1. Perera who was the Registrar of a state university was issued with a charge sheet containing
several charges. After disciplinary inquiry, the Inquiry Officer held that the charges framed
against Perera had not been proved. However, Perera was dismissed from service on a decision
taken by the Council of the University without giving any reasons. Perera is now challenging the
termination of his service in court.
Upon instituting proceedings, the University informed court that Perera’s service was terminated
for the reason that he did not have the necessary pre-requisite qualifications to hold the post in
question. Perera was not informed of this reason before.
Discuss the merits of the case filed in respect of the termination of Perera’s services referring to
the relevant principles of law. (50 marks)

2. Siyathu is a cultivator in Anuradhapura. He has made an application for a plot of land under the
provisions of the Land Development Ordinance. At a land Kachcheri held, Siyathu’s application
was accepted and a plot was allotted to Siyathu. The list of allottees was exhibited in the notice
board of the Divisional Secretary’s office and Siyathu was informed of the allocation in writing.
Siyathu has repeatedly sought a permit under the Land Development Ordinance to be issued in
respect of the plot allotted to him. On one occasion when Siyathu visited the Divisional
Secretary’s office he had been informed that the matter was under reconsideration and that for
the moment no permit can be issued to him. Siyathu seeks your advice to obtain relief from Court
for him to be issued with a permit 1 under the Land Development Ordinance for the land allotted
to him at the Land Kachcheri.
Discuss the remedies available to Siyathu.(50 marks)

3. Sarath is a student at a Higher Educational Institution. The Institution’s by-laws provide that the
attire of every student must be in accordance with the specifications referred to in the by-laws.
There is also provision to the effect that the violation of by-laws is a punishable offence for which
the governing board can take disciplinary action. Sarath attend lectures in an attire violating the
dress code specified in the by-laws. The Institution concerned finds Sarath guilty of violating the
by-laws by not being attired in accordance with the specification referred to in the by-laws. After
inquiry, Sarath’s studentship is terminated by the Institution even though this was the first
occasion on which the student had violated the rule regarding attire.

Sarath seeks your advice to challenge the decision of the Higher Educational Institution.
