Prosecution: Your Honor, may I call DEERYN DIMAGUIBA to the witness stand.
Judge: Swear in the witness.
CI: Ms. Witness, please raise your right hand. Do you swear to tell the truth, the whole truth, and
nothing but the truth in this proceeding?
Witness: Yes, your Honor.
CI: Please state your name, age, and personal circumstances?
Witness: My Name is DEERYN DIMAGUIBA, I am 40 years old, single, and I reside in Purok
1, Brgy. Juliana, City of San Fernando, Pampanga. I am a Business Woman and the niece of Ms.
Ann Dimaguiba.
Prosecution: Your Honor the witness testimony is being offered to prove the material allegations
in the information: first, that she is an eyewitness and also the victim to the shooting incidents
resulting to fatal injuries sustained by her and the death of Mrs. Ann Dimaguiba transpired in the
evening of April 1, 2025, in their house at Brgy. Juliana, City of San Fernando, Pampanga;
second, to identify the accused and their motives; third, to ascertain pertinent documents and for
such other matters or purposes which are relevant and material in the case under consideration.
May I proceed Your Honor?
Judge: Proceed.
Prosecution: why are you here Ms. Dimaguiba?
Witness:
Prosecution: Ms. Dimaguiba, how are you related to the deceased?
Witness: I am the niece of the Ms. Dimaguiba, maam.
Prosecutor: how about the accused, how do you know them?
Witnesses: They are my siblings.
Prosecutor: Were the accused present in this Court
Witness: Yes, Maam.
Prosecution: Ms. Dimaguiba will you please show this Honorable Court who are the accused?
Witness: Yes.
Prosecutor: Will you please identify them by pointing them.
Prosecution: On April 1, 2025, where were you?
Witness: I am at the house
Prosecution: what are you doing that time, if any?
Witness: I was scrolling my fb account at my cellphone
Prosecution: What time is that?
Witness: at 7:30 in the evening.
Prosecution: how do you know it was 7:30 at that time?
Witness: the time analog in my cellphone.
Prosecution: while you are scrolling your phone, is there any unusual incident transpired?
Witness: Yes.
Prosecution: what happened?
Witness: I hear gunshots coming from my Tita Ann’s room
Prosecution: Are you sure that there were gunshots?
Witness: Yes.
Prosecution: What did you do then when you here the gunshots?
Witness: I immediately went to see what had happened, but as I stepped out, I saw two men
Prosecution: Do you still remember their faces?
Witness: No, because their faces were covered with bonnets.
Prosecution: As you have said they are wearing bonnets; how will you recognize that the accused
were your siblings?
Witness: because of their voices
Prosecution: So during the crime is happening they were conversing, is that right Ms.
Dimaguiba?
Witness: Yes, Maam
Prosecution: if you can still remember, what they are talking, if any?
Witness: They were angrily shouting at me.
Proscution: You have said that they were angrily shouting at you, is there any reason for them to
be angry at you?
Witness: maybe because of the insurance.
Prosecution: what is the insurance all about?
Witness: Its about the insurance that my Tita Ann have.
Prosecution: What about that Insurance?
Witness: kasi nga po widow na si tita, wala narin po siyang ibang kamag-anak, kaya ako po
nakalagay as beneficiary nya po dun.
Prosecution: so your tita Ann has an insurance and you are the beneficiary of that insurance, will
that suffice for them to commit the crime?
Witness: I don’t know maam.
Prosecution: After that incident, how is the treatment of your siblings toward you?
Witness: Hindi na po nila ako kinakausap
Prosecution: After what happened next, if any?
Witness: Last Wednesday po kasi nanghihiram sila ng pera.
Prosecution: So after that said argument, they did not talk to you and because they need money
and you are their siblings that’s why they asked money from you despite your misunderstanding,
is that right, Ms. Witness?
Witness: Yes, maam.
Prosecution: Then, what happen when they ask money from you?
Witness: I am not able to give them the money, because I do not have any at that time.
Prosecution: how much money they are borrowing?
Witness: P 500,000 maam
Prosecutor: So then what happened when you say that you do not have money?
Witness: They get angry at me and say na madamot ako, meron naman daw binibigay si tita Ann
sakin, san ko dinadala yun. Then they told me, Tignan mo lang kung san ka dadalhin ng pera mo.
(Na-established na dito yung motive)
Prosecution: Ms. Dimaguiba, going back on the day of the incident, when you stepped out of
your room and saw the two men with bonnets, what happened next?
Witness: They saw me and fire at me also.
Prsecution: If you can still remember, where were you shot that time?
Witness: at my chest and ---po.
Prosecutor: As you have mentioned that you have sustained injuries by reason of the incident, the
fact of which you are testifying for today, what proof do you have, if any which show that you
indeed were hospitalized for your injuries which you have sustained during the incident?
Witness: I have a Medicolegal Certification issued by the hospital.
Prosecution: May I see this document, Ms. Witness.
Prosecutor: The witness is handling to this representation, Your Honor, a Medico Legal
certificate, dated __________ and also an X-ray report and both documents were issued by JBL
Regional Memorial Hospital. May we ask at this juncture that this medico-legal certification
dated ______be marked as our Exhibit “J” and the Radiologic Report be Marked provisionally as
Exhibit “K”.
COURT: Okay
Prosecution: we are presenting the Medico Legal Certification to the good defense counsel.
COURT: Okay.
Prosecutor: Ms. Witness, going back to the incident which transpired on April 1, 2025, the
incident as contained in the allegation in the Sinumpaang Salaysay ng Paghahabla you executed.
When you were shot in your chest portion, what if any did the accused tell you?
Witness: He said, you are going to die.
Prosecution: As you have mentioned earlier, you saw 2 individuals who were wearing bonnets
Ms. Dimaguiba, at this particular juncture, will you describe the one who shot you?
Witness: description ni Mash
Prosecutor: If you can still recall, what is the other one doing that time, if any?
Witness: He went inside the room of my Tita Ann and shot her again.
Prosecution: After that incident, what happened next?
Witness: They hurriedly went outside and leave us.
Prosecutor: when they were gone, are you still conscious at that time?
Witness: Yes, maam.
Prosecutor: What happened next, if any?
Witness: After a few minutes, Marites entered the house and help us, call the police and
ambulance.
Prosecutor: Ms. Witness, as you were testifying then and also now the injuries you sustained and
that of your Tita Ann, what happened to your Tita Ann by reason of the shot she sustained during
this incident?
Witness: She was hospitalized.
Prosecutor: How long had she been hospitalized?
Witness: 2 days, maam.
Prosecutor: After 2 days, what transpired next after that, if any?
Witness: She died, maam
Prosecutor: At the time you filed these cases before the Prosecutor’s office. You, also presented
a Certificate of Death, Ms. Witness, where is this Certificate of Death now?
Witness: Here, Maam.
Prosecutor: The witness is presenting to this representation a copy of the Certificate of Death
with stamp mark from the City Civil Registry Office. At this juncture, may we ask that this be
marked as Exhibit “B. we have provisionally marked this certification during the pre-trial. May
we ask that the provisional marking be cancelled and transferred to this Certificate of Death.
COURT: Okay.
Prosecution: Ms. Witness, after your Tita Ann died, what did you do next after that, if any?
Witness: we held a wake for my Tita Ann.
Prosecution: How long did you conduct this wake services for your Tita Ann?
Witness: 5 days, maam
Prosecution: Who spent for the burial and wake of your Tita Ann.
Witness: ----
Prosecution: Ms. Witness how about your hospitalization, who spent for that and also the buying
of medicine for the injuries that you sustained?
Witness: Also, us.
Prosecution: Ms. Witness, at the time you learned about the death of your Tita Ann, how did you
feel about that?
Witness: -----
Prosecutor: Thank you, Ms. Deeryn Dimaguiba, that will be all, your honor. However, note that
the witness needs to remain on the stand for cross-examination.
