Extended Warranty Contract (Vehicle)
This document sets out the terms, conditions and limits that apply to this Extended Warranty Contract.
The Company (AutoCon (India) Assistance and Administration Private Limited) hereby agree that in consideration of the charges paid as specified in the Extended Warranty
Schedule to cover the cost of repair / replacement of the covered parts listed in the “Covered Parts” section below suffering an electrical / mechanical breakdown in respect
of the covered vehicle for damages suffered by such parts within the Period of Contract as defined below, subject to the terms, exclusions, limitations and conditions
contained herein or endorsed under the Extended Warranty.
The Company reserves the right to inspect the vehicle according to its guidelines before issuing and/or during the period of this Extended Warranty contract.
1. DEFINITIONS
1.1. COVERAGE SCHEDULE: The Extended Warranty Contract issued by the Company that contains details of you, your Vehicle, the period of Contract, the claim limit
and applicable charges;
1.2. DEALER: The Agency registered in India to sell vehicles of one or more Vehicle manufacturer.
1.3. MANUFACTURER: The Original Equipment Manufacturer (OEM) of the Vehicle, which is the subject matter of the Extended Warranty.
1.4. A UTHORIZED SERVICE CENTRE: A vehicle repair centre or workshop authorized by the Company to carryout repair of your Vehicle covered under this Extended
Warranty Contract.
1.5. VEHICLE: The Vehicle, which is the subject matter of Contract under this Extended Warranty and described in the Proposal and Coverage Schedule as the covered
Vehicle.
1.6. REGISTERED OWNER: The customer to whom the Vehicle was sold by the Dealer or a person to whom the Vehicle is subsequently transferred by the Registered
Owner, provided that the term Registered Owner shall not include a Motor Dealer or Trader or a Garage Owner in whose custody the Vehicle is kept for the purpose
of its reselling or repair.
1.7. PERIOD OF CONTRACT: The term defined in month(s) commencing from the Extended Warranty Contract start date till the expiry date and the term defined
in kilometre commencing from Warranty Contract start kilometre and expiring kilometre as specified on the Coverage Schedule, for which period the applicable
charges has been paid to the Company. This Extended Warranty Contract expires either by the Extended Warranty Contract expiry date or the expiring kilometre,
whichever comes first.
1.8. B REAKDOWN / MECHANICAL OR ELECTRICAL FAILURE: The sudden and unforeseen failure of the parts of the Vehicle (but not by normal wear and tear, normal
deterioration or negligence) necessitating immediate repairs or replacement.
1.9. NORMAL WEAR AND TEAR: The gradual reduction in operating performance of a covered part of the Vehicle, having regard to the age of the Vehicle and the
distance it has travelled.
1.10. M  ANUFACTURER’S WARRANTY: It means the original equipment Warranty Coverage provided by the Manufacturer from date of first registration of the Vehicle.
(Excludes rust, corrosion, and perforation warranties, paint, battery or tire warranties)
1.11. APPLICABLE DEDUCTION ON EVERY CLAIM: It is the amount you are required to pay towards each claim you make on this Extended Warranty Contract.

2. COVERED PARTS
2.1 .ENGINE: All internal engine parts as listed: pistons, piston rings, piston pins, crankshaft and main bearings, connecting rods and rod bearings, balance shaft and balance
shaft bearings, camshaft and camshaft bearings, timing chain or timing gear, timing tensioner, engine block and cylinder barrel, cylinder head(s), intake and exhaust valves,
valve springs, guides, oil pump, push rods, rocker arms, hydraulic lifters, rocker arm shafts, cylinder head studs/bolts, camshaft followers, oil pump drive gears and shafts.
Note: Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.2. M ANUAL TRANSMISSION: All internal transmission parts as listed. All gears, bearings, bushings and spacers, oil pumps, synchromesh assembly, speedometer
drive gear, internal electronic solenoids, AMT Mechanism, internal wiring harnesses, springs, gear shift forks and rails, transmission case. Note: Gaskets and seals
alone are not covered components, if the gaskets and seals are available separately..
2.3. A UTOMATIC TRANSMISSION: All internal transmission parts as listed. All gears, bearings, bushings and spacers, clutch plates, friction and steel drums, oil pumps,
servo units and torque converter, valves and valve body, synchromesh assembly, speedometer drive gear, internal electronic solenoids, internal wiring harnesses,
springs, gear shift forks and rails, transmission case. Note: Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.4. C ONTINUOUSLY VARIABLE TRANSMISSION (CVT): Failure of internal mechanical parts including clutches, planetary gears, reduction gears, shafts, variable
pulleys, thrust link drives, belt and chain, internal seals, bushes and bearings, CVT casing. Note: Gaskets and seals alone are not covered components, if the gaskets
and seals are available separately.
2.5. C OOLING SYSTEM: Radiator, oil cooler, water pump, viscous coupling, thermostat valve, Radiator fan motor and heater matrix, viscous coupled fan.
Note: Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.6.FUEL SYSTEM: Carburettor, automatic choke unit, fuel pump, lift pump, injector and pump, metering unit, airflow computer, fuel level sensors, tank sender unit
and cold start valve. Note: Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.7. DIFFERENTIAL AND DRIVE AXLE: Crown wheel and pinion, all bearings , bushes and spacers, axles, L.S.D. friction plates, springs, spider gears, drive shafts, universal
joints and CV joint (not boots or damage caused by damaged boots), coupling and yolks, retainers and lock rings, swivel hubs and free wheel hubs, axle housing.
Note: Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.8. BRAKES: Master cylinder; wheel cylinders; disc brake callipers; power and vacuum brake units; proportioning valve, hydro boost units, A.B.S. modulator
2.9.TURBO CHARGER: (if fitted by manufacturer): Impellors, bearings and housing. Note: Gaskets and seals alone are not covered components, if the gaskets and
seals are available separately.
2.10.SUSPENSION: Only functional failure of McPherson struts, shock-absorbers or Air struts.
Note: The listed components will not be covered by this extended warranty if the issue is only noise or oil seepage due to normal usage and age of the vehicle.
2.11. STEERING SYSTEM: Power steering pump, steering column, steering rack and pinion, steering clock spring, steering motor, steering control module and sensors.
Note: The listed components will be covered only for functional failures. Noises from the covered components due to normal usage / age (but not limited to) will
not be covered. Gaskets and seals alone are not covered components, if the gaskets and seals are available separately.
2.12. A  IR CONDITIONING: Compressor, condenser, evaporator, clutch, blower motor and Condenser fan motor, expansion valve. Note: Gaskets and seals alone are

not covered components, if the gaskets and seals are available separately. Blockage and flushing alone are also not covered.
2.13. ELECTRICAL: Starter motor and solenoid, alternator, distributor, coil, wiper and washer motors, window motors, central locking solenoids, electronic ignition,
electronic control modules, ignition switch, Power window switch, Combination Switch, Door Switch, heated front / rear screen, harness and wiring, and cruise
control systems, sensors and solenoids. Note: Pulleys are not covered normally, however, if a problem in the alternator can be resolved by replacing the pulley,
the pulley will covered.
2.14. E  LECTRONICS: Electronic Engine Management Control Unit, Transmission Management Control Unit, Instrument panel cluster, A.B.S. control unit, cruise control
(if fitted by manufacturer).
2.15. CONSUMABLES: Sundry materials such as anti-freeze, refrigerant, fluids and lubricants are covered where their replacement is essential as a direct result of
breakdown of a covered component.
3. EXCLUSIONS
The Company shall not be liable for loss or damage in respect of the following:
3.1. Any Breakdown occurring outside the geographic limits of India.
3.2. Any parts / component of the Vehicle not specifically listed as a covered part of this Extended Warranty.
3.3. Any claims where we have not been contacted prior to the commencement of repairs or repairs where we have not issued a claim authorization number.
3.4. Normal maintenance service required on the Vehicle and its accessories, including oil and fluid changes, headlight alignment, fastener tightening, wheel balancing,
wheel alignment, carburettor adjustments, ignition timing, valve clearance, body work, painting, glass, interiors / exteriors, and/or repair of oil leaks caused by
gasket or seal failure, if the gaskets and seals are available separately, flushing and cleaning. All types of pulleys and exhaust system and evap emission system -
Exhaust pipes and mountings exhaust muffler, exhaust resonator, catalytic converter, lambda sensor or O2 sensor, EGR components and manifold , Audio video
infotainment system, navigation system, tyre pressure monitoring system, all types of cameras, USB and all auxiliary sockets, speaker, tweeter, subwoofer, antenna,
windshield washer jet, hands-free calling and Bluetooth devices, bulbs, cigarette lighter, horns, fuse, relay, lamps and lamp frames (including xenon HID and LED).
3.5. Any loss where the speedometer has been tampered with altered or disconnected.
3.6. Repairs, replacement or alterations not authorized by the Dealer or Manufacturer.
3.7. Vehicles or covered parts which have been in any way modified from the Manufacturer’s specification or to any non-Manufacturer fitted part or directly related to
or caused by fitting of any non-Manufacturer fitted part.
3.8. Vehicles which have been repaired other than at the Dealer’s or Manufacturer’s approved workshop or utilization of parts or accessories not approved by
Manufacturer.
3.9. Any loss arising out of the Vehicle being used for any sort of competition, sport or rally racing, pace making, reliability trials, over loading, towing without suitable
recommendation by the Manufacturer, transport for hire or reward of persons or goods, taxi services, hire, rent-a-car or driving school or any commercial use.
3.10. Liability which attaches by virtue of an Agreement (except as mentioned under the Extended Warranty Contract scheme), but which would not have attached in

the absence of such Agreement.


3.11. Consequential Damages are not covered (Damage for a covered component caused by a non-covered component or Damage for non covered component caused
by a covered component)
3.12. Loss, destruction or damage to any property whatsoever or any legal liability of whatsoever nature directly or indirectly caused by or contributed to or arising
from:-
i. Ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel.
ii. The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.
iii. Pressure waves caused by aircraft or other aerial devices traveling at sonic or supersonic speeds.
iv. War, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power.
v. Damage caused by the direct effects of storm, hail, lightning, earthquake or floods as well as by fire, charring or explosion.
vi. Damage caused by external factors such as martens or other animals.
3.13. Any Breakdown occurring which is due in whole or in part to any type of accident or any act or omission which is wilful, illegal or grossly negligent, or any repairs
required as a result of continued operation of the Vehicle once a defect or fault has occurred.
3.14. Any Breakdown to a component or components which are either subject to recall by Vehicle’s Manufacturer or can be considered as having inherent design faults.
3.15. Any Breakdown caused by corrosion, frost, rust or elements of nature.
3.16. Any Breakdown caused by lack of maintaining proper levels of or contamination of antifreeze/coolants, lubricants, hydraulic fluid or due to overheating.
3.17. Damage arising from:-
i. Normal wear and tear, including but not limited to bulbs, batteries, tires, tubes, spark plugs, brake linings, belts, hoses, filters, wiper blades, brushes and clutch
assembly plates where failure is due to burnt clutches.
ii. Faulty repair or incorrect servicing of the Vehicle.
iii. Foreign matter entering the fuel or cooling system.
iv. Contaminated or incorrect types or grade of oil, fuel, lubricants, hydraulic fluids or any additives not recommended by the Manufacturer of the Vehicle.
3.18. Damage in respect of those Vehicles which have not been regularly serviced in accordance with the Manufacturer’s or Dealer’s recommendations.
3.19. Damage as a result of Vehicle not being operated in accordance with the operating instructions of the Owner’s manual.
3.20. Insignificant defects that do not affect the functions of the Vehicle, including but not limited to sound, vibration and fluid seepage.
3.21. Any service items and other components subject to routine maintenance or servicing, or any part which has not failed but replaced due to no reason.

3.22. Detention, confiscation, destruction or requisition by or under the order of any Government or Public or Local Authority.
3.23. Chipping, scratching, denting, paint or body damages, glass, entertainment and communication equipment’s in Vehicle.
3.24. Any cause of loss, if reported to the Dealer/Manufacturers more than 30 days after the relevant fault has become apparent in the Vehicle.
3.25. Any claim for loss or damage attributable to perils covered / coverable or admissible under a Comprehensive Motor Insurance Policy of any Insurance Company.
3.26. Any part which is covered but not available (liability in any case will be restricted to the required part and not to any replacement or repair of the entire component)
3.27. Any claim where the Company or authorized representatives of Company have not been contacted prior to repair(s).
3.28. Any cost(s) incurred in improving or reconditioning of the Vehicle or parts to a condition superior to that at the time of purchase.
3.29. Any cost(s) of diagnostic or dismantling nature, unless accepted as part of an authorized claim.
3.30. Any component not covered under Manufacturer Warranty is not covered under this Extended Warranty Contract.
3.31. The GST part of the invoiced amount where the Authorised Service Centre does not issue the invoice in the name of the Company.
3.32. Any Breakdown Any loss, damage, cost or claim caused by a seizure of the Vehicle’s engine.
4. CONDITIONS
4.1. Every notice or communication to be given or made under this Extended Warranty shall be delivered in writing to the Extended Warranty Issuing Office of the
Company.
4.2. The Extended Warranty shall become void and all charges paid hereon shall be forfeited in the event of misrepresentation or non-disclosure of any material fact(s)
by the Registered Owner / Dealer / Manufacturer.
4.3. The Registered Owner/ Dealer shall inform the Company immediately on the occurrence of any claim under the Extended Warranty. The Registered Owner/ Dealer
shall furnish all such explanations, vouchers, proofs or ownership and date of sale, other evidence, information, particulars and documents as the Company may, in
its absolute discretion, require for the substantiation of claim under the Extended Warranty.
4.4. The Registered Owner will keep full and proper books and records in respect of this Extended Warranty and these books and records shall be open for inspection by
the Company as and when required. The Company will have permission to visit the Registered owner’s / Dealer’s / Manufacturer’s premises in connection with this
Extended Warranty. The Company will have the right to review and assess any claim using their claims engineers or empanelled surveyors. The Registered Owner /
Dealer shall comply with all the formalities and submit all relevant documents in support of any claim made under this Extended Warranty.
4.5. Parts used in repairing the covered Vehicle may be manufactured by other than the covered Vehicle’s Manufacturer and will be compatible with the age and
condition of the Vehicle.
4.6. The Company reserves the right to take over and conduct in the name of the Registered Owner or any person seeking benefit under the Extended Warranty, the
defence or settlement of any claim. Further, the Company also reserves the right to take proceedings at their own expenses and for their own benefit, but in the
name of Registered Owner or any other person who is claiming or has received benefit, to recover any payment or due under the Extended Warranty.

4.7. If at the time of any loss or damage arising out of the contingencies covered under this Extended Warranty, a Contract shall be subsisting with any other Company
covering such property, whether such Contract was effected by the Dealer/Manufacturer or the Registered Owner, or any other person or persons on behalf of the
Dealer/Manufacturer or the Owner, the Company shall only be liable to pay or contribute its rateable proportion of any such loss or damage.
4.8. If any claim under this Extended Warranty shall be in any respect fraudulent or if any fraudulent means or devices are used by the Dealer/Manufacturer or the
Registered Owner or anyone acting on behalf of the Dealer/Manufacturer or the Owner, all benefits under this Extended Warranty shall be forfeited.
4.9. If any dispute or difference shall arise as to the quantum to be paid under this Extended Warranty (liability being otherwise admitted) such difference shall
independently of all other questions be referred to the decision of a sole arbitrator to be appointed in writing by the parties hereto or if they cannot agree upon a
single arbitrator within 30 days of any party invoking arbitration, the same shall be referred to a panel of three arbitrators comprising of two arbitrators, one to be
appointed by each of the parties to the dispute/difference and the third arbitrator to be appointed by such two arbitrators and arbitration shall be conducted under
and in accordance with the provisions of the Arbitration and Conciliation Act 1996. It is clearly agreed and understood that no difference or dispute shall be referred
to arbitration as hereinbefore provided, if the Company has disputed or not accepted liability under this Extended Warranty. It is hereby expressly stipulated and
declared that it shall be a condition precedent to a right of action or suit under this Extended Warranty that award by such arbitrator/arbitrators of the amount of
the loss or damage shall be first obtained.
4.10. Subject to the above condition on arbitration and without affecting the validity of the Arbitration Clause, the parties hereto unconditionally and irrevocably agree
to submit to the exclusive jurisdiction of the competent Court in India.
4.11. If the Company shall disclaim liability to the Registered Owner for any claim hereunder and such claim has not been made the subject matter of a suit in a Court of
Law within 12 calendar months from the date of such disclaimer, then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter
be recoverable hereunder.
4.12. The due observance and fulfilment of the terms, provisions, conditions and endorsement of this Extended Warranty, insofar as they relate to be done or complied
with by the Registered Owner shall be condition precedent to any liability of the Company to make any payment under this Extended Warranty.
5. LIMIT OF LIABILITY / EXCESS
The overall liability under this Extended Warranty Contract for the entire Period of Contract is as specified in the Coverage Schedule. The Excess applicable on each claim
is mentioned in the Coverage Schedule.
6. CANCELLATION
This Extended Warranty may be cancelled by either party at any time by giving 10 days’ notice in writing to the other party at their last known address.
If the Extended Warranty is cancelled by the Company and subject to no claim having been reported, the amount will be refunded on pro-rata basis for the unexpired
Period of Contract. In case of reported claim, no refund shall be payable.
If the Extended Warranty is cancelled by the Registered Owner and subject to no claim having been reported, the amount will be refunded on a short term cancellation as
per the table below. In case of reported claim, no refund shall be payable.

If the Extended Warranty is issued for a terms lesser than 12 months, no refund shall be payable.

Extended Warranty Contract (Vehicle)

7. OWNER’S RESPONSIBILITY
7.1. In the event of any Breakdown, the covered Vehicle shall not be left unattended without proper precautions being taken to prevent further damage or loss and if
the Vehicle be driven before the necessary repairs are affected, there shall be no liability of the Company for any escalation of the damage or for any further damage
to the Vehicle.
7.2. The Vehicle covered under this Extended Warranty Contract must be serviced and maintained as recommended by the Vehicle Manufacturer at the Authorized
Service Centre. Please ensure that the Service Booklet or Digital Service Book/records of the Vehicle is updated with every scheduled service.
7.3. Only you are entitled to make a claim or receive a benefit from this Extended Warranty. At our sole discretion, we may permit transfer to a new owner if you sell the
covered Vehicle. To request transfer, please complete the Transfer of Ownership request form and send it to Company, accompanied by a copy of a roadworthy/
vehicle inspection report, a copy of the Vehicle service records and the applicable transfer fee. If we accept the transfer, a new Coverage schedule will be forwarded
to the new Owner.
8. MAKING A CLAIM
To make a claim on this Extended Warranty, you must:
1. Take the Vehicle to any Authorized Service Centre.
2. Provide details of this Extended Warranty Contract when delivering the Vehicle to the Authorized Service Centre and inform to lodge a claim on your behalf.
3. Instruct the Authorised Service Centre to issue the invoice in the name of the Company for the cost of the repair. If the Authorised Service Centre is unable to invoice
the Company, the Company will only reimburse you for the invoiced amount less the GST.
4. Contact the Claims Office if you experience any difficulties. We will contact the Authorized Service Centre.
You are responsible to make sure that the Authorised service facility contacts us before repairs are commenced. Sometimes we may also need you to authorise certain work
with the Authorised service facility since we may not be able to ascertain whether the failure is covered by this Extended Warranty without dismantling the Vehicle. Where
this is the case, we or the Authorized Service Centre will request your authority before commencing any work on the Vehicle.
