NO. 88
Rules

and Regulations Requiring the Services of


Duly Registered Electronics and Communications
Engineer in the Planning and Designing, Installation
or Construction, Operation and Maintenance of
Radio Stations, and in the Manufacture and/or
Modification of Radio Communications Equipment.
December 28, 1972

SECTION 1
An applicant for a radio station construction permit shall submit
to the Radio Control Office for the necessary approval an
application therefor in the prescribed form supported by
engineering
plan(s)
and
design(s)
with
corresponding
specifications of the radio station to be constructed or to be
modified and the justifications of the project or system duly
signed
and
sealed
by
a
registered
Electronics
and
Communications
Engineer,
in
addition
to
the
required
administrative and legal requirements: Provided, That, this
Section shall not apply to amateur stations, Citizens Band radio
stations, land mobile or portable stations operating in the
UHF/microwave bands, aircraft stations in the non-commercial
service, ship low power radio-telephone stations, and stations in

SECTION 2
The installation or construction of a radio station for which a
Construction Permit had been issued shall be directly supervised by a
registered Electronics and Communications Engineer, and no license for
the operation of the station so constructed shall be issued unless a
certification by an Electronics and Communications Engineer to the effect
that the station was constructed or installed in accordance with the
approved specifications and that the construction or installation thereof
was under his direct supervision, is submitted and consequently duly
verified by the Radio Control Office: Provided, that this Section shall not
apply to amateur stations, Citizens Band radio stations, land mobile or
portable stations operating in the UHF/microwave bands, aircraft
stations in the non-commercial service, ship low power radiotelephone
stations, and stations in other communication services not utilized for
commercial purposes and operating on a multiplex basis with an

SECTION 3 : OPERATION
& MAINTENANCE
(a). The operation and maintenance of any radio communications system comprised of six
(6) or more of any type of land radio stations shall be under the supervision of a duly
registered Electronics and Communications Engineer: Provided, That, amateur stations,
paging stations, maritime mobile stations, land mobile or portable stations operating in
the UHF/microwave bands, aircraft stations, stations in the Citizens band radio service,
and radio training stations are exempted from the provisions of this Section.
(b). The operation and maintenance of any broadcasting system or network shall be under
the effective supervision of a duly registered Electronics and Communications Engineer:
Provided, That, radio broadcast stations in the standard AM broadcast band with a carrier
power not in excess of one (1) kilowatt, FM broadcast stations with an effective radiated
power not in excess of three (3) kilowatts, TV translators with an TV RF power boosters
with an effective radiated power not in excess of three (3) kilowatts, are exempted from
the provisions of this Section: Provided, Further that, affected radio stations already
licensed and operating prior to the promulgation of this Order shall comply with the
provisions of this Section within one (1) year from the date of its effectivity.

SECTION 4
No permit for the manufacture and/or modification of
radio communication equipment shall be granted unless
the applicant submits for the necessary approval the
design and specifications of the type of equipment to be
manufactured and/or to be modified duly signed and
sealed by a registered Electronics and Communications
Engineer, and additionally, in the case of manufacturing, a
statement by the applicant that the manufacturing
process shall be under the direct and effective supervision
of a registered Electronics and Communications Engineer.

SECTION 5
Any violation of or non-compliance with any
provision of this Order shall be dealt with in
accordance with the provisions of Act No.
3846, as amended, and/or RA No. 5734.

SECTION 6
Any previous Order, Circular or instruction or
part thereof that is inconsistent herewith is
superseded.

SECTION 7
This Order shall take effect immediately.

LAND MOBILE RADIO SERVICE AND ITS
OPERATORS

OPERATION
1. The equipment should be built and installed in
accordance with the standards of good engineering
practice. The frequency must be crystal-controlled.

2. Operators required in the land mobile service:
(a) Base station A base station shall be in the charge
of and operated by at least a second class radiotelegraph
or a second class radiotelephone operator duly licensed by
the Secretary of Public Works and Communications.
(b) Land Mobile station A land mobile station shall be
in the charge of a person holding either any class of
commercial radio operator license or a Restricted Land
Mobile Radiotelephone Operator Permit issued by the
Secretary of Public Works and Communications.

3. Term of Permit A restricted land mobile
radiotelephone operator permit may be issued for a
period not exceeding three years to any applicant
who shall have qualified in an appropriate written
examination.

4. General Qualification of Applicants - An applicant
for a restricted land mobile radiotelephone operator
permit
must
possess
the
following
general
qualifications:
(a) He must be at least 18 years of age.
(b) He must be of good moral character.
(c) He must be a citizen of the Philippines.
(d) He must be able to transmit and receive spoken
messages in the National Language, English or

5. Subject of Examination The examination
for a restricted land mobile radiotelephone
operator permit shall cover the radio laws and
regulations ( local and international ) now in
force in the Philippines, which govern the land
mobile service, secrecy of communications,
distress calls, interference, use of obscene or
profane language, willful damage to the
equipment, superfluous transmissions and the

6. Operators Authority - The holder of a
Restricted
Land
Mobile
Radiotelephone
Operator Permit may operate only land mobile
radio stations using type A-3 or F-3 emissions.

7. The following fees shall be paid to the Secretary of Public
Works and Communications:
a)

Examination fee for a Restricted Land Mobile


Radiotelephone permit = P3.00

b)

Annual Permit fee for a Restricted Land Mobile


Radiotelephone Permit = P3.00

c)

Radio station construction permit fee for either A land


mobile station or a base station = P5.00

d)

Annual license fee for a land mobile station = P20.00

e)

Annual license fee for a base station = P30.00

DEFINITIONS
8. Base Station The term base station means a
radio station in the land mobile service, which is not
intended for operation while in motion.
9. Land Mobile Station The term land mobile
station means a radio station in the land mobile
services, which is capable of surface movement within
the geographical limits of the country and which is
intended to be used while in motion or during halts
unspecified points.

DEFINITIONS
10. Land Mobile Service The term land mobile service
means a service of radio communication between base
station and land mobile station or between land mobile
stations or between land mobile stations.
11. Restricted Land Mobile Radiotelephone Operator
The term restricted land mobile radiotelephone
operator means a person duty qualified and licensed by
the Sectary of Public Work and Communication to
operate a land mobile station.

GENERAL
PROVISION
12. All provision of the Radio Control Law, Act No.
3846, as amended, and the regulations promulgated
hereunder which are not inconsistent herewith are
made a part hereof and shall have full force and effect
as to matters not otherwise treated herein.
