PRODUCT WARRANTY

1. Limited Warranty

Under the terms of the Warranty Accura Valves Pvt. Ltd. ("Manufacturer") warrants every
valve ("Product") it manufactures and/or markets to be free from defects in material
quality or workmanship during its first tread life and warranty period. This warranty is
only applicable to our Products sold through the aftermarket/dealer network.

1.1 Operational Warranty Period

The warranty is valid for a period of one (1) year from the delivery date ("Warranty Period").
Accura Valves warrants that the Product, when used in accordance with the instructions
in the applicable documentation, will operate as described in the documentation in all
material respects. This warranty is valid exclusively for the first owner actually using the
covered Product and is non-transferable. Tampering with the Product will automatically
invalidate this warranty. This warranty is applicable provided that the customer provides
a valid receipt and original packaging from the time of sale.

1.2 Defects in Material or Workmanship

If examination reveals that a Product has failed under the terms of this clause, the
Manufacturer will replace the Product on a pro-rata wear basis.

The warranty does not cover damage arising from the following reasons:

a. Any damage or trouble caused by use beyond the specifications or selection conditions
of the Product or use under unspecified inappropriate conditions or environment;

b. Any damage or trouble caused by natural disaster.

c. Improper use, installation, or operation of the Product, not according to the


specification of the Product;

d. Insufficient or improper maintenance of the Product or Improper inspection or repair


of the Product;

e. Any damage or trouble caused by salt water.

f. Any damage caused by tire damage or irregular wear and tear

The warranty also does not cover:

a. If Product damaged due to fire, wreck, or vandalism.

b. If Product is purchased from unauthorized dealers;

c. Product worn off beyond the tread wear indicator (on either or any one side);

2.1 Modification Rights

a. The Manufacturer reserves the right to modify or alter the clause with or without any
advance intimation.

2.2 Final Decision

b. The decision of the Manufacturer's representative after investigation will be final.

2.3 Limitation of Liability

c. The Manufacturer's liability is limited to the cost of the Product only and does not
provide for compensation in case of incidental or consequential damages, including
loss of use of the Product and loss of time.

2.4 Non-Transferable

d. The warranty is applicable for the first owner of the Product and is not transferable.

2.5 Disposal of Rejected Products

e. All rejected Products, if not collected within fifteen (15) days of intimation of rejection,
will be disposed of, and the Manufacturer will not be liable for any loss after disposal.

2.6 No Other Guarantee or Warranty

f. Excluding the above, there is no other guarantee, warranty, or liability, express or


implied, applicable to the Product. No representative has the authority to make any
representation, promise, or agreement except as stated herein.

2.7 Unforeseen Product Failures

g. Any Product, no matter how well constructed, may fail in service or otherwise
become unserviceable due to conditions beyond the control of the Manufacturer.
This warranty is not intended as a representation that a Product failure cannot occur.

2.8 Variable Product Life

h. The Warranty Period does not represent the expected service life of the Product
covered under this warranty clause, as the Product's life is variable and dependent on
many factors.

2.9 Replacement Charges

i. The replacement charges (pro-rata basis) will be calculated based on the


Manufacturer's Net Billing Price (i.e., after-market price) prevailing at the time of the
final settlement of claims.

2.10 Customer Expenses

j. All applicable taxes on the new Product, balancing/alignment charges, and service
charges, if any, will be borne by the customer.

2.11 Governing Laws

k. Terms and conditions are governed by the laws in force in India and are irrevocably
and unconditionally binding.
