Introduction

This case study examines the case of Angelito G. Ridon,

focusing on his illegal possession of fire arm and ammunition. By

analyzing Mr. Ridon’s case, we aim to understand how illegal

possession of fire arm impacts the safety of the community. The

study will explore the effects of Mr. Ridons actions on his family, and

to the community. The illegal possession of firearm and ammunition

had been the problem of the law enforcer, for the past years. It has

been a challenge to our law enforcement and the criminal justice

system. The challenges include: Difficulty in identifying individuals

who are prohibited from possessing firearms. It is also a significant

societal concern, that might result to violent crime, accidental

shootings, and the potential for mass shootings.

The illegal possession of firearms disproportionately impacts

communities that are vulnerable. These communities often

experience higher rates of gun violence, accidental shooting, and

suicides related to firearm accessibility. Moreover the presence of

illegal firearms can make violence and fear, making it difficult to the

people to feel safe in their own communities. This study will explore

the complex interplay of legal, social, and economic factors that

contribute to this issue, examining its impact on public safety, the


challenges faced by law enforcement. The discussion will

encompass the legal complexities surrounding firearm ownership.


Background Information

Angelito Ridon y Guevara was driving a motorcycle early in

the morning of August 2, 2013 around 3:30 am in Baranggay

Comembo, Makati City on a one way street. The police were

patrolling when they noticed Angelito going the wrong way on one-

way street. When the police stopped him, he refused to comply and

it is said that he made a u-turn which led to a chase. The officers

was identified as PO3 Sherwin Cleto Limbauan, PO3 Mike Lester

Pacis, and Bantay Bayan Buesa, they were able to corner him after

he lost control of his motorcycle. The police officers said that

Angelito was reaching for something from his waist, which prompted

them to search him. Upon inspection, the officers discovered a 38

caliber revolver with six bullets, which led to his immediate arrest.

Angelito was brought to the police station and faced the charges for

illegal possession of firearms and ammunition under RA 10591

Problem Statement
Given the circumstances of Angelito’s arrest and the evidence

presented, the primary legal questions to be resolved are:

1. Was Angelito in illegal possesion of the fire arm and

ammunition, as defined under Republic Act No. 10591?

2. Were Angelito’s constitutional rights respected during his

apprehension and subsequent arrest?

3. Is the prosecution’s evidence sufficient to prove Angelito’s

guilt beyond a reasonable doubt?

4. Did Angelito’s suspicious movement justify the warrantless

search as an exception to the general rule requiring a search

warrant?

5. Did the prosecution sufficiently prove that Angelito had

actual possession and control of the firearm and ammunition?

Case Presentation
Overviews: the case involves an individual, Angelito Ridon Y,

Guevarra, who was arrested for the unlawfut possession of a fire

arm under Republic set No. 10591. The case highlights the legal

frameworks surrounding the ownership and possession of firearms

in the Philippines. Purpose: This presentation aims to analyze the

details of the case, explore the legal implication of violating R.A

105a1, and discuss the Steps taken by law enforcement in handling

patroling on board a police mobile car at Macopa Street, Barangay

Comembo, Makati City, around 3:30 am on August 2 2023 P03 Pacis

ordered Angelits to stop because Haropa Street was a One-way

street, but intead of stopping, he took a u turn and drove towarde

Lanzones street. the police officer and Bantay Bayan Buera chased

Angelito and cornered him at Lanzones Street. White he fell along

with his motorcycle, as he stood up he acted as the would pull

something on his side. An act that prompted the officers and Bantay
Bayan, POS Limbawan and P03 Pacis pointed their guns at Angelito.

PO3 Cimbauan ordered Angelito not to move white P03 Paris Legal

Violations Unlawful Possession of Firearms (RA 10591) Under

Section 28 of RA 10591, the possession of any firearm without a

valid License is considered unlawful. Possible Additional Violation, If

it is proven that Angelito Ridon y. Guevarra used of intended to use

the firearm in the commission of a crime, additional charges may

apply under Revised Penal code for illegal possession of fire arms in

context of criminal activity. Investigation and Procedure: Initial

Actions by Law Enforcement, •P03 Pacis marked the firearm and the

ammunition in the presence of PO3 Limbawa and Angelito. After

that, they went to the Makati city criminal Investigation, section

Where they turned over the care and fire am to the investigater,

Special Police Officer || Rodrigo. • Angelito Ridon Y, Guevarra was

detained pending further investigation Evidence and witnesses:

Evidence: 1. Firearm and Ammunition Marked and turned over

by PO3 Pacis in the presence of PO3 Limbawa and Angelito Ridon y

Guevarra. The firearm and ammunition were submitted to Special

Police Officer II Rodrigo for investigation at the Makati City Criminal

Investigation Section. 2. Documentation Record of Angelito Ridon y

Guevarra's detention and the chain of custody of the firearm.

Reports detailing the seizure of the firearm without a valid license

as required under RA 10591. Witnesses: 1. PO3 Pacis Law

enforcement officer who marked the firearm and ammunition. 2.

PO3 Limbawa Present during the marking of the firearm and


ammunition. 3. Special Police Officer II Rodrigo Investigator who

received the firearm and ammunition. 4. Angelito Ridon y Guevarra

Suspect and primary individual in possession of the firearm.

Conclusion: Based on the evidence and witness testimonies, it

is clear that Angelito Ridon y Guevarra was found in possession of a

firearm and ammunition without a valid license, constituting a

violation of Section 28 of RA 10591 (Unlawful Possession of

Firearms). Furthermore, if it is proven that the firearm was used or

intended to be used in the commission of a crime, additional

charges under the Revised Penal Code may be applied. The proper

procedures were followed by law enforcement, including the

marking, documentation, and turnover of the firearm and

ammunition to the investigator. Angelito Ridon y Guevarra remains

detained pending further investigation to determine any additional

violations or aggravating circumstances. Thus, sufficient evidence

and witness testimonies exist to establish probable cause for the

unlawful possession of firearms.

Conclusion
In conclusion, the resolution of Angelito's case will depend on

several interrelated factors. If it is established that he possessed a

firearm and ammunition without the necessary licenses, he would

be guilty of illegal possession under Republic Act No. 10591.

However, any violations of his constitutional rights during his arrest

could undermine the legality of the proceedings and the

admissibility of evidence. The prosecution must also demonstrate

guilt beyond a reasonable doubt, which requires sufficient evidence

linking Angelito to the firearm and ammunition. Additionally, if his

suspicious movements justified a warrantless search, this could

further support the prosecution's case. Ultimately, the court will

need to carefully evaluate these elements to determine Angelito's

culpability and ensure that justice is served in accordance with the

law.

Abstract
The case of Angelito Rigidon involves significant legal

implications surrounding illegal possession of firearms and

ammunition, as governed by Republic Act No. 10591, also known as

the Comprehensive Firearms and Ammunition Regulation Act in the

Philippines.

In Rigidon’s situation, the prosecution establish two primary

elements to prove illegal possession: (1) The existence of the

firearm or ammunition in question , and (2) that Rigidon did not

possess a legal license to own such items. The law also says that

ignorance or lack of knowledge regarding the legality of possession

does not serve as a valid defense, given that act is considered

malum prohibitum, meaning it is inherently illegal regardless of

intent.

The case involved warrantless search and seizure of a firearm

from Ridon after he was stopped for a traffic violation. The Supreme

Court ruled that the warrantless search was invalid because the

traffic violation was not punishable by imprisonment, and therefore

did not justify the search. The court emphasized that violating

ordinances and regulations alone are insufficient to trigger a valid

warrantless search and seizure, especially when the penalty does

not involve imprisonment. This case highlights the importance of the

right against unreasonable search and seizure, a fundamental right

in the Philippine Constitution.
