because employer invested on visa processing previously for some candidate in


which during corona virus in India they pass on, we mean all our investment related to
visa was wasted as a result of this we lost exorbitant huge amount in their country, to
avoid loss of money our management introduced new policy, any serious candidate to
secure visa on his account, as soon as he or she completed visa procurement
successful
Expenses will be reimbursed to employee account before leaving his home country, we
don’t need any negotiation on this, if you accept Kindly sign the agreement and send us

14. Others
The Employee shall pay for all necessary fees and expenses incurred on the
Acquisition of visa in accordance with the local regulations on the Employer behalf.
In the event of natural disaster, riot, fighting or war the Employer shall evacuate the
Employee to the safe area, and if the situation is no longer conducive for the Continuity
of work, the Employer shall repatriate the Employee and employer shall pay for all the
Expenses of the repatriation.
Other conditions not mentioned in the contract shall be in accordance with the
Stipulations of the local labor law.
In case the Employer fails to implement any of the conditions agreed in this Contract, in
full or in part, the Employer shall be responsible for all the losses incurred to the
Employee.
Done in duplicate, English, each being equally authentic, each party holding one copy.
In Witness whereof, the undersigned, having fully understood the contents of the
Contract stated herein, have signed this agreement.
15. Payment Of Tax Elaboration
Employee will be subject to tax free no form of deduction will be subtract from
employee salary, the same amount mention in the agreement will be paid at end of
every month or during vacation to employee

A. The Employer shall also pay for the cost of the return travel to Employee
whenever he/she intends to travel to his/her home country in all cases, except
that the Employee is at fault or terminates the contract.

16 FAMILY WELFARE & HEALTH ARRANGEMENT


A. the Employer shall be responsible for the total welfare of the
employee’s family members and shall be responsible for the educational
advancement of two members of the employee’s families
B. In the event of any health-related issues, the Employee’s family
members shall be provided with basic health facilities at the company’s
expense ( free of charge.)
