Extended Warranty Contract (Vehicle)
This document sets out the terms, conditions and limits that apply to this Extended Warranty Contract.
The Company (AutoCon (India) Assistance and Administration Private Limited) hereby agree that in consideration of the charges paid as specified in the Extended Warranty
Schedule to cover the cost of repair / replacement of the covered parts listed in the “Covered Parts” section below suffering an electrical / mechanical breakdown in respect
of the covered vehicle for damages suffered by such parts within the Period of Contract as defined below, subject to the terms, exclusions, limitations and conditions
contained herein or endorsed under the Extended Warranty.
The Company reserves the right to inspect the vehicle according to its guidelines before issuing and/or during the period of this Extended Warranty contract.
1. DEFINITIONS
1.1. COVERAGE SCHEDULE: The Extended Warranty Contract issued by the Company that contains details of you, your Vehicle, the period of Contract, the claim limit
and applicable charges;
1.2. DEALER: The Agency registered in India to sell vehicles of one or more Vehicle manufacturer.
1.3. MANUFACTURER: The Original Equipment Manufacturer (OEM) of the Vehicle, which is the subject matter of the Extended Warranty.
1.4. A UTHORIZED SERVICE CENTRE: A vehicle repair centre or workshop authorized by the Company to carryout repair of your Vehicle covered under this Extended
Warranty Contract.
1.5. VEHICLE: The Vehicle, which is the subject matter of Contract under this Extended Warranty and described in the Proposal and Coverage Schedule as the covered
Vehicle.
1.6. REGISTERED OWNER: The customer to whom the Vehicle was sold by the Dealer or a person to whom the Vehicle is subsequently transferred by the Registered
Owner, provided that the term Registered Owner shall not include a Motor Dealer or Trader or a Garage Owner in whose custody the Vehicle is kept for the purpose
of its reselling or repair.
1.7. PERIOD OF CONTRACT: The term defined in month(s) commencing from the Extended Warranty Contract start date till the expiry date and the term defined
in kilometre commencing from Warranty Contract start kilometre and expiring kilometre as specified on the Coverage Schedule, for which period the applicable
charges has been paid to the Company. This Extended Warranty Contract expires either by the Extended Warranty Contract expiry date or the expiring kilometre,
whichever comes first.
1.8. B REAKDOWN / MECHANICAL OR ELECTRICAL FAILURE: The sudden and unforeseen failure of the parts of the Vehicle (but not by normal wear and tear, normal
deterioration or negligence) necessitating immediate repairs or replacement.
1.9. NORMAL WEAR AND TEAR: The gradual reduction in operating performance of a covered part of the Vehicle, having regard to the age of the Vehicle and the
distance it has travelled.
1.10. M ANUFACTURER’S WARRANTY: It means the original equipment Warranty Coverage provided by the Manufacturer from date of first registration of the Vehicle.
(Excludes rust, corrosion, and perforation warranties, paint, battery or tire warranties)
1.11. APPLICABLE DEDUCTION ON EVERY CLAIM: It is the amount you are required to pay towards each claim you make on this Extended Warranty Contract.
3.22. Detention, confiscation, destruction or requisition by or under the order of any Government or Public or Local Authority.
3.23. Chipping, scratching, denting, paint or body damages, glass, entertainment and communication equipment’s in Vehicle.
3.24. Any cause of loss, if reported to the Dealer/Manufacturers more than 30 days after the relevant fault has become apparent in the Vehicle.
3.25. Any claim for loss or damage attributable to perils covered / coverable or admissible under a Comprehensive Motor Insurance Policy of any Insurance Company.
3.26. Any part which is covered but not available (liability in any case will be restricted to the required part and not to any replacement or repair of the entire component)
3.27. Any claim where the Company or authorized representatives of Company have not been contacted prior to repair(s).
3.28. Any cost(s) incurred in improving or reconditioning of the Vehicle or parts to a condition superior to that at the time of purchase.
3.29. Any cost(s) of diagnostic or dismantling nature, unless accepted as part of an authorized claim.
3.30. Any component not covered under Manufacturer Warranty is not covered under this Extended Warranty Contract.
3.31. The GST part of the invoiced amount where the Authorised Service Centre does not issue the invoice in the name of the Company.
3.32. Any Breakdown Any loss, damage, cost or claim caused by a seizure of the Vehicle’s engine.
4. CONDITIONS
4.1. Every notice or communication to be given or made under this Extended Warranty shall be delivered in writing to the Extended Warranty Issuing Office of the
Company.
4.2. The Extended Warranty shall become void and all charges paid hereon shall be forfeited in the event of misrepresentation or non-disclosure of any material fact(s)
by the Registered Owner / Dealer / Manufacturer.
4.3. The Registered Owner/ Dealer shall inform the Company immediately on the occurrence of any claim under the Extended Warranty. The Registered Owner/ Dealer
shall furnish all such explanations, vouchers, proofs or ownership and date of sale, other evidence, information, particulars and documents as the Company may, in
its absolute discretion, require for the substantiation of claim under the Extended Warranty.
4.4. The Registered Owner will keep full and proper books and records in respect of this Extended Warranty and these books and records shall be open for inspection by
the Company as and when required. The Company will have permission to visit the Registered owner’s / Dealer’s / Manufacturer’s premises in connection with this
Extended Warranty. The Company will have the right to review and assess any claim using their claims engineers or empanelled surveyors. The Registered Owner /
Dealer shall comply with all the formalities and submit all relevant documents in support of any claim made under this Extended Warranty.
4.5. Parts used in repairing the covered Vehicle may be manufactured by other than the covered Vehicle’s Manufacturer and will be compatible with the age and
condition of the Vehicle.
4.6. The Company reserves the right to take over and conduct in the name of the Registered Owner or any person seeking benefit under the Extended Warranty, the
defence or settlement of any claim. Further, the Company also reserves the right to take proceedings at their own expenses and for their own benefit, but in the
name of Registered Owner or any other person who is claiming or has received benefit, to recover any payment or due under the Extended Warranty.
4.7. If at the time of any loss or damage arising out of the contingencies covered under this Extended Warranty, a Contract shall be subsisting with any other Company
covering such property, whether such Contract was effected by the Dealer/Manufacturer or the Registered Owner, or any other person or persons on behalf of the
Dealer/Manufacturer or the Owner, the Company shall only be liable to pay or contribute its rateable proportion of any such loss or damage.
4.8. If any claim under this Extended Warranty shall be in any respect fraudulent or if any fraudulent means or devices are used by the Dealer/Manufacturer or the
Registered Owner or anyone acting on behalf of the Dealer/Manufacturer or the Owner, all benefits under this Extended Warranty shall be forfeited.
4.9. If any dispute or difference shall arise as to the quantum to be paid under this Extended Warranty (liability being otherwise admitted) such difference shall
independently of all other questions be referred to the decision of a sole arbitrator to be appointed in writing by the parties hereto or if they cannot agree upon a
single arbitrator within 30 days of any party invoking arbitration, the same shall be referred to a panel of three arbitrators comprising of two arbitrators, one to be
appointed by each of the parties to the dispute/difference and the third arbitrator to be appointed by such two arbitrators and arbitration shall be conducted under
and in accordance with the provisions of the Arbitration and Conciliation Act 1996. It is clearly agreed and understood that no difference or dispute shall be referred
to arbitration as hereinbefore provided, if the Company has disputed or not accepted liability under this Extended Warranty. It is hereby expressly stipulated and
declared that it shall be a condition precedent to a right of action or suit under this Extended Warranty that award by such arbitrator/arbitrators of the amount of
the loss or damage shall be first obtained.
4.10. Subject to the above condition on arbitration and without affecting the validity of the Arbitration Clause, the parties hereto unconditionally and irrevocably agree
to submit to the exclusive jurisdiction of the competent Court in India.
4.11. If the Company shall disclaim liability to the Registered Owner for any claim hereunder and such claim has not been made the subject matter of a suit in a Court of
Law within 12 calendar months from the date of such disclaimer, then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter
be recoverable hereunder.
4.12. The due observance and fulfilment of the terms, provisions, conditions and endorsement of this Extended Warranty, insofar as they relate to be done or complied
with by the Registered Owner shall be condition precedent to any liability of the Company to make any payment under this Extended Warranty.
5. LIMIT OF LIABILITY / EXCESS
The overall liability under this Extended Warranty Contract for the entire Period of Contract is as specified in the Coverage Schedule. The Excess applicable on each claim
is mentioned in the Coverage Schedule.
6. CANCELLATION
This Extended Warranty may be cancelled by either party at any time by giving 10 days’ notice in writing to the other party at their last known address.
If the Extended Warranty is cancelled by the Company and subject to no claim having been reported, the amount will be refunded on pro-rata basis for the unexpired
Period of Contract. In case of reported claim, no refund shall be payable.
If the Extended Warranty is cancelled by the Registered Owner and subject to no claim having been reported, the amount will be refunded on a short term cancellation as
per the table below. In case of reported claim, no refund shall be payable.
If the Extended Warranty is issued for a terms lesser than 12 months, no refund shall be payable.

7. OWNER’S RESPONSIBILITY
7.1. In the event of any Breakdown, the covered Vehicle shall not be left unattended without proper precautions being taken to prevent further damage or loss and if
the Vehicle be driven before the necessary repairs are affected, there shall be no liability of the Company for any escalation of the damage or for any further damage
to the Vehicle.
7.2. The Vehicle covered under this Extended Warranty Contract must be serviced and maintained as recommended by the Vehicle Manufacturer at the Authorized
Service Centre. Please ensure that the Service Booklet or Digital Service Book/records of the Vehicle is updated with every scheduled service.
7.3. Only you are entitled to make a claim or receive a benefit from this Extended Warranty. At our sole discretion, we may permit transfer to a new owner if you sell the
covered Vehicle. To request transfer, please complete the Transfer of Ownership request form and send it to Company, accompanied by a copy of a roadworthy/
vehicle inspection report, a copy of the Vehicle service records and the applicable transfer fee. If we accept the transfer, a new Coverage schedule will be forwarded
to the new Owner.
8. MAKING A CLAIM
To make a claim on this Extended Warranty, you must:
1. Take the Vehicle to any Authorized Service Centre.
2. Provide details of this Extended Warranty Contract when delivering the Vehicle to the Authorized Service Centre and inform to lodge a claim on your behalf.
3. Instruct the Authorised Service Centre to issue the invoice in the name of the Company for the cost of the repair. If the Authorised Service Centre is unable to invoice
the Company, the Company will only reimburse you for the invoiced amount less the GST.
4. Contact the Claims Office if you experience any difficulties. We will contact the Authorized Service Centre.
You are responsible to make sure that the Authorised service facility contacts us before repairs are commenced. Sometimes we may also need you to authorise certain work
with the Authorised service facility since we may not be able to ascertain whether the failure is covered by this Extended Warranty without dismantling the Vehicle. Where
this is the case, we or the Authorized Service Centre will request your authority before commencing any work on the Vehicle.
