CONSUMER

PROTECTION
Republic Act No. 7394
PURPOSE
To protect the
interests of the
consumer, promote
his general welfare
and to establish
standards of conduct
for business and
industry.
ARTICLE 5. DECLARATION OF POLICY
– It shall be the duty of the State:
To develop and provide safety and quality standards for
consumer products, as well as the performance and the use of
the products;
To assist the consumer in evaluating the quality, including
safety, performance and comparative utility of consumer
products;
To protect the public against unreasonable risks of injury
associated with consumer products;
To undertake research on quality improvement of products and
investigation into causes and prevention of product related
deaths, illness and injuries; and
To assure the public of the consistency of standardized
products.
THE OBJECTIVES OF THIS ACT ARE THE FOLLOWING:
Protection against hazards to health and
safety; protection against deceptive, unfair
and unconscionable sales. acts, and practices;
Provision of information and education to
facilitate sound choice and the proper exercise
of rights by the consumer;
Provision of adequate rights and means of
redress; and
Involvement of consumer representatives in
the formulation of social and economic
policies.

ARTICLE 6. IMPLEMENTING AGENCIES
– The provisions of this Article and its implementing
rules and regulations shall be enforced by:

The Department of Health with respect to food,


drugs, cosmetics, devices and substances;

The Department of Agriculture with respect to


products related to agriculture, and;

The Department of Trade and Industry with respect


to other consumer products not specified above.

Developing and providing safety and quality

CHAPTER I: DECEPTIVE, UNFAIR, AND UNCONSCIONABLE
SALES ACTS OR PRACTICES

Purpose: To protect consumers from


dishonest selling practice and to ensure
businesses will deal buyers fairly, honestly,
and transparently.
Penalties: includes fines, cancellation of
license, return or refund requirements, and
even imprisonment (extreme case).
CHAPTER II: REGULATION OF PRACTICES RELATIVE TO
WEIGHTS AND MEASUREMENTS:
Purpose: To protect customers from being
shortchanged or deceived when buying products
that are sold by measurement (weighing scales,
meters, or rulers).
Right to Verification and re-testing as well as
Consumer’s right to check.
Penalties: includes fines, confiscation of devices
or goods, suspension of permits, possible
crimininal charges (repeated offenses).
CHAPTER III: CONSUMER PRODUCTS AND SERVICE
WARRANTIES
Purpose: To ensure consumers are protected
after buying a product or service - especially
when something goes wrong due to defects or
poor quality.
Penalties: includes fines, orders to refund,
repair, or replace, suspension of business
licenses.
The Department of Trade and Industry (DTI)
handles enforcement.
CHAPTER IV: LABELING AND FAIR PACKAGING
Purpose: To promote transparency and
honesty in the sale of consumer goods through
paper labeling and packaging, helping
consumers avoid deception.
Penalties: includes fines, product recalls,
andsuspension of business operations.

compliance like the DTI, DOH, and DA.
