It is this day mutually agreed between A. Bune Esq. Hong kong, as agent tor
-owners of the goods steamship called "Komagata Maru" of 3096 tons
gross horse power nominal, classed German Iioyd 100 A.L., of 4300 tons

dead weight and- tons cubic capacity, or thereabouts inclusive of bunkes,


which contain 444 tons, and Gurdit Singh, Esq. as Time charters.
1. That the said A. Bune Esq. Hong Kong agrees to let, and the sad

restraint of princes, rulers, or people loss or damages from machinery,
boilers or steam, or from explosion, heat or fire on board, in hulk or craft, or
on shore, Jettison, baratary,; Collison, any act, neglect, or default whatsoever
of Pilots, master or crew, in the management of navigation of the ship; and
all and every the dangers and accidents of the seas, rivers and Canals, and of
navigation or what ever nature or kind are mutually accepted. General
verage, if any, to be settled according to York Antwerp Rules, 1890. This
contract,wherever entered into, to be construes and governed by British Law

officer, Hong Kong Passenger Certificate for a full complement of
steerage passengers for which the measures under the certificate with
the necessary boats and hafts to be provided by the owners.

Dear Sir,
I have yours of the 29th instant in this matter.

Ido not think that any good purpose would be answered at the present
time by a discussion as to what led up to the present siruation, or whether the
writer concurs in the proposals made in the letter of yesterday's date or not. It
appears to the writer, although not having personal knowledge of the
situation until very lately, that the facts are not altogether as stated in your
letter. However, I have submitted to the Hindu Committee the terms of your
telephonic communication of yesterday evening Up to the present writingI
have not received a reply, further than to state that the matter is under

consideration, that it was impossible to get the committee together to discuss


the whole question, but that an early reply may be expected.
In the meantime I am instructed to inform you that the Hindu
Lommittee are prepared to supply provisions for them immediate needs of
tncir starving countrymen now on board the Komagata Maru. As you know,
these men have now been without food for some four or five days. The
whole question appears to resolve itself into one of a financial nature, and I
nope you will concur with me that it would be an everlasting disgrace that any
