Karnataka Education Act 1983

• The government of Karnataka brought into force


the Karnataka education act -1983 on 1st of
June 1995

• The act deals with the ways and means of


solving several problems in education

The Kothari commission on education 1964-66


observed
• Education should be given a statutory basis
every where and in all sectors and education
acts should be passed in all the states and
union territories

Ramakrishna hedge government during 1983-

in the standard of education

• Enforcement of compulsory primary education
• Examinations prevention of mal –practice
• Classification and registration of educational
institution
• Recognition of educational institutions

educational institutions and local authority
intuitions
• Grants –in aid
• Accounts audit inspection of returns
• Prohibition of transfer of properties by aided
educational institutions
• Taking over management requisitioning and
acquisition of educational institution
• T erms and condition of service employees in
private educational institutions
• Control of private educational institutions
• Penalties
Compulsory primary education in specified
area
• The state government may ,by order direct
that with effect from the commencement of
such academic year

• Children with such age group as may be


specified in the order primary education shall
be compulsory in any area
Schemes for primary education
• The state government shall submit a scheme
for compulsory primary education

• it should be in the form as specified by state


government and must include the following
particulars
• The approximate number of children to whom the
scheme apply classified according to age and
mother tongue

• The area in which primary education will be


compulsory
• A list of existing approved schools and proposed
schools if any

 The number of teachers already employed and the


additional staff proposed

• The cost of the scheme

• Such other particulars as may be prescribed


Attendance authorities and their powers and duties

• A local authority the director of compulsory


education may appoint as many persons as it
or he think fit to be attendance authority to
prepare the list of children within the age
group for the scheme

• It is the duty of the attendance authority to


inform the parents ,if the child fails to attend
an approved school
• It shall be the duty of the parent of every
child to see that the child is attends to the
approved school
Reasonable excuse for non-attendance
• No approved school within the distance of
residence

• A school where religious instruction is given


which is not approved by the parent

• The child suffers from physical or mental


defect
• The child has been sanctioned temporary
leave any other proper reason not to attend
the school
• Special schools for physically or mentally
deficient children
• The authority directs such children to attend
the special classes
• it is the duty of the parent to make the child
to attend classes
Attendance orders
• if the parents fail to send the child to the
approved school an enquiry may be
conducted

• After inquiry if there are of proper reasons


the authority shall direct the child to attend
the school
• Children are not being employed so as to
prevent them from attending school

• Primary education should be free

• Age of child shall be computed for the


purpose of this act
RECOGNITIONS OF EDUCATIONAL INSTITUTIONS

• The granting of recognition shall be subject to


fulfillment of the following conditions

• Security deposit of the prescribed amount


shall be made within the time specified

• The governing council shall possess adequate


funds to run the institution
• Such other general and special conditions as may
be prescribed in regard to accommodation,
appointment of teaching and other staff ,
furniture and equipments syllabus textbooks

• Any local authority seeking recognition shall


make an application to the competent authority
furnishing such particulars and such manner as
may be prescribed by the government
• The competent authority after considering
the report received by expert body shall grant
recognition when the conditions are fulfilled
Recognition shall be withdrawn where any
local authority
• fails to fulfill the conditions of recognition

• Denied admission to any citizen on ground of


religion , race , caste language

• Directly or indirectly propagate to hurt the


religious feelings of any class or citizen
• Employs or continues to employ any teacher
whose certificate has been cancelled or
suspended by the competent authority

• Fails to remedy the defects in the instruction


or accommodation or deficiency in the
management or discipline
Grant- in- aid
• The state government shall within the limits of its
economic capacity set apart a sum of money
annually for being given as grant –in – aid

• The state government may sanction grant to any


recognized local authority or private educational
institution subject to condition as they may
impose in the order relating to such grants
• Every grant sanctioned shall be distributed by
the commissioner of public instruction or
director
• The governing council of every recognized
institution receiving any grant out of state
funds shall be responsible for the fulfillment
of all at the condition subject to which such
grant has been given
• Any money received by the way of voluntary
donations may be accepted by the institution
and the fact shall be intimated within 90 days
from the date of such acceptance

• This money shall be deposited in the amount


of the institution and expanded for the
improvement of the institution
• Every application for the sanction of grants
shall contain a declaration signed by
governing council of the recognized institution
